The Common Council of the City of Richmond, Indiana met in regular session August 15, 2011 in the
Council Chambers in said City.

President Pappin called the meeting to order and the following business was conducted:
ROLL CALL
Councilors present were Howard "Jack' Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing
Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn.
Also present were: Sarah "Sally " Hutton, Mayor, Karen Chasteen, City Clerk; Wait Chidester, City

APPROVAL OF MINUTES
Ms. Cruse - Nicholson moved to approve the minutes of the meeting of August 1, 2011, supported by Mr.
Miller. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
• RESOLUTION NO. 7 -2011— A RESOLUTION OF RICHMOND COMMON COUNCIL
EXTENDING CONGRATULATIONS TO THE RICHMOND MARCHING RED DEVILS
WHEREAS, the Richmond Marching Red Devils, after hours of hard work, diligence, and
practice, and display of commendable competitive drive, achieved second place honors at the
Indiana State Fair Band Day Competition; and
WHEREAS, the Mayor and the Common Council of the City of Richmond, as a reflection of
community support as well as support of the Mayor and the members of Common Council,
applaud the dedication of the Richmond Marching Red Devils for their accomplishments; and
WHEREAS, the Mayor and the Common Council of the City of Richmond believe it is in the
best interests of the members of the Richmond Marching Red Devils, as well as the parents,
band aids, staff, and boosters to extend enthusiastic acclamations toward these dedicated young
individuals for their achievement; and
WHEREAS, the Mayor and the Common Council of the City of Richmond encourage the
Richmond Community to continue to show its support for the Richmond Marching Red Devils.

NOW THEREFORE, BE IT RESOLVED by the Mayor and the Common Council of the City of
Richmond that the Mayor and the Common Council extend congratulations to the Richmond
Marching Red Devils and commend them for their achievement of second place honors at the
Indiana State Fair Band Day Competition.
Upon a vote viva voce, the Resolution No. 7 -2011 was adopted.
COMMUNICATION FROM THE MAYOR

REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the July 28 and August 4, 2011, meetings were accepted as presented.
Note that Trick or Treat will be Monday, October 31, 2011.

MISCELLANEOUS BUSINESS
• Gary Franklin, representing various Veteran's organizations, voiced concerns relative to INDOT
attempting to begin construction of a trail project at the Veteran's Park site on the eve of a major
event to Welcome Home Vietnam Veterans August 24 -28. With intervention from the Mayor and
Department of Metropolitan Development, the project has been postponed until September 2.
The Park Department is assisting with cleanup to prepare for the event.
There was also concern regarding bills received for electric service to the site. Representatives
of Richmond Power and Light will be meeting with the group to develop a solution to this
situation.
ORDINANCES ON FIRST READING
Mr. Elstro moved to suspend the rules and read Ordinance Nos. 34, 44, 45, 46 & 49 -2011 on first reading
by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 34-2011 — ORDINANCE AMENDING ORDINANCE NO. 47-2010
The Clerk read Ordinance No. 34 -2011 on first reading by title only.
Presented by Mr. Chidester and Ms. Barkdull, this Ordinance would amend Ordinance No. 47 -2010 as
follows:
Section I. The Ordinance shall be amended to increase the maximum aggregate principal
amount of the Bonds to be issued to an amount not to exceed $34, 000, 000 at a maximum interest rate of
fourteen percent (14 %) and to permit the Bonds to be sold wits► a premium or discount of up to three
percent (3 %).
Section 2. The Ordinance shall be further amended to change the name of the Bonds hvm "City
of Richmond, Indiana Economic Development Revenue Bonds, Series 2010 (Perpetual Recycling
Project)* to "City of Richmond, Indiana Economic Development Revenue Bonds, Series 2011
(Perpetual Recycling Project)" (to be completed with the proper senses designation or taxable status).

Mr. vessel moved to advance Ordinance No. 34 -2011 to second reading and to suspend the rules and

being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of
Ordinance No. 342011, supported by Mr. Elstro. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 44-2011 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 30-

Mr. Miller moved to amend Ordinance No. 44 -2011
by striking the position of Deputy Chief of EMS,
supported by Mr. vessel. The motion failed with a 45 roll call vote. Dissenting were Councilors Elstro,
Cruse- Nicholson, Welch, Goodwin and Quinn.
Mr. Welch moved to advance Ordinance No. 442011 to second reading and to suspend the rules and
read by title only, supported by Ms. Cruse - Nicholson.

ORDINANCE NO. 46-2011 -AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET
The Clerk read Ordinance No. 442011 on first reading by title only.
Presented by Mr. Foster, this Ordinance would amend the 2011 Budget as follows:
General fund — Mebropolitan Development.
1 Delete $3,5W 00 from Part Time Salaries
2. Add $500.00 to Legal Publications
3. Add $3, 000.00 to Repair and Mainf. - Vehicles

POWER & LIGHT WHITEWATER VALLEY TURBINE #1 AND 02 ALONG WITH ASSOCIATED
EQUIPMENT AND LEASED PROPERTY

Presented by Mr. Saum, this Ordinance would authorize Common Council to appoint three appraisers to
appraise the value of Richmond Power and Light Turbine Generating Equipment and the Leased
Property.

ORDINANCE NO. 49 -2011 — AN ORDINANCE TO APPROVE AND ADOPT THE NEIGHBORHOOD
STABILIZATION PROGRAM (NSP) REAL ESTATE DISPOSITION PROCEDURES FOR REAL ESTATE
LOCATED IN NSP AREA (VAILE NEIGHBORHOOD) RICHMOND, INDIANA

Presented by Mr. Foster and Ms. Vessels, this Ordinance would allow the City to adhere to the NSP
guidelines during the sale of the NSP -1 and NSP -3 properties and would allow the Board of Public Works
to conduct the required public hearings.

I.C.6 -1.1 -12.1 (J. M. Hutton & Co., Inc. — Equipment)

This Ordinance is a request of J.M. Hutton & Co., Inc. for a ten -year tax abatement on equipment valued
at $403,284.00. The Tax Abatement Committee recommended approval.

6-1.1 -12.1 (Vandor —Equipment)

This Ordinance is a petition of Vandor Corporation for a ten -year tax abatement on equipment valued at
$2,043,100.00. The Tax Abatement Committee recommended approval.

being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 43-
