HomeMy Public PortalAbout2008-042 Resolution Authorizing Publication of Ord 445Member Weir introduced the following resolution and moved its adoption CITY OF MEDINA RESOLUTION NO. 2008-42 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 445 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 445, an ordinance regulating illicit discharges and illicit connections to the city's storm water system; and WHEREAS, Minnesota Statutes § 412.191, subdivision 4 allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinance is 8 pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk shall cause the following summary of Ordinance No. 445 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 445, adding Section 747 to the city code regarding storm water illicit discharge and illicit connections to the storm sewer system. This ordinance promotes, preserves and enhances the water bodies within the city by protecting them from adverse effects caused by non -storm water discharge that is caused by the disposal and dumping of substances and materials and illicit connections to the city's storm sewer system. This ordinance regulates connections and discharges to the city's storm sewer system along with the dumping and disposal of substances and materials that may enter the system. The ordinance sets forth discharge prevention requirements for all properties. The ordinance contains a notification requirement which requires notification to the city of all known or suspected releases of materials or pollutants which may result in illegal discharges to the storm sewer system. The ordinance sets forth inspection, sampling, dye testing and examination requirements for buildings related to storm water discharge. The ordinance also permits the city to suspend a property owner's access to the storm sewer system, along with the option to take other enforcement actions as are necessary. The full text of Ordinance No. 445 is available from the city administrator -clerk at Medina city hall during regular business hours. BE IT FURTHER RESOLVED by the city council of the city of Medina that the city administrator -clerk keep a copy of the ordinance in his office at city hall for public inspection and that he post a full copy of the ordinance in a public place within the city.
