HomeMy Public PortalAboutORD14139 BILL NO. 2006-100 • SPONSORED BY COUNCILMAN Brown ORDINANCE NO. 1 )�9 AN ORDINANCE OF THE City OF JEFFERSON, MISSOURI, AMENDING THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI. BE IT ENACTED BY THE COUNCIL OF THE City OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article 8 of the Personnel Policy Manual is hereby amended by adding one Section to Chapter 8 to read as follows: Section 8-19. Safe Harbor Policy. Exempt employees are paid a predetermined weekly amount constituting all or part of the exempt employees compensation. With limited exceptions, the amount paid to exempt employees is not subject to reduction because an exempt employee works fewer hours on some weeks than other. In certain instances, deduction may be made for personal leave when all sick and • vacation leave is exhausted,for FMLA-qualifying absences,for jury or military duty, for violations of the City's safety or workplace conduct rules, or when Raid through the worker's compensation fund. This predetermined-amount will be paid to exempt employees for any week in which they Derform any work for the City. In the event that any of the above-mentioned deductions are taken from the predetermined amount, whether inadvertently, improperly, or otherwise, the following procedures will be followed by the City and any affected exempt employee- 1. The affected exempt employee should notify the Director of Human Resources or the Director of Finance that an improper deduction has been taken. 2. Upon otification by the affected exempt employee, the City will conduct a prompt and thorough investigation into the propriety of the complained-of deductions, and will make every effort to conclude that investigation in a reasonable amount of time. 3. If it is determined that any improper deductions have been taken,the City will make full reimbursement to the affected exempt employee and will make a good faith commitment to comply in the future with the applicable law and terms of this policy so that improper deductions will not be taken in the future. • It is the intention of the City to fully comply with all applicable state and federal laws that regulate the payment of wages and all other compensation to its employees. Accordingly,this policy is subject to revision as those laws may change Section 2. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed:�C-Z,?
