HomeMy Public PortalAboutORD14134 le BILL NO. 2006-105 As Amended SPONSORED BY COUNCILMAN Crane ORDINANCE NO. / Lj 3 L-f AN ORDINANCE SUBMITTING THE PROPOSED ORDINANCE REGARDING UNLIMITED OPEN BURNING OF YARD WASTE, PAPER, AND CARDBOARD, DURING DAYLIGHT HOURS,AS SUBMITTED BYAN INITIATIVE PETITION FROM REGISTERED VOTERS OF THE CITY OF JEFFERSON, MISSOURI AND SETTING THE DATE FOR SUCH ELECTION. WHEREAS, the City has received a valid petition pursuant to Article IX of the City Charter; and, WHEREAS, the City Clerk has certified that the required number of valid signatures of registered voters of the City appear on the petition and that the petition otherwise complies with the provisions of the Charter; and WHEREAS, the City Council has declined to enact the code provision proposed by the petitioners in substantially the same form; and, WHEREAS, the Charter requires the Council is such a case to place the issue before the voters within one year; NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The ordinance proposed by the petitioners shall be submitted to the qualified voters of the City of Jefferson, Missouri, for their approval, at the Election to be held on the Sixth day of November, 2007, at the places designated by the County Clerk for said Election and the ballot shall be in substantially the following form: Proposition 1 Shall the Code of the City of Jefferson be amended to allow unlimited open burning of yard waste, paper and cardboard in designated containers, during daylight hours only as set forth in the initiative petition submitted to the City? [ ] Yes [ ] No If you are in favor of the question, place an "X" in the box opposite "Yes". If • you are opposed to the question, place an "X" in the box opposite "No". Section 2. The Mayor and City Clerk shall prepare and execute the form of the Notice of said Election and shall transmit the same to the Election Authority for the City of Jefferson, Missouri, and request said election to be conducted by law. Section 3. This ordinance shall be in full force and effect from and after its passage and approval subject to the provisions herein contained which provide for voter approval or for specific dates of effectiveness.
