CITY OF MEDINA
RESOLUTION NO. 2008-43
RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 446 BY TITLE AND SUMMARY
WHEREAS, the city council of the city of Medina has adopted Ordinance No. 446, an
ordinance amending the construction site storm water runoff control ordinance; and
WHEREAS, Minnesota Statutes § 412.191, subdivision 4 allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the ordinance is 18 pages in length; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that
the city administrator -clerk shall cause the following summary of Ordinance No. 446 to be
published in the official newspaper in lieu of the entire ordinance.
Public Notice
The city council of the city of Medina has adopted Ordinance No. 446, an amendment to the
city's construction site storm water runoff control ordinance. The amendment adds additional
requirements for final stabilization of the soil on construction sites where land disturbing activities
are taking place. Requirements for land disturbance activities that are less than one acre have been
added. Additional requirements for the management of construction site waste have been added.
The use of a temporary tracking pad is now required for all roads, access and parking areas on the
site. The criteria for site erosion control has been modified and additional provisions have been
added that pertain to runoff and sediment control. Sections pertaining to site restoration and special
and impaired waters have been added. The amendment also added additional inspection and record
keeping requirements. Inspection and maintenance requirements for best management practices
have been added. An additional enforcement provision was added that makes any violation of any
provision of this ordinance a misdemeanor.
The full text of Ordinance No. 446 is available from the city administrator -clerk at Medina city hall
during regular business hours.
BE IT FURTHER RESOLVED by the city council of the city of Medina that the city
administrator -clerk keep a copy of the ordinance in his office at city hall for public inspection and
that he post a full copy of the ordinance in a public place within the city.
