PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR CRUSE- NICHOLSON President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard 'Jack' Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Sarah "Sally' Hutton, Mayor, Walt Chidester, City Attorney; Karen Chasteen, City Clerk; Tony Foster, Director of Metropolitan Development; Tammy Glenn, City Controller; Mike Crawley, Fire Chief; Kim Vessels, Assistant City Attorney; Dave Dorsten and employees of Rural Metro. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting of March 21, 2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None were presented. COMMUNICATION FROM THE MAYOR 9-1 -1 PROJECT — two of the beams from the Twin Towers will be in Richmond April 9 from noon — 1:30 pm. At that time there are expected to be between 5- 10,000 motorcycles accompanying them to Indianapolis. • Spring Clean -Up begins in the Elizabeth Starr $ Starr Parkside, Valle and Olde Richmond Neighborhoods April 16 -21ot. • The /f I were Mayor... essay contest for 6th grade students will soon be underway. • The Street Department has been cleaning the bridges of winter debris. The bridge on Northwest 5t' Street will reopen the week of April 22. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 10 817, 2011, meetings were accepted as presented. Common Council Minutes April 4, 2011 Page 2 of 4 REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None were presented MISCELLANEOUS BUSINESS A meeting of Committee of the Whole has been scheduled for April 13, 7 PM in the council Chambers. This meeting is to hear public comment relative to Ordinance Nos. 13 & 142011. ORDINANCES ON FIRST READING ORDINANCE NO. 21 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION FOR THE FIRST ANNUAL DREAM KEEPERS DANCE (HRC Dream Keeper's Dance) The Clerk read Ordinance No. 21 -2011 in its entirety: WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose, and WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond. From the Richmond Housing Authority, a donation of Five Hundred Dollars and No Cents ($500); from Oberle Inc., a donation of Two Hundred Dollars and No Cents ($200); from West End Bank, a donation of Two Hundred and FiKy Dollars and No Cents ($250); from The Wayne County Foundation, a donation of Two Hundred and Filly Dollars and No Cents ($25o), from Richmond Baking Company, a donation of Fitly Dollars and No Cents ($50), to the Human Rots Commission, to be used to assist with the funding of the `First Annual Dream Keepers Dance'. in honor and recognition of `Disability Awareness Month.' Mr. Wissel moved to advance Ordinance No. 21 -2011 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Cleric read Ordinance No. 21 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 21 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 21- 2011, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 21 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Ordinance No. 21 -2011 was adopted with a 9-0 roll call vote Common Councd Minutes Apn14, 2011 Page 3 of 4 ORDINANCE NO. 22 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND STREET TREE COMMISSION TO RECEIVE A DONATION FROM THE RICHMOND AREA ENVIRONMENTAL FUND The Clerk read Ordinance No. 22 -2011 in its entirety: WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the Wended purpose. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: From the Richmond Area Environmental Fund, a donation of One Thousand Dollars and No Cents ($1,000.00) to the City of Richmond Street Tree Commission. Mr. Parker moved to advance Ordinance No. 22 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 22 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 22 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 22 -2011, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 22 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 22 -2011 on third reading by title only. Ordinance No. 22 -2011 was adopted with a 94 roll call vote ORDINANCES ON SECOND READING ORDINANCE NO. 13 -2011 — A GENERAL ORDINANCE AMENDING RICHMOND CITY CODE CHAPTER 80 (RICHMOND FIRE DEPARTMENT RESPONSES TO EMERGENCY MEDICAL CALLS) The Cleric read Ordinance No. 13 -2011 on second reading by title only. This Ordinance would amend Chapter 80 of the Richmond City Code dealing with costs that may be recouped by the Richmond Fire Department for emergency medical responses. A meeting of the Committee of the Whole has been scheduled for April 13, 2011, 7 PM in the Council Chambers. ORDINANCE NO. 14 -2011 — A GENERAL ORDINANCE CREATING RICHMOND CITY CODE CHAPTER 81 (RICHMOND FIRE DEPARTMENT RESPONSES TO MOTOR - VEHICLE ACCIDENTS) The Cleric read Ordinance No. 142011 on second reading by title only. This Ordinance would create Chapter 81 of the Richmond City Code dealing with non - medical costs that may be recouped by the Richmond Fire Department for services when responding to motor - vehicle accidents. ORDINANCE NO. 16 -2011 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM URBAN RESIDENTIAL (UR) DISTRICT TO LIMITED COMMERCIAL (LC) DISTRICT (431 West Main) The Clerk read Ordinance No. 16 -2011 on second reading by title only. This Ordinance is a petition to rezone the property at 431 West Main Street from Urban Residential District to Limited Commercial District. The property is a former post office and residential zoning limits the potential use of the property. The Planning Staff recommended approval and the Plan commission voted unanimously to recommend approval. Council President Pappin declared Ordinance No. 16 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 16- 2011, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 16 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Cleric read Ordinance No. 16 -2011 on third reading by title only. Ordinance No. 16 -2011 was adopted with a 9-0 roll call vote ORDINANCE NO. 19 -2011 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE 2011 LOCAL HIGHWAY SAFETY IMPROVEMENT PROGRAM (Manor Drive) The Clerk read Ordinance No. 19 -2011 on second reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Federal Highway Safety Administration and to accept said grant funding in an amount up to One Million Six Hundred Fifty Thousand Dollars ($1,650,000.00), of which One Million Three Hundred Twenty Thousand Dollars ($1,320,000) is the federal contribution. Said funds, if awarded to the City of Richmond, shall be used for the construction and extension of Manor Drive from Dillon to Catalpa Drive (extension of existing roadway on new alignment) within the City of Richmond Ordinance No. 19 -2011 was tabled until April 18, 2011. ORDINANCES ON THIRD READING No Ordinances were presented for Thins Reading.
