No. 1. "That it is equipped as a two family apartment." This reason was based on the finding of Mr. Berg and Mr. Kratovil who inspected the property after the meeting of Aug. 6 (several weeks after this matter was brought before the Planning commission) inepite of the fact that they were informed at this meeting that carpenter work had been done in the house of this property within the last two or three weeks, and in spite of the evidence produced at the first hearing that at t_ ham e there was no kitchen on the ground floor of the house. When this matter was brought before the Planning commission, enough evidence was presented to prove that at that time there were not two kitchens in the building, that the laundry room on the ground floor which was in use at that time as a kitchen was equipped with only a double laundry tub and nothing more - -no kitchen sink or cupboard. This faut was verified by both Mrs. Knop and her agent, Mr Estes. Therefore, any kitchen fixtures which Mr. Berg and an Mr. Kratovil saw on the ground floor was installed long after this case was presented to the Planning commission, a fact which was plainly pointed out to the Commission at their meeting of Aug. 6. The PKnop Uommission has propertynetherewwerennotht at two kitchens time Mrs. house, p in the house, and this fact also was verified by both Mrs. Knop and Mr. Estes - Then, from the time of her purchase ed as about a month apartment." or less, this building was not "equipp Therefore, this reason for the Planning Commission s decision ahoula be ruled out. No. 2 will be commented upon later. No. 3. "In existence prior to the ordinance." Evidence was presented by Mrs. Knop and Mr. Estes that at one time Mr. and Mrs. Sacheiri, the former owners, installed kitchen fixtures in the above mentioned laundry room and rented the ground floor as an apartment, but in giving the reason for the Sacheiris removing this equipment, Mrs. Knop stated that they did it out of spite because of losing their property. We wish to point out two facts: (1) that in a court of law one person's opinion of another's inner thoughts is not permitted as evidence, and (2) if the Sacheiris did install kitchen fixtures and later remove them, as far as Mrs. Knop's Deed of Trust was concerned (according to legal advice we have had on this point), -1- ,r •m V1ee4hairman J.
