HomeMy Public PortalAbout04-18-2011PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 18, 2011 The Common Council of the City of Richmond, Indiana met in regular session, 2011 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, and Diana Pappin. Absent was Phil Quinn. Also present were: Tony Foster, Director of Metropolitan Development; Greg Steins, Director of Public Works; Pat Heiny, Mayor Sally Hutton; Walt Chidester, City Attorney and Karen Chasteen, City Clerk. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting of April 4, 2011 supported by Mr. Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • RESOLUTION NO. 4-2011 - A RESOLUTION IN RECOGNITION OF FAIR HOUSING MONTH, APRIL, 2011 Mr. Parker moved to adopt Resolution No. 4 -2011, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR • Over 15,000 motorcyclists were in Richmond for the presentation of the beams from the Twin Towers in their trip to Indianapolis where there will be a monument constructed in memory of September 11, 2001. Accolades were extended to Bill Henry, Milestone Construction; Lt. Benedict and Sgt. Curt Leverton of the Richmond Police Department, for their tireless efforts in the organization of this event and keeping everyone safe. • April 16 started the Spring Clean Up schedule. Dozens of volunteers who gathered 70.5 tons of trash • Thirty Two students from Michigan were in town April 17 and picked up 20 bags of trash. They are interested in returning to help. • Lemonade Day is scheduled for May 1 • INDOT is constructing the medians on US 27 North. They will then be asphalting the bridge near Sim Hodgin Parkway Common Council Minutes April 18, 2011 Page 2 of 4 • The bridge on NW 5t' Street will not be open at projected on April 22 — rain has delayed the project • Pat Heiny, Chair of the Comprehensive Plan Citizens' Advisory Council, extended an invitation to a public meeting at Townsend Center, May 16, 6 pm, to discuss how to make the plan for North Richmond happen and keep the initiative going. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 24 and April 7, 2011, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 23 & 24 -2011 on first reading by title only, supported by Ms. Cruse - Nicholson. ORDINANCE NO. 23 -2011 - A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM MEDIUM DENSITY SINGLE - FAMILY RESIDENTIAL (R2) DISTRICT TO GENERAL COMMERCIAL (GC) DISTRICT (3955 US 27 N) The Clerk read Ordinance No. 23 -2011 on first reading by title only. Presented by Mr. Foster, this Ordinance is a petition to rezoning the property at 3955 US 27 North from Medium Density Single- family Residential District to General Commercial District. The owner desires to use the residential structure on the site as a Medical Service Office. Ordinance No. 23 -2011 was referred to the Richmond Advisory Plan commission for public hearing at its meeting on April 28, 2011. ORDINANCE NO. 24 -2011 - ORDINANCE AUTHORIZING PARTICIPATION IN PJM DEMAND RESPONSE PROGRAMS FOR RICHMOND POWER & LIGHT The Clerk read Ordinance No. 24 -2011 on first reading by title only. Presented by Mr. Saum, this Ordinance would authorize eligible customers of Richmond Power & Light to participate through such utility in the PJM Emergency Demand Response Program. Mr. Elstro moved to advance Ordinance No. 24 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 24 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 24 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 24 -2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 24 -2011 on third reading by title only. Ordinance No. 24 -2011 was adopted with an 8 -0 roll call vote ORDINANCES ON SECOND READING ORDINANCE NO. 13 -2011 — A GENERAL ORDINANCE AMENDING RICHMOND CITY CODE CHAPTER 80 (RICHMOND FIRE DEPARTMENT RESPONSES TO EMERGENCY MEDICAL CALLS) The Clerk read Ordinance No. 13 -2011 on second reading by title only. This Ordinance would amend Chapter 80 of the Richmond City Code dealing with costs that may be recouped by the Richmond Fire Department for emergency medical responses. Ordinance No. 13 -2011 was tabled until further notice. ORDINANCE NO. 14 -2011 — A GENERAL ORDINANCE CREATING RICHMOND CITY CODE CHAPTER 81 (RICHMOND FIRE DEPARTMENT RESPONSES TO MOTOR - VEHICLE ACCIDENTS) The Clerk read Ordinance No. 14 -2011 on second reading by title only. this Ordinance would create Chapter 81 of the Richmond City Code dealing with non - medical costs that may be recouped by the Richmond Fire Department for services when responding to motor - vehicle accidents. Ordinance No. 14 -2011 was tabled until further notice. ORDINANCE NO. 19 -2011 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE 2010 LOCAL HIGHWAY SAFETY IMPROVEMENT PROGRAM (Manor Drive) The Clerk read Ordinance No. 19 -2011 on second reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Federal Highway Safety Administration and to accept said grant funding in an amount up to One Million Six Hundred Fifty Thousand Dollars ($1,650,000.00), of which One Million Three Hundred Twenty Thousand Dollars ($1,320,000) is the federal contribution. Said funds, if awarded to the City of Richmond, shall be used for the construction and extension of Manor Drive from Dillon to Catalpa Drive (extension of existing roadway on new alignment) within the City of Richmond. Council President Pappin declared Ordinance No. 19 -2011 on second reading and public hearing. Speaking in opposition was Kevin Hurley, Western Cullen Hayes. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 19 -2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 19 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch.. Upon a vote viva voce, the motion passed.
