Martha Nelson, SE retary Minut( Meetii The Planning Commissi Joe Davis at 7:32 P.M of the Planning Commission of December 22, 1977 Meeting was called to order by Cha Those Present: Joe Davis, Ed Gaines, Blanche Fries and Red Livingston Absent: Bill Bebee Minutes of the December 8, 1977 meeting were approved as received. It was noted that the word Savior should read Waiver. A Anda Item #1: Public Hearing for Conditional Use Permit for Robert Loper, 507 Highland Springs Road for Off premise sale of Beer and Wine. Negative Declaration, E.I.R. #125. Mr. Loper was present to answer any questions regarding his request. The Commission declar d E.I.R. #125 a Negative Declaration and the Public Hearing was de Tared open at 7:35 P.M. Mr. Loper stated that sales would take place within the building and the hours would be se6 by A.B.C. There was no one pres nt to speak or ask questions for this request nor was there anyone 3resent to speak or ask questions against this request. Jerry Kay asked one q estion about whether or not who can sell to an individual under the 'nfluence. This was answered by Joe Davis and Glenn Sparks. They e plained the law on this question. No further comments, he Public Hearing closed at 7:40 P.M. On Motion by Red Livi gston, seconded by Blanche Fries the ommission voted unanimously to rant off sales of Beer and Wine. Res lution No. 1977 -33 AYES: Joe Davis, R d Livingston, Blanche Fries, Ed NOES: None ABSENT: Bill Bebee Agenda Item #2: Public Hearing on request for Zone Varianc for Gerald Kay, 690 E. 13th Street for waiver of sidewalk requi ement. Negative Declaration, E.I.R. #126. Mr. & Mrs. Kay were present to answer any questions regardi g their request. The Commission declared E.I.R. #126 a Negative Declaration nd the Public Hearing was declared open at 7:45 P.M. Mr. Kay explained this was a request to waive the sidewalk equirement as they are adding to an existing bedroom to make a family oom. Negati e Declar- ation, E.I.R. #128. j The Commission declare E.I.R. #128 a Negative Declaration a d the Public Hearing was dec ared open at 7:55 P.M. Mr. Schroeder was pres nt to answer any questions on the request. He stated he intends t add a 12 x 27' family room onto his house. It will not effect the off - street parking and curb and gutter are in along Michigan and 2th Streets. No one was present to i Ppeak against this request and no one was pre- sent to speak for thisirequest. On Motion by Ed Gained, Seconded by Red, the Commission voted to grant this waiver. Resolution No. 1977 -34 AYES: Red Livingston, Ed Gaines and Blanche Fries NOES: None ABSENT: Bill Bebee ABSTAIN: Joe Davis Agenda Items #4 and 8' Chairman Davis suggested that these two items should be considered onder the same item as one. Staff recommended that Mr. Redmond does not need a Condition 1 Use and he should receive 'a refund. (501.2 sub para 6) This wa3 item #8 on the agenda. E.I.R. #130 will remain unused. The Commission declared E.I.R. #127 a Negative Declaration Public Hearing was declared open at 8:05 P.M. Don Long explained that this was taken care of at the last meeting (12 -8 -77) and that the permit to erect the sign had been purchased from the Building Department. This is a sep- arate item. Agenda Items #'s 5 and 6 were tabled to the January 12, 1978 meeting. Agenda Item #7 Set date for Public Hearing on Request for onditional Use Permit for sign at 410J Pennsylvania Avenue for Hal Hey ood. Negative Declaration, E.I.R. #129. Cal Trans has informed us that property zoned O -S (Open SpE be issued a permit to erect a sign. Staff recommends cane( E.I.R. #129 and return the filing fee to Mr. Heywood. Glenn recommended that Commission go ahead with the Public and get a letter from Cal Trans. Blanche wants to notify Heywood of what we learned first. Additonal Agenda Items: Set date for Public Hearing for Zone Variance for Hydroponics, E.I.R. #133. Thursday, January 26 at 7:30 P.M. in the Council Ch bers as the -time and place for said hearing.(E.I.R. #133 Negative eclaration). Date set for Public Hearing on same is Januammry 26, 1977 at 7:30 P.M. in the Council Chambers as the time and plac for said hearing. E.I.R. #132, Negative Declaration. Glenn asked what the feeling of the Commission is on the M ni -Park? Joe Davis said that that would be pre - judging and he expla ned. ME Mr. Murdock wanted to know if there was any reason not to gr4nt the permit. He further stated that so far they (the Chamber) has not had any opposition on the project. Mr. Murdock was informed the application would be good for oz 1 year at a time, and can be required to make changes to meet ordinances.
