PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOODWIN President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Sarah "Sally" Hutton, Mayor, Walt Chidester, City Attorney; Karen Chasteen, City Clerk; Tammy Glenn, City Controller; Greg Steins, City Engineer; Bill Smith, Street Department Superintendent; Ron Oler; and, Chris Hardie. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting of August 1, 2011, supported by Mr. Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 14 & 21, 2011, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 40, 41, 42 & 43 -2011 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Common Council Minutes August 1, 2011 Page 2 of 3 ORDINANCE NO. 40 -2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET (Engineering) The Clerk read Ordinance No. 40 -2011 on first reading by title only. Presented by Mr. Steins, this Ordinance would authorize the transfer of funds as follows: General Fund — Engineering: 1 Delete $18,800.00 from Salary and Wages — Part Time 2 Delete $2,000.00 from Overtime 3. Add $20,800.00 to Other Contract Services Mr. Welch moved to advance Ordinance No. 40 -2011 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 40 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 40 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 40 -2011, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 40 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 40 -2011 on third reading by title only. Ordinance No. 40 -2011 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 41 -2011 — AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET (Street) The Clerk read Ordinance No. 41 -2011 on first reading by title only. Presented by Mr. Smith, this Ordinance would authorize the transfer of funds as follows: Motor Vehicle Highway: 1 Delete $5,000.00 from Salary and Wages 2. Delete $8,033.00 from Contractual Concrete 3. Add $13,033.00 to Other Equipment Mr. Wissel moved to advance Ordinance No. 41 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 41 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 41 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 41- 2011, supported by Mr. Welch. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 41 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. ORDINANCE NO 42 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.6 -1.1 -12.1 (J. M. Hutton & Co., Inc. — Equipment) The Clerk read Ordinance No. 42 -2011 on first reading by title only. This Ordinance is a request of J.M. Hutton & Co., Inc. for a ten -year tax abatement on equipment valued at Four Hundred Three Thousand Two Hundred Eighty Four Dollars and Zero Cents ($403,284.00). Ordinance No. 42 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 43 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor —Equipment) The Clerk read Ordinance No. 43 -2011 on first reading by title only. This Ordinance is a request of Vandor Corporation. for a ten -year tax abatement on equipment valued at Two Million Forty Three Thousand One Hundred Dollars and Zero Cents ($2,043,100.00). Ordinance No. 42 - 2011was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 44 -2011 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 42- 2009 KNOWN AS THE 2011 SALARY ORDINANCE Ordinance No. 44 -2011 was held on first reading until the August 15, 2011 meeting. ORDINANCES ON SECOND READING None ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
