PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR CRUSE- NICHOLSON President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Bing Welch. Also present were: Waft Chidester, City Attorney; Sarah "Sally" Hutton, Mayor, Karen Chasteen, City Clerk; Joyce Carr, Ordinance Violation Clerk; Monica Burns, Deputy City Clerk; Ron Christopher; Bob & Margaret Wotherspoon; Ron Oler, Chris Hardie; Mike Bennett; Misty Hollis; Josh Williams, Wazir Mohamed, Batty Cramer, Mario Simpson, Human Rights Commission; Rachel Hunter, Bill Smith, Street Department Superintendent; Tammy Glenn, City Controller, Jerry Purcell, RFD Batalion Chief, Mike Crawley, Fire Chief; Sue Roberson, Human Resources Director; Kim Dorsten and Seton High Students April Witt, Daniel Marsee, Sam Dickman, Harold Smith, Clay Dolesh & Mary Beth Dietz; Tony Foster, Director of Metropolitan Development; Dave Dorsten; and Police Reserve Officers. . APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting of September 6, 2011, supported by Mr. Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 8 -2011 - RESOLUTION APPROVING THE AMENDMENT OF THE CITY OF RICHMOND COMPREHENSIVE PLAN (TRANSORTATION PLAN) Following a public hearing, the Richmond Advisory Plan commission approved the amendment of the Comprehensive Plan to include the updated Transportation Plan and a separate motion was passed certifying the Transportation Plan as an amendment to the Comprehensive Plan to the Common Council of the City of Richmond, Indiana. This Resolution is a request to amend the Comprehensive Plan with the updated Transportation Plan. Mr. Foster presented the Resolution and requested it be referred to Council following the Plan Commission for public hearing on September 22, 2011. COMMUNICATION FROM THE MAYOR • Thank you to all involved in making the Kids Parade a success • The Police Department SWAT Team placed Fifth Place overall out of Eighteen teams in a state competition Common Council Minutes September 19, 2011 Page 2 of 4 • The Police Department SWAT Team placed Fifth Place overall out of Eighteen teams in a state competition • Steps are being taken to bring the Model T Museum to the Depot District. The Redevelopment Commission is assisting in this effort. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the September 1 & 8, 2011, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 56 -2011 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 56 -2011 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED STATES FEDERAL AVIATION ADMINISTRATION The Clerk read Ordinance No. 56 -2011 on first reading by title only. Presented by Mr. Foster, this Ordinance would authorize the City of Richmond to submit a grant application to assist with the costs associated with Phase II and Phase III of the Terminal apron and Taxiway project located at the Richmond Municipal Airport. Mr. Wissel moved to advance Ordinance No. 56 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 56 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 56 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 56- 2011, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 56 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 56 -2011 on third reading by title only. Ordinance No. 56 -2011 was adopted with an 8 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 47 -2011 - AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2012 BUDGET Common Council Minutes September 19, 2011 Page 3 of 4 The Clerk read Ordinance No. 47 -2011 on second reading and public hearing by title only. Presented by Ms. Glenn, attached to this Ordinance is Budget Form 4 -A which contains all expenses of the City of Richmond for the year ending December 31, 2012. Council President Pappin declared Ordinance No. 47 -2011 on second reading and public hearing. Speaking to the Ordinance on behalf of the Human Rights Commission were Ms. Hunter, Mr. Williams and Mr. Mohamed. Mr. Christopher spoke in opposition of the proposed EMS services included in the 2012 Budget and Mr. Dorsten stated the responsibility of Council at this meeting was to address the 2012 Budget as presented. Mr. Quinn moved for engrossment of Ordinance No. 47 -2011, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Ordinance No. 47 -2011 will be heard on third reading and Adoption Meeting September 29, 2011. ORDINANCE NO. 48 -2011 - AN APPROPRIATION ORDINANCE FIXING THE ANNUAL COMPENSATION OF ALL ELECTED CITY OFFICERS FOR 2012 The Clerk read Ordinance No. 48 -2011 on second reading and public hearing by title only. Presented by Ms. Glenn, this Ordinance establishes the compensation of all elected City Officers for 2012. All salaries remain the same as in 2011. Council President Pappin declared Ordinance No. 48 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 48- 2011, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Ordinance No. 48 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 48 -2011 on third reading by title only. Ordinance No. 48 -2011 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 50 -2011 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2012 SALARY ORDINANCE The Clerk read Ordinance No. 50 -2011 on second reading and public hearing by title only. Presented by Ms. Glenn, this Ordinance fixes the compensation of each appointive officer, deputy and other employees of the City departments, except police officers and firefighters. Council President Pappin declared Ordinance No. 50 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 50 -2011, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 50 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Common Council Minutes September 19, 2011 Page 4 of 4 ORDINANCE NO. 53 -2011 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR SERVICES FROM THE RICHMOND SANITARY DISTRICT, ROSEVIEW TRANSIT, RICHMOND POWER AND LIGHT, MOTOR VEHICLE HIGHWAY AND PARK AND RECREATION DEPARTMENT FUNDS TO THE GENERAL FUND IN 2012 The Clerk read Ordinance No. 53 -2011 on second reading by title only Presented by Ms. Glenn, this Ordinance the personal services for executive departments are paid from the Richmond general Fund and it is necessary to transfer monies to such fund from various funds. Ordinance No. 53 -2011 was held on second reading until the October 3, 2011 meeting. ORDINANCE NO. 54 -2011 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 The Clerk read Ordinance No. 54 -2011 on second reading and public hearing by title only. Presented by Mr. Wissel, this Ordinance is a request of Color -Box, LLC for a ten year tax abatement for equipment valued at Eight Million Two Hundred Eighty Thousand Dollars ($8,280,000.00). The Tax Abatement Committee recommended approval. Council President Pappin declared Ordinance No. 54 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 54 -2011, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 54 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
