HomeMy Public PortalAbout2008-020 Resolution Denying Variance from Setback Requirements of Sign for Holy Name ChurchMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2008 -20 RESOLUTION DENYING A VARIANCE FROM SETBACK REQUIREMENTS OF THE SIGN FOR HOLY NAME CHURCH FOR PROPERTY LOCATED AT 155 COUNTY ROAD 24 WHEREAS, Holy Name of Jesus Catholic Church (the "Applicant") has requested approval from the City of Medina (the "City") for a variance from the setback requirements of the sign ordinance to allow a monument sign to be constructed five (5) feet from the right-of-way on property located at 155 County Road 24 (the "Property"), legally described as follows: Lot 1, Block 3, Holy Name Church; and WHEREAS, the Planning Commission reviewed the application on April 8, 2008, and testimony was heard from the Applicant, city staff, and other interested parties; and WHEREAS, the Planning Commission recommended denial of the variance request; and WHEREAS, the City Council reviewed the application on April 15, 2008 for conformance with the ordinances of the City, considered the recommendation of the Planning Commission, and heard comments from the Applicant, city staff, and other interested parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that it should and hereby does deny the request by Holy Name of Jesus Catholic Church for a variance from the sign setback requirements in the sign ordinance based on the following findings: 1. The topography of the site, nearby trees and existing street signage along County Road 24 do not result in a hardship on the Property. 2. Various alternatives exist which allow the Applicant to construct reasonable signage in a way which abides by the regulations of the sign ordinance. 3. The conditions described above are not unique to the property within the Suburban Residential zoning district. Resolution No. 2008-20 April 15, 2008 BE IT FURTHER RESOLVED that the Applicant shall pay to the city a fee in an amount sufficient to reimburse the costs and fees incurred for the review of the variance request subject to Subd. 2 of Section 815.31 of the city code.
