The Common Council of the City of Richmond, Indiana met in regular session June 6, 2011 in the Council
Chambers in said City.
PLEDGE OF ALLEGIANCE
PRAYER BY COUNCILOR PARKER
President Pappin called the meeting to order and the following business was conducted:
ROLL CALL
Councilors pnasent were Howard "Jack' Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Lary Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
Also present were: Sarah "Sally" Hutton, Mayor, Walt Chidester, City Attorney; Monica Bums, Deputy City
Clerk; Tammy Glenn, City Controller; Ron Oler; Denise Bullock; Sue Roberson, Director of Human
Resources; Richard Jeffers; Bob Wotherspoon; Jean Cates, Program Coordinator for Partnership for a
Drug Free Wayne County; Dave Dorsten; Tony Foster, Director of the Department of Metropolitan
Development; Chris Hardie; Kris Wolski, Police Chief, Bill Smith, Street Superintendent; and, Misty Hollis;
Bob Faucett and David Stidham.
APPROVAL OF MINUTES
Ms. Cruse - Nicholson moved to approve the minutes of the meetings of May 16 & 24, 2011, supported by
Mr. Welch. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
RESOLUTION NO. 6-2011 - CITY OF RICHMOND COMMON COUNCIL REGARDING THE
ESTABLISHMENT OF THE WHITEWATER RIVER ECONOMIC DEVELOPMENT AREA
This Resolution would authorize the establishment of an economic development area in the area known
as the Whitewater River Economic Development Area described in Exhibit A of the Declaratory
Resolution.
Mr. Chidester stated the City would not close on the bonds unless it was done simultaneously with the
proof of availability of investors' monies in hand to finance the Spring Grove Development project. He
also stated that whether the bonds closed with or without the investors and their monies, the city would
not be out any monies, not its bond rating affected, even If the bonds were issued and not paid back.
Finally, Chidester pointed out that since the investors in Peter Murphy's equity company would most likely
purchase the bonds, the sale of the bonds would probably occur at or near the time the investors were
lined up.
Speaking against this Resolution were Messrs. Faucett and Stidham.
Mr. Elstro moved to adopt Resolution No. 6 -2011, supported by Mr. Welch. The motion passed with an 8-
1 roll call vote. Dissenting was Mr. Quinn.

PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY — Ms. Cates, presented the Partnership's
annual report.
COMMUNICATION FROM THE MAYOR
• The Northwest 5"' Street bridge has been opened to traffic
• Thank you to Mr. Dorsten for his work mowing and trimming public rights of way
• A Memoriam for Bob Rosa will be held at Office Plus on June 14 (Flag Day)
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the May 12, 29 & 26, 2011 meetings were accepted as presented.
REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES
and/or ORGANIZATIONS
• If 1 Were Mayor Essay Contest: Runner Up, Ariel DeSonie, read her essay and is a $50 winner
Lillian Dickman read her First Place essay. She received $100 from Richmond and $250 as the
Regional winner
MISCELLANEOUS BUSINESS
• Messrs. Miller and vessel thanked Mr. Dorsten for delivering Council packets.
• Mr. Quinn commented on the Warning Siren — would like to see changes in guidelines
• The ne)d Council Meeting will be held June 27 in lieu of June 20, 2011.
ORDINANCES ON FIRST READING
Mr. Eistro moved to suspend the rules and read Ordinance Nos. 33 -2009, 28, 29, 32 & 32 -2011 on first
reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 33-2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE DONATIONS
The Deputy Clerk read Ordinance No. 33 -2009 on first reading by title only.
Mr. Parker moved to Strike Ordinance No. 33 -2009, supported by Ms. Cruse - Nicholson. Upon a vote viva
voce, the motion passed.
ORDINANCE NO. 28-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET
The Deputy Cleric read Ordinance No. 28-2011 on first reading by title only.
Presented by Ms. Glenn, this Ordinance would authorize the transfer of funds within the Motor Vehicle
Highway budget as follows:
Delete $35,000.00 - Electric Current, $10,000.00 - Gas and $135,000.00 - Other Contract
Services
Add $180,000.00 to Other Equipment

Mr. Parker moved to advance Ordinance No. 28 -2011 to second reading and to suspend the rules and
read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed.

Council President Pappin declared Ordinance No. 28 -2011 on second reading and public hearing. There
being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 28-
2011, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
Mr. Welch moved to advance Ordinance No. 28 -2011 to third and final reading and suspend the rules and
read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
The Deputy Clerk read Ordinance No. 28 -2011 on third reading by tide only.
Ordinance No. 28 -2011 was adopted with a 9-0 roll call vote.
ORDINANCE NO. 29 -2011 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL
APPROPRIATIONS FROM CERTAIN FUNDS
The Deputy Cleric read Ordinance No. 29 -2011 on first reading by title only.
Presented by Ms. Glenn, this Ordinance would authorize an additional appropriation of $314,050.00 to
the Cumulative Capital Development Fund.
Mr. Parker moved to advance Ordinance No. 29 -2011 to second reading and to suspend the rules and
read by title only, supported by Mr. Wissel. Upon a vote viva voce, the motion passed.
The Deputy Clerk read Ordinance No. 29 -2011 on second reading by title only.
Council President Pappin declared Ordinance No. 29 -2011 on second reading and public hearing. There
being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 29-
2011, supported by Mr. Wiissel. Upon a vote viva voce, the motion passed.
Mr. Elstro moved to advance Ordinance No. 29 -2011 to third and final reading and suspend the rules and
read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 31-2011 —A SPECIAL ORDINANCE VACATING A PUBLIC WAY (ALLEY) (east of
South a Street and North of South "N" Street)
The Deputy Cleric read Ordinance No. 31 -2011 on first reading by title only.
Presented by Mr. Foster, this Ordinance is a petition to vacate a portion of the public way (alley1running
north and south approximately 450 feet north of South "N" Street. The alley is east of South 6 Street,
Richmond Recycling, Inc. and Edelman Management, LLC own the entire block and the bacation will
allow the business to best utilize their property.
Ordinance No. 31 -2011 was referred to the Richmond Advisory Plan commission for public hearing at its
June 23, 2011 meeting.

ORDINANCE NO. 32 -2011 - AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE DONATIONS
The Deputy Clerk read Ordinance No. 32 -2011 on first reading by title only.
Presented by Chief Wolski, this Ordinance would authorize the Police Department to accept a donation in
the amount of Five Thousand Dollars and zero cents ($5,000.00) from the Moose Lodge for the purchase
of K -9 Equipment and/or purchase of canine.
Mr. vessel moved to advance Ordinance No. 32 -2011 to second reading and to suspend the rules and
read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.

Council President Pappin declared Ordinance No. 32 -2011 on second reading and public hearing. There
being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No.
32 -2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed.
Mr. Wissel moved to advance Ordinance No. 32 -2011 to third and final reading and suspend the rules
and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed.

ORDINANCES ON SECOND READING
ORDINANCE NO. 27 -2011— A SPECIAL ORDINANCE VACATING A PUBLIC WAY (STREET) (NW 7T"
Street)
The Deputy Clerk read Ordinance No. 27 -2011 on second reading by title only.
This Ordinance is a petition by Johns Manville to vacate a portion of NW 7"' Street north of Richmond
Avenue and south of the Penn - Central Rail Line. Johns Manville owns both sides of the street and would
like to better secure their property. The Ordinance was heard at the May 26, 2011 Richmond Advisory
Plan Commission meeting. The Staff and Richmond Advisory Plan commission recommended approval
based on the following Findings of Fact and with the condition that the location of all utility easements be
described and recorded as requested.
WHEREAS, The vacation would not hinder the growth and orderly development of the
community in which it is located In or contiguous to because Manville owns both sides of
the street, and
WHEREAS, The vacation would not make access to lands owned by others by means of a
public way dMult or inconvenient because the road dead -ends at a railroad track, and
WHEREAS, The vacation would not hinder the public's access to a church, school or other
public building or place because there are no such properties in that area; and
WHEREAS, The vacation would not hinder the use of a public way by the neighborhood in
which it is located or to which it is corrtlguous because there is an alley that still provides
access through the general area,
Mr. Miller moved to amend this Ordinance to include the recommended conditions, supported by Ms.
Cruse - Nicholson. Upon a vote viva voce, the motion passed.

Council President Pappin declared Ordinance No. 27 -2011 as amended on second reading and public
hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of
Ordinance No. 27 -2011 as amended, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the
motion passed.
Mr. Parker moved to advance Ordinance No. 27 -2011 as amended to third and final reading and suspend
the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed.

Ordinance No. 27 -2011 as amended was adopted with a 9-0 roll call vote.
