PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOODWIN President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Lary Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Tony Foster, Metropolitan Development; Mike Cawley, Fire Chief; Pat Welch, Ron Oler, Misty Hollis, Dave Stidham; Karen Chasteen, City Cleric; Waft Chidester, City Attorney; Sally Hutton, Mayor. . APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting of February 7, supported by Mr. Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • City wide cleanup will begin April 16 and continue weekly thereafter • Government 101 classes are scheduled for March 1, 8 & 15 —6-8:00 pm • The Gorge cleanup will be April 9 • The 800 block of East Main will be closed on February 25 to allow major pipe repair REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY There were no minutes to be presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • POLICE MERIT COMMISSION: Dr. Amy Viano has expressed interest in serving another term. This appointment was held until March 7 to allow time for additional nominations. MISCELLANEOUS BUSINESS None Common Council Minutes February 22, 2011 Page 2 of 4 ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 7, 8, 10, 11, 13 & 14 -2011 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 7 -2011 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR CERTAIN PARCELS FROM INSTITUTIONAL (IS) DISTRICT TO CENTRAL BUSINESS (CB) DISTRICT (Wayne County Historical Museum) The Clerk read Ordinance No. 7 -2011 on first reading by title only. Presented by Mr. Foster, this Ordinance is a petition to rezone the Wayne County Museum property from Institutional Zoning District to Central Business District. The property to be rezoned is the block between North A and North B Streets and between North 11th and North 12th Streets. The museum now owns the entire block and the zoning change will lessen the need for any variance of development standards. Ordinance No. 7 -2011 was referred to the Richmond Advisory Plan Commission for public hearing on February 24, 2011. ORDINANCE NO. 8-2011 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM GENERAL COMMERCIAL (GC) DISTRICT TO MEDIUM DENSITY SINGLE - FAMILY RESIDENTIAL (R2) DISTRICT (23 Sunset Drive) The Clerk read Ordinance No. 8 -2011 on first reading by title only. Presented by Mr. Foster, this Ordinance is a petition to rezone the property at 23 Sunset Drive. The property, which is accessed through Spring Grove, is zoned for commercial use but has always been a residential property. The zoning change is necessary to reflect current land use and is requested by the property owners. Ordinance No. 8 -2011 was referred to the Richmond Advisory Plan Commission for public hearing on February 24, 2011. ORDINANCE NO. 10 -2011 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY (ALLEY) (Wayne County Museum) The Clerk read Ordinance No. 10 -2011 on first reading by title only. Presented by Mr. Foster, this Ordinance is a petition to vacate a portion of the alley running north and south between North A and North B Streets behind the Wayne County Museum. The Museum owns the entire block and the vacation will allow the Museum to best access and develop their property. Ordinance No. 10 -2011 was referred to the Richmond Advisory Plan Commission for public hearing on February 24, 2011. ORDINANCE NO. 11 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6.1.1 -12.1 (B&F Plastics Acquisition Inc) The Cleric read Ordinance No. 11 -2011 on first reading by title only. Presented by Mr. Wissel, this Ordinance is a request of B &F Plastics Acquisition Inc. for a ten year tax abatement on equipment valued at Seven Hundred Ten Thousand Five Hundred Dollars and zero cents ($710,500.00). ORDINANCE NO. 13 -2011 — A GENERAL ORDINANCE AMENDING RICHMOND CITY CODE CHAPTER 80 (RICHMOND FIRE DEPARTMENT RESPONSES TO EMERGENCY MEDICAL CALLS) The Clerk read Ordinance No. 13 -2011 on first reading by title only. Presented by Mr. Crawley, this Ordinance would amend Chapter 80 of the Richmond City Code dealing with costs that may be recouped by the Richmond Fire Department for emergency medical responses. Ordinance No. 13 -2011 was referred to the Finance Committee for due diligence. ORDINANCE NO. 14 -2011 — A GENERAL ORDINANCE CREATING RICHMOND CITY CODE CHAPTER 81 (RICHMOND FIRE DEPARTMENT RESPONSES TO MOTOR - VEHICLE ACCIDENTS) The Clerk read Ordinance No. 14 -2011 on first reading by title only. Presented by Mr. Crawley, this Ordinance would create Chapter 81 of the Richmond City Code dealing with non - medical costs that may be recouped by the Richmond Fire Department for services when responding to motor - vehicle accidents. Ordinance No. 14 -2011 was referred to the Finance Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 5 -2011 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Silgan White Cap Corp) The Clerk read Ordinance No. 5 -2011 on second reading by title only. Presented by Mr. Wissel, this Ordinance is a request of Silgan White Cap Corp for a ten year tax abatement on equipment valued at Eight Hundred Seventy Thousand Five Hundred Dollars and zero cents ($870,500.00). The Tax Abatement Committee recommended approval. Council President Pappin declared Ordinance No.5 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No.5- 2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No.5 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No.5 -2011 on third reading by title only. Ordinance No.5 -2011 was adopted with a 9-0 roll call vote.
