CITY OF MEDINA
RESOLUTION NO.2008-38
RESOLUTION AMENDING COMPLETION OF VACATION
OF A PORTION OF WILLOW DRIVE
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, the City completed a roadway and intersection improvement project at T.H.
55 and Willow Drive (the "Project") in 2003; and
WHEREAS, the City had more right-of-way for Willow Drive than necessary and vacated
a portion of Willow Drive when the Project was complete; and
WHEREAS, notice of the public hearing for the vacation was posted, published in the
official newspaper and mailed to the owners of affect properties, all in accordance with law; and
WHEREAS, the City adopted Resolution No. 03-20 which vacated a portion of Willow
Drive; and
WHEREAS, it has recently come to the City's attention that the legal description used in
Resolution No. 03-20 did not accurately describe that portion of Willow Drive that was intended to
be vacated; and
WHEREAS, a legal description attached as Exhibit A more accurately describes the same
portion of Willow Drive that was vacated in Resolution No. 03-20; and
WHEREAS, the City will prepare a revised Notice of Completion of Vacation Proceedings
using the legal description in Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota as follows:
1. The City hereby determines that the legal description in Exhibit A attached hereto
should be used in the revised Notice of Completion of Vacation Proceedings.
2. The city administrator or his designee is authorized and directed to prepare and
present to the Hennepin County auditor a revised notice which describes the same
property as originally described in Resolution No. 03-20 using the attached Exhibit
A as the more accurate legal description.

vote being taken thereon, the following voted in favor thereof:
Crosby, Smith, Weir, Cavanaugh
and the following voted against same: (Absent: Johnson)

Whereupon said resolution was declared duly passed and adopted.

WILLOW DRIVE VACATION DESCRIPTION- AMENDED
Together with that portion of Willow Drive described as:
That part of the East 33.00 feet of the Southwest Quarter of the Northeast Quarter of Section 4,
Township 118, Range 23, Hennepin County, Minnesota, lying northerly of State Highway No. 55 as
described in Document No. 2843993, Deed Book 1979, page 253, and that part of the West 33.00
feet of the Southeast Quarter of the Northeast Quarter of said Section 4, also being that part of
Willow Drive as dedicated in the plat of CATES RANCH, filed as Document No. 6112989lying
northerly of State Highway No. 55 as described in Document No. 2843993, Deed Book 1979, page
254, lying southerly of a line beginning at a point on the west line of said East 33.00 feet of the
Southwest Quarter of the Northeast Quarter, distant 541.80 feet north of the south line as measured
along said west line of the East 33.00 feet of the Southwest Quarter of the Northeast Quarter and
said line terminating at a point on the east line of said West 33.00 feet of the Southeast Quarter of
the Northeast Quarter, distant 324.80 feet north of said south line as measured along said east line of
the West 33.00 feet of the Southeast Quarter of the Northeast Quarter.
