HomeMy Public PortalAbout12-05-2011PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 5, 2011 The Common Council of the City of Richmond, Indiana met in regular session December 5, 2011 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR QUINN President Pappin called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard *Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Absent was Bing Welch. Also present were: Walt Chidester, City Attorney; Karen Chasteen, City Clerk; Ron Oler; Misty Hollis; Jerry Purcell, RFD Batalion Chief; Oscar Abner, Deputy Fire Chief; Tony Foster, Director of Metropolitan Development; Tammy Glenn, City Controller; and, Steve Swoveland, Sanitary District. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the regular meeting on November 14, 2011, supported by Mr. Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS. WAYNE COUNTY CONVENTION & TOURISM BUREAU • Per legislation HB #1127, Richmond Common Council has the responsibility to appoint members to the Wayne County Convention & Tourism Bureau (WCCTB) board of directors per industry classifications. Representing those specific classifications, the Bureau's Board of Governors requests approval for the following individuals: Travel Industry - Linda Von Pain, Owner, Advanced Travel of America Lodging Industry - Sandy Baker, General Manager of the Quality Inn of Richmond Chamber of Commerce - Dana Weigle — as recommended by the Chamber The above board appointees' terms would be for two (2) years beginning January 1, 2012 and ending December 31, 2013. This matter was held until December 19, 2011 to allow time for additional nominations. • EMERGENCY MEDICAL SERVICES Btl. Chief Purcell reported the EMS provided by the Fire Department are on track and self- sufficient to date. The majority of runs are EMS related. Common Counco Mfnufes December 5, 2011 Page 2 of 4 COMMUNICATION FROM THE MAYOR • The tentative date for the swearing in of newly elected officials is December 30. Details will be forthcoming. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the November 17 & 23, 2011, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS ►CriT� MISCELLANEOUS BUSINESS There will be a Joint Meeting of City of Richmond and Wayne County officials on December 14 at 5:30 pm to discuss potential cost savings. This meeting will be held at the County Annex Building. ORDINANCES ON FIRST READING ORDINANCE NO. 71-2011 — A GENERAL ORDINANCE AMENDING SECTION ADDING CHAPTER 50 TO THE RICHMOND CODE REGARDING GENERAL SEWER USAGE The USEPA is currently requiring Municipalities with industrial and commercial pretreatment programs update the language and discharge limits within their local ordinances. This language currently exists in Chapter 54 of the Richmond Code. In addition to pretreatment, Chapter 54 holds the requirements for the general use and construction of the sewers within the City and the Sanitary District. Previous to 1997, two ordinances existed that dealt with these issues, Chapter 50 and 54. In 1997, Chapter 50 was repealed and both topics, pretreatment and general sewer usage, were combined into a single Chapter 54. Updates to Chapter 54 were last made in 2007. Due to EPA's new requirements and because of the need to update the language about general sewer usage, it was determined that the most efficient way to do this would be to create separate chapters that dealt with each topic. Chapter 54 will hold all of the needed pretreatment language, while Chapter 50 will hold all of the general sewer use language. Mr. Chidester reported Ordinance No. 71 -2011 was to be held on first reading until further notice. ORDINANCE NO. 72 -2011 — A GENERAL ORDINANCE AMENDING SECTION 54 OF RICHMOND CITY CODE AND ADOPTING AN ENFORCEMENT RESPONSE GUIDE The USEPA is currently requiring Municipalities with industrial and commercial pretreatment programs update the language and discharge limits within their local ordinances. Upon a vote viva voce, the motion passed. ORDINANCE NO. 73-2011 - AN APPROPRIATION ORDINANCE AMENDING THE 2011 BUDGET The Clerk read Ordinance No. 73 -2011 on first reading by title only. Presented by Deputy Chief Abner, this Ordinance would authorize the transfer of funds within the 2011 Budget of the Fire Department as follows: General Fund — Fire Department Delete $687.00 from Physicals Delete $200.00 from Postage Delete $882.00 from Travel Delete $309.00 from Printing Delete $7,000.00 from Gas Delete $309.00 from Repair Vehicles Delete $113.00 from Subscription and Dues Delete $1,300.00 from Training Delete $3,800.00 from Uniform Maintenance Add $2,500.00 to Gasoline Add $12,100.00 to Diesel Mr. Miller moved to advance Ordinance No. 73 -2011 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 73 -2011 on second reading by title only. Council President Pappin declared Ordinance No. 73 -2011 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 73 -2011, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 73 -2011 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 73 -2011 on thins reading by title only. Ordinance No. 73 -2011 was adopted with an 8-0 roll call vote.
