CALL TO ORDER: Mayor Atkins called the regular meeting of the City Council to order at 7:30 p.m. on Tuesday, May 20, 1986, in the Council Chamber. 2. The invocation was given by Pastor Ted Sneed of the Seventh Day Adventist Church, 9664 East Broadway. 3. The Pledge of Allegiance to the Flag was led by Mayor Atkins. 4. ROLL CALL: Present: Councilmen- Dennis, Froehle, Gillanders, Swain, Atkins Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett, Public Works Coordinator Peter- son and Julie Estrada of the Temple City Times 5. CONSENT CALENDAR: Councilman Dennis requested that item B. (4) and B. (6) be removed from the Consent Calendar. On motion by Councilman Gillanders, seconded by Councilman Froehle, the remaining Consent Calendar items were unani- mously approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting- of May 6, 1986 Approved as written. B. RECOMMENDATIONS FROM TRAFFIC COMMISSION MEETING OF MAY 7, 1986. .(1) WENDON WAY.& CLOVERLY AVENUE - ADDITIONAL RED CURB Council approved placement of additional red curb in the area of Longden School, as recommended in staff memo dated May 8, 1986. (2) 9543 -9564 BROADWAY - INSTALL RED CURB Placement of red curb along Broadway on either side of all three driveways of the Temple Town- house was approved by the City Council. Council Minutes, May 20, 1986 - Page 2 1! 2P7 (3) KAUFFMAN AVENUE - LIMITED TIME PARKING Approval was given to limited time parking on Kauffman Avenue as outlined in staff memo dated May 8, 1986. (5) CRA PARKING LOT - INSTALLATION OF SPEED BUMP Pursuant to a complaint received from Clark Drugs regarding excessive speed of vehicles in front of the store, Council approved the place- ment of a speed bump in the isleway between Albertson'sMarket and Clark Drugs. (7) PAL MAL AVENUE: FREER STREET TO LOWER AZUSA ROAD - RADAR SPEED SURVEY Council approved the retention of the existing 30 MPH speed limit on Pal Mal Avenue between Freer Street and Lower Azusa Road. (8) LOWER AZUSA ROAD - TEMPLE CITY BOULEVARD TO SOUTHERN PACIFIC RAILROAD - RADAR SPEED SURVEY Council approved the retention of the existing 40 MPH speed limit on Lower Azusa Road between Temple City Boulevard and the Southern Pacific Railroad. C. 1986 -87 CAPE SEAL AND SLURRY SEAL PROGRAM - APPROVAL OF PLANS AND SPECIFICATIONS - AUTHORIZATION TO SOLICIT BIDS City Council approved the plans and specifications and authorized staff to solicit bids for the 1986 -87 annual preventive maintenance program for streets in Mainten- ance Areas 5 and 6. D. CLAIM FOR DAMAGE - AMERICO RIZZQ. Claim for damages was denied and referred Eo the Southern California Joint Powers Insurance Authority. E. RESOLUTION NO. 86 -2435: INTENTION TO LEVY 1985 -86 ASSESSMENTS FOR CITY -WIDE LIGHTING DISTRICT Council accepted the Engineer's Report for the City - Wide Lighting District; adopted a Resolution of Inten- tion to. Levy and Collect assessments,,for fiscal year 1986 -87; and set public hearing on the matter for the June 3, 1986 Council meeting. F. PLANNING COMMISSION ACTION - MEETING OF MAY 13, 1986 Council received and filed the Planning Commission memo relating to action taken at the Commission's May 13, 1986 meeting. G. RESOLUTION NO. 86- 2436: WARRANTS AND DEMANDS Council adopted Resolution No. 86 -2436, a Resolution to pay bills. B. (4) LOWER AZUSA ROAD :& BALDWIN AVENUE - REPORT FROM COMMISSION Councilman Dennis did not agree with Traffic Commission's . recommendation that changes were not necessary. He felt that a- -1e-ft -hand turn onto Lower Azusa Road from the Jack -in- the -Box Restaurant driveway was unsafe. Council Minutes, May 20, 1986 = Page 3 Councilman Dennis moved to have a "right turn only" sign placed in the Lower Azusa Road drive- way of Jack-in-the-Box Restaurant, seconded by Councilman Gillanders and unanimously carried. (6) McCULLOCH AVENUE - INSTALLATION OF "STOP" SIGNS Councilman Dennis stated that, where there was a "T" intersection, he felt a "stop" sign should be installed. Councilman Gillanders concurred with Councilman Dennis, stating it would be an extra precaution against an accident occurring. Councilman Dennis moved to approve the recom- mendations of the Traffic Commission regarding placement of "stop" signs, as stated in staff memo dated May 8, 1986, with an additional "stop" sign placed at McCulloch and Lynrose Street, seconded by Councilman Gillanders and unanimously carried. 6. .UNFINISHED BUSINESS: None 7. NEW BUSINESS: A. PUBLIC HEARING: REQUEST FOR TENTATIVE TRACT MAP 4413 TO DEVELOP A SIX -UNIT RESIDENTIAL CONDOMINIUM LOCATED AT 5632 McCULLOCH AVENUE; APPLICANT: KENNETH T. HUANG City Manager Koski provided background information stating that the Planning Commission at their April 22, 1986 meeting approved a Tentative Tract Map to allow development of a six -unit detached residential condo- minium located on the east side of McCulloch Avenue between Daines Drive and Live Oak Avenue with a street address of 5632 McCulloch. The applicant proposes to remove the existing structures and construct 6 two - story residential condominiums with an overall density 11.36 dwelling units per acre. Each unit will have an attached two -car garage and six guest parking spaces areevenly distributed throughout the project A Negative Declaration, of Environmental Impact has been filed. Councilman Froehle inquired if the double pane win- dows were for the second story only or both_.floors;: and if sidewalks would be installed. City Manager Koski responded, saying that the double pane windows would be used throughout the structure for energy conservation and soundproofing; and that sidwalks will be installed. The requirement of the double pane windows is a policy decision rather than an Ordinance requirement... Mayor Atkins declared the public hearing open and in- vited anyone wishing to address the subject to come forward. Kenneth T. Huang, 8369 Wendon'Street, San Gabriel, advised that he was the engineer on the project, work- ing very closely.with the architect and owner. He felt that the development was of.high'•'quality and would attract high caliber owners. 'Also,.he stated that the project was compatible to neighboring properties. aK� rr: 6 Council Minutes, May 20, 1986 - Page 4 Councilman Froehle inquired of Mr. Huang if there was any decorative brick work planned for the area of the driveway and fence, since a great deal of cement would make the complex look rather stark. Mr. Huang responded that there is decorative brick work planned and indicated such on plans which he showed members of the Council. Mayor Atkins asked Mr. Huang if he was in agreement with all of the conditions noted on the Conditional Use Permit. Mr. Huang responded affirmatively. As no one else wished to address Council on the matter, Councilman Gillanders moved to close the public hear- ing, seconded by Councilman Froehle and unanimously carried. Councilman Dennis asked what the maximum number of units would be allowed on the property.. Planning Director Shaw responded that the property is zoned R-3' and couid be developed to 11.36 units but is being developed as an R -2 due to the fact that the General Plan indicates the parcel as medium den- sity. Councilman Dennis stated that he had no problem approv- ing the project. Councilman Swain indicated that she was pleased with the medium density plan, the open spaces and the attractiveness of the proposed project. Councilman Gillanders concurred with statements made by Councilman Swain. Councilman Froehle concurred with the positive response of other members of the Council. Mayor Atkins stated that he also agreed with the Council members that this was a welcome project to Temple City. Councilman Gillanders moved to certify the Negative Declaration of Environmental Impact, seconded by Councilman Froehle and unanimously carried. Councilman Swain moved to approve the request for Tentative Tract Map 44413 allowing development of a six -unit residential condominium per the findings and conditions of approval as recommended by the Planning Commission, seconded by Councilman Dennis and unanimously carried. PUBLIC HEARING: ASSESSMENTS FOR STREET LIGHTING IMPROVEMENTS - FIEST AVENUE, LOWER AZUSA ROAD TO LA ROSA DRIVE (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Manager Koski stated that, at their regular meet - ing of November 5, 1985, City Council ordered the installation of eight 5800 lumen HPSV lights on new marbelite poles with overhead service on Fiesta Council Minutes, May 20, 1986 - Page 5 Avenue between Lower Azusa Road and La Rosa Drive. A petition was submitted by property owners pursuant to Chapter 27 proceedings. The street lights were installed and energized by Southern California Edison Company on March 28, 1986, and installation has been confirmed by staff. The cost of installation was $1,920; therefore, the 41 property owners have been assessed at $46.82 per property. A Negative Declar- ation of Environmental Impact has been filed. Mayor Atkins declared the public hearing open and invited anyone wishing to. address the subject to come forward. As no one wished to address Council on the matter, Councilman Gillanders moved to close the public hear- ing, seconded by Councilman Dennis and unanimously carried. Councilman Dennis moved to accept the installation of eight 5300 lumen HPSV lights on Fiesta Avenue bet- ween Lower Azusa Road and La Rosa Avenue; and approve the assessments and instruct the Superintendent of Streets to notify property owners. C. APPROVAL OF FINAL PARCEL MAP 17278 CREATING TWO LOTS AT THE SOUTHEAST CORNER OF DAINES DRIVE AND BALDWIN AVENUE, WITH A STREET ADDRESS OF 5444 BALDWIN AVENUE; APPLICANT: WESTCO LAND, INC. City Manager Koski advised that the City Engineer from the Los Angeles County Department of Public Works has checked Parcel Map No. 17278 and indicated in corres- pondence that it is now ready for approval and accept- ance of the dedications. The Parcel Map allows the creation of two lots with areas of 7,540 square feet and 8,816 square feet. The existing dwelling on the southern lot would be retained. ,A new single family dwelling would be constructed on the northern lot. Councilman Dennis moved to approve the map; accept abandonment and /or restriction of access rights as offered for dedication on said map; approve and accept work agreement; and make findings as outlined in staff memo dated May 14, 1986, seconded by Councilman Gil - landers and unanimously.carried. 8. COMMUNICATIONS: None •5. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: George Koumachian, 9622 East Craiglee, advised that Bar- bara Abraham, president of Sister City, Inc. had requested him to read a letter from the Mayor of Magdelena de Kino advising that she had appointed Dr. Ernesto Valdez as the president of the Magdelana de Kino sister city. Professor Valdez is anxious to establish an exchange of students bet- ween his city and Temple City. Professor Valdez inquired about getting used medical and dental textbooks. Mr. Koumachian advised Council that Mayor Fernandez is very interested in the Sister City program and is offering her full support to Dr. Valdez. :c 224 Council Minutes, May 20, 1986 - Page 6 William Russo, 5626 McCulloch Avenue, requested clarifi- cation on item 5. B. (6) McCulloch Avenue - Installation of "Stop" signs. Councilman Dennis advised Mr. Russo that Council approved "Stop" signs at all intersections recommended by the Traffic Commission with an additional "Stop" sign placed at McCulloch and Lynrose Street. Mr. Russo stated the latter was what he wanted to hear. Delores Swinn, '5444 'Baldwin Avenue, requested confirma- tion that item 7. C. had been approved by the City Council. Mayor Atkins responded that it had been approved. RECESS TO CRA: At this time Council recessed to meet as the Temple City Community Redevelopment Agency; approved the Minutes of the May 6, 1986 meeting; and adopted Resolution No. CRA 272 approving warrants and demands in the amount of $43,656.25. 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. SENIOR CITIZENS CLUB - INSURANCE CONCERN City Manager Koski referred to staff memo dated May 15, 1986, which had been submitted to Council in the Fri- day Memo, wherein the club requested a letter from the City absolving the Senior Citizens Club from any lia- bility in the event of an accident inasmuch as they have no insurance and have been unable to obtain lia- bility insurance for the club. City Attorney Martin advised that the City could not honor the club's. request. Responding to.an inquiry from City Manager Koski, Councilman Gillanders stated that the officers of the club would be covered under their, homeowner's liability insurance policyif they, have one. Council instructed staff to meet with club officers to discuss the possibility of officers using their home- owner's insurance for personal protection. B. CALIFORNIA CQNTRACT CITIES ASSOCIATION BOARD MEETING Councilman Dennis. advised Council that he and the mem- bers of the Executive Board of the California Contract Cities Association met with the Local Government Com- rnittee. and have developed a good relationship with them. He further reported that the ambulance suit with the County is scheduled to go to court on the 15th of June, but will most likely be continued. f°■ Council Minutes, May 20, 1986 - Page 7 Councilman Dennis reported that at the last board meeting the legal action regarding no property tax cities was discussed and the City's City Manager and City Attorney would be meeting with the Pacific Legal Foundation on Thursday, May 22 at City Hall. He wanted to point out that Contract Cities does recog- nize that the City of Temple City has expended funds up front on this issue, and Contract Cities will go ahead and make the assessments to the other cities in order to enable Temple City to be reimbursed for the up -front costs." Several members of the Executive Board of Contract Cities expressed their hope that Councilman Gil - lenders be reelected to the board of Southern Cali- fornia Joint Powers Insurance Authority as they felt he was doing an excellent job. C. TRAFFIC SURVEY - ARDEN DRIVE FROM OLIVE TO LOWER AZUSA Councilman Swain advised members of the Council that she has received several resident complaints regarding excessive speed on Arden Drive between Olive Street and Lower Azusa Road. Councilman Gillanders stated that Halifax Road from Olive to Lower Azusa is also a problem as to excessive speed. Council members were in agreement that the Traffic Commission should conduct a traffic survey of Arden Drive and Halifax Road between Olive Street and Lower Azusa Road. D. SOUTHERN CALIFORNIA JOINT POWERS INSURANCE AUTHORITY Councilman Gillanders reported that currently the Joint Powers Insurance Authority (of which Temple City is a member) has an arrangement whereby the cities all share on a pro rata basis for amounts from $50,000 to $500,000. Losses that exceed $500,000 are handled by an excess carrier. With the escalating costs and prob- lems facing insurance companies, carriers are becoming more reluctant to insure cities at all, resulting in 42 cities in California that are without insurance. Councilman Gillanders requested a policy position by the Council on a vote which will be taken at the next meeting of the executive board of the JPIA as the decision of the board will affect all the cities. The following are the options available: 1 that the Authority super- impose an assess- ment on each of the member cities.to estab- lish a fund to re- insure the cities for the excess coverage of $500,000 to approxi- mately $10,000,000 for each occurrence; 2. that a second JPIA be created that would cover the City's.insurance.from-$500,000 to $10,000,000;' 3. continue as presently exists as long as insurance is available on the open market. 5 222 Council Minutes, May 20, 1986 - Page 8 City Attorney Martin recommended, based on the options available, that Council vote in favor of the superfund. Councilman Gillanders concurred in that it appeared to give the cities more control over their own destiny. Council concurred that Councilman Gillanders vote in favor of the superfund. E. 1985 ANNUAL SISTER CITY AWARDS SPONSORED BY READER'S DIGEST FOUNDATION Mayor Atkins advised that Temple City has been chosen to receive an award for the "best overall program" for a city with a population of less than 50,000, which was sponsored by the Reader's Digest Foundation, and which will be awarded at the Sister Cities International Conference in Los Angeles on July 19, 1986. F CORRESPONDENCE RECEIVED FROM DAVID DREIER RE: CORPS OF ENGINEERS' PROPERTY LOCATED WITHIN THE SANTA FE DAM RECREATIONAL PARK Mayor Atkins advised Council that he had received cor- respondence from Congressman David Dreier advising that legislation was recently presented in Congress to direct the Secretary of the Corps of Engineers to con- vey the property located within the. Santa Fe Dam Recre- ational Park area along the San Gabriel River directly to the City of Irwindale - - at taxpayers' expense. The proposed use for this property would be to con- struct a toxic waste incinerator. The City of Duarte is interested in obtaining this same piece of property for the purpose of developing an equestrian facility on the site. Mr. Dreier has urged the City Council to urge the Board of Supervisors to let this property go to a recreational use rather than a toxic waste site. Councilman Swain moved that:Mayar.Atkins respond to Congressman Dreier's letter by writing Congressman Carlos Moorhead that the City Council of Temple City urges a negative vote on the proposed legislation, seconded by Councilman Gillanders and unanimously carried. 12.
