PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOODWIN President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Bing Welch. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the regular meeting on November 7, 2011, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. ORDINANCE NO. 69 -2011 - A SPECIAL ORDINANCE AMENDING ORDINANCE NO. 47 -2010 RE PERPETUAL RECYCLING The Clerk read Ordinance No. 69 -2011 on first reading by title only. Presented by Mr. Chidester, this Ordinance would amend Ordinance No. 47 -2010 which would approve the issuance of bonds, in one or more series, in an aggregate principal amount not to exceed Thirty four million dollars ($34,000,000.00) at an interest rate not to exceed fourteen percent (1496), in order to procure funds to be loaned to the Company to be applied on the costs of the Project and associated costs of issuing the Bonds. Ordinance No. 69 -2011 was adopted with an 8-0 roll call vote ORDINANCE NO. 62 -2011 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS. The Clerk read Ordinance No. 62 -2011 on first reading by title only. Presented by Ms. Glenn, this Ordinance would appropriate additional sums of money to the following funds: General Fund — Mayor - $ 1,309.00 General Fund — Finance - $ 8,031.00 General Fund — Clerk - $ 2,054.00 General Fund — Fire - $ 61,920.00 Motor Vehicle Highway - $ 19,516.00 Park and Recreation - $ 17,183.00 Fire Pension - $ 50,000.00 Health Insurance - $1,700,000.00 Worker's Compensation - $ 125,000.00 Rainy Day - $ 300,000.00 First Response - $ 3,800.00 The 2011 Budget was based on prior year's experience. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 62- 2011, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. Parker moved to advance Ordinance No. 62 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 62 -2011 on third reading by title only. Ordinance No. 62 -2011 was adopted with an 8 -1 roll call vote. Dissenting was Mr. Quinn. ORDINANCE NO. 63-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET The Cleric read Ordinance No. 63 -2011 on first reading by title only. Presented by Ms. Glenn, this Ordinance would amend the 2011 Budget of the Office of the Mayor as follows: General Fund — Mayor expenses which make it necessary to appropriate additional funds to cover claims. Speaking to the Ordinance was Mr. Halfacre, Mr. Wotherspoon, and Ms. Roberson. Mr. Wissel moved to advance Ordinance No. 62 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 62 -2011 on second reading by title only. Delete $400.00 from Promotional Services Add $300.00 to Gasoline Add $100.00 to Copier Charges Mr. Wissel moved to advance Ordinance No. 63 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 63 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 63 -2011 on second reading and public hearing. Mr. Wissel moved to advance Ordinance No. 63 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 64-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET The Clerk read Ordinance No. 64 -2011 on first reading by title only. Council President Pappin declared Ordinance No. 64 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 64- 2011, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. tassel moved to advance Ordinance No. 64 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 65-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET The Clerk read Ordinance No. 65 -2011 on first reading by title only. Presented by Chief Wolski, this Ordinance would amend the 2011 Budget of the Police Department as follows: General Fund — Police Delete $37,500.00 from Patrol Officers Add $37,500.00 to Gasoline Mr. Wissel moved to advance Ordinance No. 65 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Miller. Presented by Ms. Glenn, this Ordinance would amend the 2011 Budget of the Motor Vehicle Highway (Street Department) as follows: Motor Vehicle Highway Delete $90,000.00 from Contractual Services Delete $15,000.00 from Contractual Concrete Add $90,000.00 to Other Equipment Add $10,000.00 to Salary and Wages — Temporary Add $5,000.00 to Overtime Mr. Elstro moved to advance Ordinance No. 66 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Ordinance No. 66 -2011 was adopted with an 8-0 roll call vote ORDINANCE NO. 70-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET The Clerk read Ordinance No. 70 -2011 on first reading by title only. Presented by Ms. Quinter, this Ordinance would amend the 2011 Budget of the Off -Street Parking as follows: Off -Street Parkin Delete $1,000.00 from Electric - Facilities Add $1,000.00 to Salaries and Wages — Part Time Mr. Wissel moved to advance Ordinance No. 70 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Mr. Parker moved to advance Ordinance No. 70 -2011 to third and final reading and suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Ordinance No. 70 -2011 was adopted with an 8-0 roll call vote ORDINANCE NO. 71-2011 — A GENERAL ORDINANCE AMENDING SECTION ADDING CHAPTER 50 TO THE RICHMOND CODE REGARDING GENERAL SEWER USAGE The Clerk read Ordinance No. 71 -2011 on first reading by title only. The USEPA is currently requiring Municipalities with industrial and commercial pretreatment programs update the language and discharge limits within their local ordinances. This language currently exists in Chapter 54 of the Richmond Code. In addition to pretreatment, Chapter 54 holds the requirements for the general use and construction of the sewers within the City and the Sanitary District. Previous to 1997, two ordinances existed that dealt with these issues, Chapter 50 and 54. In 1997, Chapter 50 was repealed and both topics, pretreatment and general sewer usage, were combined into a single Chapter 54. Updates to Chapter 54 were last made in 2007. Due to EPA's new requirements and because of the need to update the language about general sewer usage, it was determined that the most efficient way to do this would be to create separate chapters that dealt with each topic. Chapter 54 will hold all of the needed pretreatment language, while Chapter 50 will hold all of the general sewer use language. Ordinance No. 71 -2011 was held on first reading until December 5, 2011, ORDINANCE NO. 72 -2011 — A GENERAL ORDINANCE AMENDING SECTION 54 OF RICHMOND CITY CODE AND ADOPTING AN ENFORCEMENT RESPONSE GUIDE The Clerk read Ordinace No. 72 -2011 on first reading by title only.
