City of Richmond, Indiana met in regular session August 20, 2012 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR HOLLIS President Quinn called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Bruce Wissel, Clayton Miller, Don Winget, Lary Parker, Misty Hollis, Ron Oler and Phil Quinn. Absent was Kelley Cruse - Nicholson. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Lynn Loring; Steve Swoveland, RSD Pre - Treatment Coordinator; Tim Parrott, EMS Deputy FD Chief; Bill Thistlethwaite, Parks & Recreation; Sue Roberson, Human Resources; Jerry Day; Representatives of the Wayne County Veterans Memorial Committee; members of the media; and, the Sargeant -at -arms. APPROVAL OF MINUTES Ms. Hollis moved to approve the minutes of the meetings held July 16 and August 6, 2012, supported by Mr. Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • Many citizens are cleaning their properties and alleys • Concrete work and paving projects are being finalized REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the August 2, 8 & 9, 2012, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None MISCELLANEOUS BUSINESS A meeting of the Committee of the Whole is scheduled for September 10, 7 pm, in the Council Chambers. This will be public hearing for Ordinance No. 39 -2012 which is regarding an adjustment in sewer rates. Common Council Minutes August 20, 2012 Page 2 of 3 ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 49 -2012 on first reading by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. ORDINANCE NO. 49 -2012 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (First Response — RFD) The Clerk read Ordinance No. 49 -2012 on first reading by title only. This Ordinance would transfer Eighteen Thousand Dollars ($18,000.00) from revenues generated by Fire Department Emergency Medical Services to be used by First Response for part time EMS employees and laptop computers. Mr. Miller moved to advance Ordinance No. 49 -2012 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 49 -2012 on second reading by title only. Council President Quinn declared Ordinance No. 49 -2012 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 49 -2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No.49 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 49 -2012 on third reading by title only. Ordinance No. 49 -2012 as adopted with a 7 -1 roll call vote. flisnting was Ms+iis: ORDINANCES ON SECOND READING AMENDED ORDINANCE NO. 72 -2011 — A GENERAL ORDINANCE AMENDING CHAPTER 54 OF RICHMOND CITY CODE AND ADOPTING AN ENFORCEMENT RESPONSE GUIDE The Clerk read Amended Ordinance No. 72 -2011 on second reading by title only. The USEPA is currently requiring Municipalities with industrial and commercial pretreatment programs update the language and discharge limits within their local ordinances. The required modification consists of updating language in Chapter 54 and the Enforcement RespOnse Guide to be consistent with rule changes in the National Pretreatment Streamlining Rules found in 40 CFR Part 403. Council President Quinn declared Amended Ordinance No. 72-2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Amended Ordinance No. 72 -2011 and the Pretreatment Enforcement Management Plan and Enforcement Response Guide, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Amended Ordinance No. 72 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 72 -2011 on third reading by title only Amended Ordinance No. 72 -2011 as adopted with an 8 -0 roll call vote Common Council Minutes August 20, 2012 Page 3 of 3 ORDINANCE NO. 48 -2012 — A SPECIAL ORDINANCE AMENDING ORDINANCE NO. 3 -2012 AND AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION OF MEMORIAL DISPLAYS LOCATED IN THE VETERANS MEMORIAL PARK The Clerk read Ordinance No. 48 -2012 on second reading by title only. This Ordinance would amend Ordinance No. 3 -2010 with the following updated list and authorize the City of Richmond to accept this donation: 1. Memorial Shelter 8. Granite Benches (3) 2. Vietnam Wall 9. Brick Work 3. World War 1 Display 10. Lighting 4. World War 11 Display 11. Iraq and Afghanistan 5. Korean War Display 12. Women's Display 6. All Conflicts 13. Purple Heart Display 7. Tanks (2) Council President Quinn declared Ordinance No. Speaking to the Ordinance was Jerry Day, Nick engrossment of Ordinance No. 48 -2012, supported passed. 48 -2012 on second reading and public hearing. Upon a vote viva voce, the motion Mr. Wissel moved to advance Ordinance No.48 -2012 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 48 -2012 on third reading by title only. Mr. Miller requested he be allowed to abstain due to his work with the Memorial Committee. Mr. Wissel moved for Mr. Miller to abstain from voting, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Ordinance No. 48 -2012 as adopted with a 7-0 roll call vote. Abstaining was.Mr..
