PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Quinn called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Lary Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor, Karen Chasteen, City Cleric; Tammy Glenn, City Controller; Bill Thistlethwaite, Superintendent of Parks and Recreation; Sue Roberson, Director of Human Resources; Greg Steins, Director of Public Works; Tony Foster, Director of Metropolitan Development; Jason Whitney, Center City Development; Peter Zaleski, Wayne County Council; David Brock; Steve Nicholson; Kim Vessels, Assistant City Attorney; and Brett Guiley, Economic Development Corporation of Wayne County. APPROVAL OF MINUTES Ms. Hollis moved to approve the minutes of the meeting held May 21, 2012, supported by Mr. Oler. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ There will be a ribbon cutting at the Cardinal Greenway Williamsburg Trailhead June 23, 9:30 a.m. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 17 & 24, 2012, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • ECONOMIC DEVELOPMENT CORPORATION OF WAYNE COUNTY: Council liaison to the EDCWC, Mr. Gulley presented a macro view of the EDC's activities in 2012 • STATE OF INDIANA SMOKING BAN UPDATE: Mr. Chidester reviewed the Indiana Smoking Ban statute which will take effect July 1, 2012. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 26, 27, 28, 29, 30, 31, 32 & 33 -2012 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 26 -2012 — A GENERAL ORDINANCE AMENDING SUBSECTION 74.47(1) OF THE RICHMOND CITY CODE (parking passes) The Clerk read Ordinance No. 26 -2012 on first reading by title only. Presented by Ms. Vessels, this Ordinance would amend Subsection 74.47(1) of the Richmond City Code, to read: (i) New businesses (defined as any business moving into or starting as a new business in the Uptown area on or offer June 4, 2012, which area shall be bounded by the Whitewater River to the west, 14"' Street to the east, North "A" Street to the north and South 'W Street to the south) that agree to purchase monthly parking passes for all they employees shall receive free panting passes for the first and second years . Parking passes will be full price for the third and following years. Mr. Wissel moved to advance Ordinance No. 26 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 26 -2013 on second reading by title only. Council President Quinn declared Ordinance No. 26 -2012 on second reading and public hearing. Speaking in favor of the Ordinance was Mr. Whitney. There being no comments against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 26 -2012, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 26 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 26-2012 on third reading by title only. Ordinance No. 26 -2012 was adopted with a 9-0 roll call vote ORDINANCE NO. 27 -2012 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (Clerk's Office) The Clerk read Ordinance No. 27 -2012 on first reading by title only. Presented by Ms. Glenn, this Ordinance would authorize an additional appropriation In the amount of Five Hundred Ninety Eight Dollars and Zero Cents ($598.00) to the 2012 budget of the Office of the City Clerk. Mr. Miller asked Council to not suspend the rules and read Ordinance No. 27 -2012 on second reading at the next Council meeting. This will allow time to investigate another source of funds rather than an additional appropriation. Ordinance No. 27 -2012 will be heard on second reading July 2, 2012. Common Council Minutes June 4, 2012 Page 3 of 5 ORDINANCE NO. 28 -2012 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE FEDERAL HIGHWAY ADMINISTRATION (So. °E" Street Rehab) The Clerk read Ordinance No. 28-2012 on first reading by title only. Presented by Mr. Steins, this Ordinance would authorize the submittal of a grant application to the Federal Highway Administration, and to accept said grant funding in an amount up to Two Million Forty - six Thousand Dollars and Zero Cents ($2,046,000.00). The Mayor has pledged EDIT funds in the amount of Five Hundred Eleven Thousand Five Hundred Dollars and Zero Cents ($511,500.00) in order to meet the local match required for the grant. If awarded, grant funding shall be appropriated to help fund the South E Street Road Rehabilitation Phase II Project. Mr. vessel moved to advance Ordinance No. 28 -2012 to second reading, suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion failed. Dissenting was Ms. Hollis. Ordinance No. 28 -2012 will be heard on second reading July 2, 2012. ORDINANCE NO. 29 -2012 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 (B&F Plastics) The Clerk read Ordinance No. 29 -2012 on first reading by title only, Presented by Mr. Wissel, this Ordinance is a petition of B &F Plastics for a ten -year tax abatement on equipment valued at Six Hundred Thirty Thousand Dollars and zero cents ($630,000.00). Ordinance No. 29 -2012 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 30 -2012 — A SPECIAL ORDINANCE ADOPTING NEPOTISM POLICY AND CONTRACTING WITH A UNIT BY A RELATIVE POLICY IN ACCORDANCE WITH IC 36 -1 -20.2 AND IC 36 -1 -21 (HEA 1005 CONFLICT OF INTEREST AND NEPOTISM EFFECTIVE JULY 1, 2012) The Clerk read Ordinance No. 30 -2012 on first reading by title only. Presented by Ms. Vessels, this Ordinance would establish a policy of conduct with regard to nepotism in the employment with the City of Richmond and in contracting with the City of Richmond in order to continue to be able to provide local government services to its residents and to comply with the new laws effective July 1, 2012 known as IC 36-1 -20.2 and IC 36 -1 -21, respectively. Mr. Miller moved to amend Ordinance No. 30 -2012, page 2, paragraph No. 3, last sentence to read: The "new hire" provisions of this policy does not affect people hired prior to July 1, 2012. This motion was supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Amended Ordinance No. 30 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 30 -2012 on second reading by title only. Council President Quinn declared Amended Ordinance No. 30 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse- Nicholson moved for engrossment of Amended Ordinance No. 30 -2012, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 30 -2012 on third reading by title only. Amended Ordinance No. 30 -2012 was adopted with a 9-0 roll call vote ORDINANCE NO. 31 -2012 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM MEDIUM DENSITY SINGLE - FAMILY RESIDENTIAL DISTRICT TO HIGH IMPACT DISTRICT The Cleric read Ordinance No. 31 -2012 on first reading by title only. Presented by Mr. Foster, this Ordinance would change the zoning designation of real estate located at 1400 South 21 st Street to a High Impact (HI) District in order to allow the correction of the zoning so that it is consistent with the current land use. Ordinance No. 31 -2012 was referred to the Plan Commission for Public Hearing on June 28, 2012. ORDINANCE NO. 32 -2012 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM HIGH INTENSITY INDUSTRIAL DISTRICT TO INSTITUTIONAL DISTRICT The Clerk read Ordinance No. 32 -2012 on first reading by title only. Presented by Mr. Foster, this Ordinance would change the zoning designation of real estate commonly known as King Cemetery at the western end of NW "N" Street and north of the Norfolk and Western Railroad to an Institutional District in order to allow the correction of the zoning so that it is consistent with the current land use. Ordinance No. 32 -2012 was referred to the Plan Commission for Public Hearing on June 28, 2012. ORDINANCE NO. 33 -2012 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM GENERAL COMMERCIAL DISTRICT TO INTENSE MULTIPLE- FAMILY RESIDENTIAL DISTRICT The Clerk read Ordinance No. 33 -2012 on first reading by title only. Presented by Mr. Foster, this Ordinance would change the zoning designation of real estate located at 2507 Chester Boulevard to an Intense Multiple - family Residential District in order to allow the development of a student housing complex for Indiana University East. Ordinance No. 33 -2012 was referred to the Plan Commission for Public Hearing on June 28, 2012.
