PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR CRUSE - NICHOLSON President Quinn called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor, Karen Chasteen, City Clerk; Stephanie Hays - Mussoni, Kumar Jensen & Scott Hess, COPE; Sue Routson and student representatives of Richmond High School Peer Helpers; ICm Vessels, Assistant City Attorney; Tony Foster, Director of Metropolitan Development. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting held May 7, 2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • Peer Helpers in conjunction with Students Against Destructive Driving presented a Proclamation for signature by all Councilors and the Mayor COMMUNICATION FROM THE MAYOR - None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 3 and 10, 2012, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS — None MISCELLANEOUS BUSINESS ■ Mr. Quinn asked if radios for Reserve Officers could be added to the budget. The Mayor will look into this. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 25 -2012 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Common Council Minutes May 21, 2012 Page 2 of 4 ORDINANCE NO. 25 -2012 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE AREA 9 AGENCY The Clerk read Ordinance No. 25 -2012 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to Area 9 Agency and to accept said grant funding in an amount up to Forty Two Thousand Two Hundred Nineteen Dollars and Zero Cents ($42,219.00). Matching funds from Roseview Transit Rider donations and the City of Richmond, Indiana, in the amount of Seven Thousand Four Hundred Fifty Dollars and Forty -One Cents ($7,450.41) shall be appropriated to support this grant application. If awarded, these funds shall be appropriated to help fund the Roseview Transit transportation services for fiscal year 2012 to 2013. Mr. vessel moved to advance Ordinance No. 25 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 25 -2012 on second reading by title only. Council President Quinn declared Ordinance No. 25 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 25- 2012, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 25 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 25 -2012 on third reading by title only. Ordinance No. 25 -2012 was adopted with a 9-0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 17 -2012 — A GENERAL ORDINANCE ADDING A SECTION TO THE CITY OF RICHMOND CODE CHAPTER 32 — Environmental Sustainability Commission The Clerk read Ordinance No. 17 -2012 on second reading by title only. The intent of this Ordinance is to coordinate and inform efforts to promote environmental sustainability and conservation of natural resources, for the greater good of the public of Richmond, Indiana by creating an Environmental Sustainability Commission Ms. Vessels recommended the following amendments: Page 2, paragraph (b), Composition, to read: the Commission shall consist of nine (9) voting members . The voting members shall be initially appointed by the Mayor of the City of Richmond, Indiana, subject to the approval of the Common Council of the City of Richmond, Indiana. Subsequent appointment of voting members as terms become open shall be made by nomination and vote of existing Commission members (requiring at least 213 approval), subject to the approval of the Mayor and Common Council of the City of Richmond. The members of the Commission should include persons knowledgeable and engaged in matters of sustainability, conservation, and environment and involved and committed to promoting such matters in Richmond. As environmental concerns cannot be contained within a political subdivision, membership of individuals residing outside of the Richmond City limits is allowed, however, no more than three (3) of the Commission members may live outside the City and if is recommended that any nonresident members be residents of Wayne County or residents of counties adjacent to Wayne County . To ensure that the Commission represents a wide range of interested Common Council Minutes May 21, 2012 Page 3 of 4 constituencies and stakeholders, as necessary for its advisory and coordinating role, the Commission should indude representatives actively associated with the (following constituencies... Paragraph (c), Terrn, to read: ... vacancy shall be filled by nomination and vote of existing Commission members (requiring at least 21.3 approval), subject to the approval of the Mayor and Common Council of the City of Richmond, within ninety (90) days from the time of vacancy. The new member shall serve for the unexpired duration of the term of the member who is being replaced. There is no limit to the number of terms or consecutive terms that a member may serve. Mr. Miller moved to amend as recommended, supported by Mr. Parker. This motion carried with an 8 -1 roll call vote. Dissenting was Ms. Hollis. Council President Quinn declared Amended Ordinance No. 17 -2012 on second reading and public hearing. Speaking in favor was Ms. Hays - Mussoni, Messers. Jensen and Hess. There being no comments against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Amended Ordinance No. 17 -2012, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Amended Ordinance No. 17 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 17 -2012 on third reading by title only. Amended Ordinance No. 17 -2012 was adopted with an 8-1 roll call vote. Dissenting was Mr. Miller. ORDINANCE NO. 21 -2012 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (Suncall —equipment) The Clerk read Ordinance No. 21 -2012 on second reading by title only. This Ordinance is a request of Suncall America, Inc. for a ten -year tax abatement on equipment valued at Two Million Five Hundred Eight Thousand Nine Hundred Seventy Six Dollars and zero cents ($2,508,976.0. The Tax Abatement Committee recommended approval. Council President Quinn declared Ordinance No. 21 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 21- 2012, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 21 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Cleric read Ordinance No. 21 -2012 on third reading by title only. Ordinance No. 21 -2012 was adopted with a 9-0 roll call vote. ORDINANCE NO. 22 -2012 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (Suncall —real estate) The Clerk read Ordinance No. 22 -2012 on second reading by title only. This Ordinance is a request of Suncall America, Inc. for a ten -year tax abatement on real estate valued at Four Hundred Eighty Two Thousand Six Hundred Seventy Sox Dollars and thirty one cents ($482,676.31). Common Council Minutes May 21, 2012 Page 4 of 4 Mr. vessel moved to amend Ordinance No. 22 -2012 to reflect the number of additional employees as ten (10) in lieu of eleven (11), supported by Mr. wnget. Upon a vote viva voce, the motion passed. The Tax Abatement Committee recommended approval. Council President Quinn declared Amended Ordinance No. 22 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Amended Ordinance No. 22 -2012, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. vessel moved to advance Amended Ordinance No. 22 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Cleric read Amended Ordinance No. 22 -2012 on third reading by title only. Amended Ordinance No. 22 -2012 was adopted with a 9-0 roll call vote.
