RESOLUTION NO.2008-36
RESOLUTION GRANTING PRELIMINARY AND FINAL PLAT APPROVAL
FOR RGA PROPERTIES, LLC, LOCATED AT 4535 WILLOW DRIVE
WHEREAS, RGA Properties, LLC, d/b/a Walter G. Anderson, Inc. (the
"Applicant") has requested approval of a preliminary and final plat to combine parcels,
located at 4535 Willow Drive (the "Subject Property") which is legally described on
Exhibit - A attached hereto; and
WHEREAS, the preliminary plat and final plat of the Subject Property was
reviewed by the Planning Commission on April 8, 2008 and, following public hearing
thereon as required by law, the Planning Commission recommended approval thereof,
subject to certain terms and conditions; and
WHEREAS, the City Council on May 20, 2008 reviewed the preliminary and
final plat, and determined the proposed plat met the findings as established under City
Code Section 820.21. Subd. 10, which are as follows:
(a) the proposed subdivision is not in conflict with the general and specific plans of
the city.
(b) the physical characteristics of this site, including but not limited to topography,
vegetation, soils, susceptibility to flooding, water storage, drainage and
retention, would not render the site unsuitable for the type of development or
use contemplated.
(c) the site is physically suitable for the proposed density of development and does
meet minimum lot size standards.
(d) the design of the subdivision or the proposed improvements is unlikely to cause
substantial environmental damage.
(e) the design of the subdivision or the type of improvements is unlikely to cause
serious public health problems.
(f) the design of the subdivision or the type of improvements will not conflict with
public or private streets, easements or right-of-way.

WHEREAS, the City Council further finds that the Applicant has successfully
demonstrated the preliminary plat and final plat of the Subject Property meet the criteria
and conditions necessary to approve said plats, subject to certain terms and conditions.
NOW, THEREFORE, BE IT RESOLVED by the City Council and the City of
Medina, Minnesota, that it should and herby does approve the request by RGA
Properties, LLC, for preliminary and final plat of the Subject Property, subject to the
following terms and conditions:
1. The Applicant must comply with all terms and conditions of the Plat Opinion letter
from City Attorney dated May 9, 2008, and as presented in the May 20, 2008 City
Council packet planning staff report;
2. The Applicant must comply with all terms and conditions from Pioneer -Sarah Creek
Watershed District review letter, dated April 17, 2008, and as presented in the May
20, 2008 City Council packet planning staff report;
3. The Applicant must comply with all terms and conditions from Minnesota
Department of Transportation review letter, dated April 4, 2008, and as presented in
the May 20, 2008 City Council packet planning staff report;;
4. The Applicant shall comply with the conditions outlined in the City Engineer's
review letter dated March 24, 2008, and as presented in the May 20, 2008 City
Council packet planning staff report;
5. The Applicant shall provide an easement over the existing sewer and water lines on
the property (as indicated by the City Engineer's review letter);
6. The Applicant shall complete the submittal requirements and execute the Declaration
of Restrictions and Covenants document related to the previous wetland mitigation
and buffer establishments from the 2004 expansion project and approvals, as
presented in the May 20, 2008 City Council packet planning staff report;
7. The Applicant shall comply with all conditions and regulations of the adopted City
Zoning Ordinance and City Code at time of approval, including the city Wetland
Ordinance and wetland buffer/easement requirements; and
8. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City
for the cost of reviewing the application and related documents.
9. The final plat shall be revised as required by Hennepin County Surveyor.
10. The final plat must be filed with Hennepin County Recorder within 60 days of the
date of the city council resolution granting final approval or the final plat shall be
considered void, unless a written request for time extension is submitted by the
Applicant and approved by the city council

The motion for the adoption of the foregoing resolution was duly seconded by member
Weir upon vote being taken thereon, the following voted in favor thereof:
Crosby, Smith, Weir, Cavanaugh, Johnson
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

The West 631 feet of the East 664 feet of that part of the West '/ of the Northeast 1/4 of
Section 4, Township 118 North, Range 23 West of the 5'i' Principal Meridian, which lies
South of the North 1343 feet of the West % of the Northeast 1/4 and lies northerly of State
Highway No. 55.
Together with that portion of Willow Drive vacated in Resolution No. 03-20 filed as
Document No. 8413169 accruing thereto by reason of said vacation, Hennepin County,
Minnnesota.
Parcel 2
That part of the West '/ of the Northeast 1/4 of Section 4, Township 118 North, Range 23
West of the 5th Principal Meridian, which lies South of the North 1343 feet of said West %z
of the Northeast 1/4, Northerly of State Highway No. 55, and West of the East 664 feet of
said West `/ of the Northeast'/4, Hennepin County, Minnesota.
