HomeMy Public PortalAbout065-1998 - Fixes Certain Benefits under the Fireman and Policeman Pension FundORDINANCE NO. 65-1998 A SPECIAL ORDINANCE FIXING CERTAIN BENEFITS UNDER THE FIREMAN AND POLICEMAN PENSION FUND FOR THE CITY OF RICHMOND WHEREAS, pursuant to I. C. 36-8-6-9.8 and I. C. 36-8-7-12.1, certain benefits are required to be paid to surviving spouses and surviving dependents of members of the 1925 Police Pension Fund and 1937 Firefighters Pension Fund respectively; and WHEREAS, pursuant to the above statutes, such retirement monthly amounts are to be fixed by City ordinance, but to a surviving spouse be not less than the greater of 30% of the monthly pay of a first class patrolman (or first class firefighter) or 55% of the monthly benefit the deceased member was receiving or was entitled to receive on the date of the member’s death, and to each dependent child of the member a monthly sum of not less than 20% of the monthly pay of a first class patrolman (or first class firefighter); and WHEREAS, the Boards of Trustees for the above Police Pension Fund and Firefighter Pension Fund have recommended the following percentages for payments to surviving spouses and dependent children. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, as follows: 1. Pursuant to I. C. 36-8-6-9.8, the monthly payment to a surviving spouse of a deceased police officer who was a member of the 1925 Police Pension Fund shall be the greater of 40% of the monthly pay of a first class patrolman or 55% of the monthly benefit of deceased member was receiving or was entitled to receive on the date of the member’s death. The monthly payment to any dependent child of such patrolman as defined within the above statute shall be 20%. 2. Pursuant to I. C. 36-8-7-12.1, the monthly payment to a surviving spouse of a deceased firefighter who was a member of the 1937 Firefighter Pension Fund shall be the greater of 40% of the monthly pay of a first class firefighter or 55% of the monthly benefit of deceased member was receiving or was entitled to receive on the date of the member’s death. The monthly payment to any dependent child of such firefighter as defined within the above statute shall be 20%.
