The Common Council of the City of Richmond, Indiana met in regular session May 2, 2011 in the Council
Chambers in said City.
PLEDGE OF ALLEGIANCE
PRAYER BY COUNCILOR
President Pappin called the meeting to order and the following business was conducted:
ROLL CALL
Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
Also present were: Chris Hardie; Tony Foster, Director of the Department of Metropolitan Development;
David Dorsten; Denise Bullock; Mike Bennett; Steve Higinbothan, Wayne County Director of Facilities and
Planning; Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk.
Also present were Government students from Richmond High School classes of Messrs. Wier and Priest.
APPROVAL OF MINUTES
Mr. Parker moved to approve the Memorandum of Proceedings for the Committee of the Whole held April
13, 2011 and minutes of the meeting of April 18, 2011, supported by Mr. Goodwin. Upon a vote viva voce,
the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
• RESOLUTION NO. 5 -2011 -MEMORANDUM OF UNDERSTANDING WITH WAYNE
COUNTY (South 41h Street)
This Resolution attaches the Memorandum of Understanding which sets forth the common
goals and duties of both the city of Richmond and the County Commissioners with respect to
that portion of South 4th Street between the Courthouse and Annex Building in order that
vehicular traffic may continue to traverse.
Mr. Miller moved to adopt Resolution No. 5 -2011, supported by Ms. Cruse - Nicholson. Upon
a vote viva voce, the motion passed.
COMMUNICATION FROM THE MAYOR
• Spring Clean -up is going very well. On Seton High School Branch -Out Day, several teams of
students helped uncover brick streets; clean up the Starr - Gennett Site, etc.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the April; 14, 2011 meeting was accepted as presented.

MISCELLANEOUS BUSINESS
• Ms. Cruse - Nicholson offered Kudos on Lemonade Day held last weekend. There are lots of
great stories of how the kids did business in the rain.
• Public hearings re the proposed Wheel Tax will be held at 8:30 am and 7:00 pm, May 4, 2011
in the Wayne County Council Chambers.
• A combined meeting of the Redevelopment and Economic Commissions will be held on May
24, 5:30 PM re the proposed Tax Incremental Finance district for the former Reid Hospital
Building. A Special Meeting of the Common Council will follow at 7:00 PM.
ORDINANCES ON FIRST READING
Mr. Elstro moved to suspend the rules and read Ordinance No. 25 -2011 on first reading by title only,
supported by Mr. Miller. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 25-2011 —AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE DONATIONS (Historic Preservation Commission)
The Clerk read Ordinance No. 25 -2011 on first reading by title only.
Presented by Mr. Foster, this Ordinance would allow the Richmond Historic Preservation Commission to
accept donations to help fund projects specific to the Commission's purpose.
Mr. Wissel moved to advance Ordinance No. 25 -2011 to second reading and to suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 25 -2011 on second reading by title only.
Council President Pappin declared Ordinance No. 25 -2011 on second reading and public hearing. There
being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No.
25 -2011, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed.
Mr. Welch moved to advance Ordinance No. 25 -2011 to third and final reading and suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 25 -2011 on third reading by title only.
Ordinance No. 25 -2011 was adopted with a 9 -0 roll call vote.
ORDINANCES ON SECOND READING
ORDINANCE NO. 16 -2010 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY (STREET) (S 4th
Street — Main to South "A" Street)
The Clerk read Ordinance No. 16 -2011 on second reading by title only.
This Ordinance is a petition to vacate South 4th Street between Main Street and South "A" Street.

This Ordinance is a petition to vacate South 4" Street between Main Street and South "A" Street.
Mr. Miller moved to amend Ordinance No. 16 -2011 to include:
• An easement for all current and future utilities will be recorded.
• After the Ordinance is adopted, a Compliance Order from the Richmond Fire Department will be
submitted to the Wayne County Commissioners that establishes South 4" Street as a required
access road, based on Indiana Fire Code, which will have the effect of leaving the street open.
A Memorandum of Understanding (MOU) has been offered by Wayne County that outlines
procedures that must be taken if the County ever desires to close the street to vehicular traffic.
The specifics of this MOU have been agreed to by the City and County. The County has already
signed the Agreement.
This motion was supported by Mr. Goodwin. Upon a vote viva voce, the motion passed.
Council President Pappin declared Ordinance No. 16 -2011 as amended on second reading and public
hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of
Ordinance No. 16 -2011, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
Mr. Wissel moved to advance Ordinance No. 16 -2011 as amended to third and final reading and suspend
the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion
passed.
The Clerk read Ordinance No. 16 -2011 as amended on third reading by title only.
Ordinance No. 16 -2011 as amended was adopted with a 9 -0 roll call vote.

There being no further business, on a motion duly made, seconded and passed, the meeting was
adjourned.
