PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PAPPIN President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Lary Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Sarah "Sally" Hutton, Mayor; Walt Chidester, City Attorney; Kim Vessels, Assistant City Attorney; Karen Chasteen, City Clerk; Terry Quinter, Roseview Transit; Tony Foster, Metropolitan Development; John Sayre, Attorney for Edelman Management; Misty Hollis; Ron Oler; Steve Rabe; and, Phil Morgan. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting of, July 5, 2011 supported by Mr. Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 7, 2011, meeting was accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS Mr. Parker reported that Reid Health Care paid $254,331 in 2010 for property taxes. Combined with Charity Care, Community Benefits, Bad Debt, a total of $48,558,000 was paid into the Community. MISCELLANEOUS BUSINESS Per the Indiana Department of Transportation, bids for the resurfacing of the US 27 N (Chester Boulevard) bids for the bridge will be let soon. Common Council Minutes July 18, 2011 Page 2 of 3 ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 37 -2011 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 37 -2011 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION (Roseview) The Clerk read Ordinance No. 37 -2011 on first reading by title only. Presented by Ms. Quinter, this Ordinance would authorize the City of Richmond, by and through Rose View Transit to submit a grant application to the Indiana Department of Transportation and to accept grant funding in an amount up to Nine Hundred Thirty Four Ten Dollars and zero cents ($934,010.00). Said funds, if awarded shall be appropriated to assist with operating expenses for Rose View Transit for 2011. The City would provide up to One Hundred Fifty Nine Thousand Seven Hundred Ninety-one Dollars and Zero cents ($159,791.00) in local funds. Mr. Miller moved to advance Ordinance No. 37 -2011 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 37 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 37 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 37 -2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 37 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 37 -2011 on third reading by title only. Ordinance No. 37 -2011 was adopted with an 8 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 31-2011 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY (ALLEY) (Recycling Center) The Clerk read Ordinance No. 31 -2011 on second reading by title only. This Ordinance is a petition to vacate a portion of the public way (alley) running north and south approximately 450 feet north of South "N" Street. The alley is east of South 6v' Street, Richmond Recycling, Inc. and Edelman Management, LLC own the entire block and the vacation will allow the business to best utilize their property. Council President Pappin declared Ordinance No. 31 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 31- 2011, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Ordinance No. 36 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 31 -2011 on third reading by title only. Ordinance No. 31 -2011 was adopted with 7 -1 roll call vote. Dissenting was Mr. Elstro. Common Council Minutes July 18, 2011 Page 3 of 3 ORDINANCE NO. 36 -2011 - A GENERAL ORDINANCE AMENDING SECTION 94.03 OF THE RICHMOND CODE COMMONLY KNOWN AS THE WEED ORDINANCE The Clerk read Ordinance No. 36 -2011 on second reading by title only. This Ordinance would amend the Richmond City Code Section 94.03 with regard to Weeds. Council President Pappin declared Ordinance No. 36 -2011 on second reading and public hearing. Speaking in favor of the Ordinance were Phil Morgan and Steve Rabe. There were no comments against the Ordinance, Ms. Vessels noted a correction should be made on page 2 to reflect Ordinance 63 -1990 in lieu of Ordinance 63 -1991. Mr. Miller so moved, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Parker moved to amend Ordinance No. 36 -2011 as amended by adding the following to section (h): In addition to the above, a property owner may be subject to a fine up to Twenty Five Hundred Dollars ($2,500) per occurrence for violation of this section. This motion was supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. Miller moved to amend section (g) to read ... One letter within a calendar year shall be deemed sufficient notice per each and every lot, parcel, and lands ..., supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Miller moved for engrossment of Ordinance No. 36 -2011 as amended, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Ordinance No. 36 -2011 as amended to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 36 -2011 as amended on third reading by title only. Ordinance No. 36 -2011 as amended was adopted with an 8 -0 roll call vote. ORDINANCES ON THIRD READING CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
