PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PARKER President Quinn called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Tim Parrot, Deputy Fire Chief; Danny Sexton, AFSCME 1791; Linda Wolski and Kris Wolski, Police Chief; Bill Harris and Denise Johnson, Sanitary District; Tony Foster, Metropolitan Development; Terry Quinter, Roseview Transit; Sue Roberson, Human Resources; Tammy Glenn, Department of Finance; Monica Burns, Wayne County Councilor; George Sowers, Attorney; Susan Isaacs, Wayne Township Trustee; Jerry Day; Lynn Loring; Aaron Loring; Dan Bolling; Chris Hardie; members of the media; and, the Sargeant at Arms. APPROVAL OF MINUTES The minutes of July 16, 2012 were held for approval until August 20, 2012. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ Wayne County Republican Chair, Misty Hollis, presented a portrait of Bing Welch to the City of Richmond. This practice is to honor a deceased Councilor who served at least twelve years. Mr. Welch was a Councilor -at -large 1978 -1983 and 5th District Councilor 1996 -2012. Mr. Welch passed away in January. This portrait will be displayed in the Council Chambers. COMMUNICATION FROM THE MAYOR • The fountain in Glen Miller Park lake was dedicated August 5 • Representatives from our sister city in Japan will be arriving soon. The delegation includes students and government employees. • Now that the weather is cooler, it is a good time to clean alleys. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 12 & 19, 2012, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ Dr. Oler presented an Economic Development Corporation update. The new contract will be four years in lieu of five. This will give elected officials with four year terms a better opportunity to work with EDC. MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 42, 43, 44, 45, 46, 47 & 48 -2012 on first reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 42 -2012 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE FEDERAL TRANSIT ADMINISTRATION (Roseview) The Clerk read Ordinance No. 42 -2012 on first reading by title only. Presented by Ms. Quinter, this Ordinance would authorize the City of Richmond, by and through Rose View Transit to apply for and accept grant funding in an amount up to Eight Hundred Seventy -one Thousand One Hundred Sixty-five Dollars and Zero Cents ($871,165.00), of which $496,193 are federal (USDOT) grant funds and of which $374,972 are state (INDOT) grant funds. The City will provide up to One Hundred Fifty Nine Thousand Seven Hundred Ninety-one Dollars and Zero Cents ($159,791.00) in local EDIT funds towards transportation services in 2013. If awarded, these funds shall be appropriated to assist with operating expenses for Rose View Transit for 2013. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 42 -2012, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 42 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 42 -2012 on third reading by title only. Ordinance No. 42 -2012 was adopted with an 8 -1 roll call vote. Dissenting was Ms. Hollis. ORDINANCE NO. 43 -2012 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (First Response) The Clerk read Ordinance No. 43 -2012 on first reading by title only. Presented by Deputy Fire Chief Parrot, this Ordinance would authorize the appropriation of Thirty Thousand Dollars and zero cents ($30,000.00) into the First Response Fund. These funds have been collected for Emergency Medical Services by the Fire Department and are available for this use. Mr. Winget moved to advance Ordinance No. 43 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 43 -2012 on second reading by title only. Council President Quinn declared Ordinance No. 43 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 43- 2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 43 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 44 -2012 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM INDIANA CRIMINAL JUSTICE INSTITUTE (RPD -OPO Program) The Clerk read Ordinance No. 44 -2012 on first reading by title only. Presented by Chief Wolski, this Ordinance would allow the City of Richmond Police Department to accept grant funding in an amount up to Thirty Thousand Dollars and Zero Cents ($30,000.00) from the Indiana Criminal Justice Institute, Drug & Crime Control Division, through its overtime pay program to pay for officers to work with the Operation Pull Over (OPO)/Buckle Up Directive project, outside of their current assignments. Mr. Parker moved to advance Ordinance No. 44 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 44 -2012 on second reading by title only. Council President Quinn declared Ordinance No. 44 -2012 on second reading and public hearing. Mr. Wissel moved to advance Ordinance No. 44 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 45 -2012 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM INDIANA CRIMINAL JUSTICE INSTITUTE (RPD -DUI Task Enforcement) The Clerk read Ordinance No. 45 -2012 on first reading by title only. Presented by Chief Wolski, this Ordinance would allow the City of Richmond Police Department to accept grant funding in an amount up to Thirty Six Thousand Dollars and Zero Cents ($36,000.00) from Indiana Criminal Justice Institute, Drug & Crime Control Division, through its overtime pay program to pay for officers to work with the DUI Task Enforcement project, outside of their current assignments. Mr. Parker moved to advance Ordinance No. 45 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 46 -2012 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM URBAN RESIDENTIAL DISTRICT TO INTENSE MULTIPLE RESIDENTIAL DISTRICT (702 N 13th) The Clerk read Ordinance No. 46 -2012 on first reading by title only. Presented by Mr. Foster, this is a petition to rezoning a property at 701 North 13th Street, formerly known as Nicholson School, from Urban Residential District to Intense Multiple - family Residential District. The property owner, Richmond Housing Authority, has long planned to use the property for residential development. They now have a development firm interested in implementing that plan. Ordinance No. 46 -2012 was referred to the Advisory Plan Commission for its August public hearing. ORDINANCE NO. 47 -2012 - A SPECIAL ORDINANCE VACATING A PUBLIC WAY (part of South "O ", "P" and 20th Streets) The Clerk read Ordinance No. 47 -2012 on first reading by title only. Presented by Mr. Foster, this is a petition to vacate portions of South 20th , South "O" and South "P" Streets in the Richards Addition.. The adjoining property owner, Wernle Children's Home, would like to consolidate lots they own in that area. Ordinance No. 47 -2012 was referred to the Advisory Plan Commission for its August public hearing. ORDINANCE NO. 48 -2012 — A SPECIAL ORDINANCE AMENDING ORDINANCE NO. 3 -2012 AND AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION OF MEMORIAL DISPLAYS LOCATED IN THE VETERANS MEMORIAL PARK The Clerk read Ordinance No. 48 -2012 on first reading by title only. This Ordinance would amend Ordinance No. 3 -2010 with the following updated list and authorize the City of Richmond to accept this donation: 1. Memorial Shelter 2. Vietnam Wall 3. World War 1 Display 4. World War II Display 5. Korean War Display 6. All Conflicts 7. Granite Tiles (10) 8. Granite Benches (3) 9. Brick Work 10. Lighting 11. Iraq and Afghanistan 12. Tanks (2) Mr. Miller moved to advance Ordinance No. 48 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 48 -2012 on second reading by title only. Council President Quinn declared Ordinance No. 48 -2012 on second reading and public hearing. Speaking against was Mr. Day who expressed concern about the design of the Iraq /Afghanistan memorial and feels the message is not clear. Ordinance No. 48 -2012 was held on second reading by consensus of Council until this concern is addressed. ORDINANCES ON SECOND READING ORDINANCE NO. 32 -2012 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM HIGH INTENSITY INDUSTRIAL DISTRICT TO INSTITUTIONAL DISTRICT (King Cemetery — end of NW "N" Street) The Clerk read Ordinance No. 32 -2012 on second reading by title only. This Ordinance would change the zoning designation of real estate commonly known as King Cemetery at the western end of NW "N" Street and north of the Norfolk and Western Railroad to an Institutional District in order to allow the correction of the zoning so that it is consistent with the current land use. Council President Quinn declared Ordinance No. 32 -2012 on second reading and public hearing. Speaking in favor was Mr. Sowers. There being no comments against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 32 -2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 40 -2012 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 50- 2011 KNOWN AS THE 2012 SALARY ORDINANCE (Finance) The Clerk read Ordinance No. 40 -2012 on second reading by title only. Common Council Minutes August 6, 2012 Page 6 of 6 Indiana American Water is terminating their contract for the billing of the Sanitary District. This Ordinance would authorize the addition of two employees to the Department of Finance in the capacity of "billing clerks" to assist with the processing of payments. Mr. Miller moved to amend Ordinance No. 40 to reflect the Bi- Weekly pay for these positions as $1,072.22, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Council President Quinn declared amended Ordinance No. 40 -2012 on second reading and public hearing. Speaking against was Ms. Loring, Mr. Day, Ms. Burns, Mr. Sexton, and Mr. Loring. There being no comments for the Ordinance, Mr. Miller moved for engrossment of amended Ordinance No. 40 -2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance amended Ordinance No. 40 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read amended Ordinance No. 40 -2012 on third reading by title only. Amended Ordinance No. 40 -2012 was adopted with a 5-4 roll call vote. Dissenting was Ms. Cruse - Nicholson; Ms. Hollis; Messrs. Miller and Quinn. ORDINANCE NO. 41 -2012 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor) The Clerk read Ordinance No. 41 -2012 on second reading by title only. This Ordinance is a petition of Vendor Corporation for a ten -year tax abatement on equipment valued at Two Million Four Hundred Seventy One Thousand Seven Hundred Ninety Dollars and zero cents (2,471,790.00). The Tax Abatement Committee recommended approval. Council President Quinn declared Ordinance No. 41 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 41- 2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed.
