CITY OF MEDINA
RESOLUTION NO.2008-47
RESOLUTION AUTHORIZING PUBLICATION OF
ORDINANCE NO. 447 BY TITLE AND SUMMARY
WHEREAS, the city council of the city of Medina has adopted Ordinance No. 447, an
ordinance amending the open burning ordinance; and
WHEREAS, Minnesota Statutes § 412.191, subdivision 4 allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the ordinance is 6 pages in length; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that
the city administrator -clerk shall cause the following summary of Ordinance No. 447 to be
published in the official newspaper in lieu of the entire ordinance:
Public Notice
The city council of the city of Medina has adopted Ordinance No. 447, an amendment to the
city's open burning ordinance. The ordinance requires a permit for all open burning except
campfires and fires in a grill, camp stove or other device intended for cooking. Some permits may
be issued by the Medina fire warden. Other permits may be issued by the fire warden but only after
approval from the state forest officer. Burning of household waste is not permitted. Burning of
other specified materials is also prohibited. Except in the case of prairie management fires, burning
must be kept 600 feet from occupied houses unless permission is first obtained from the owners.
All burning must be conducted in a safe manner and subject to permit limitations. In any case in
which a permit has been revoked for violation of its conditions, no subsequent permit may be
issued without an inspection of the site and the payment of an inspection fee. The full text of
Ordinance No. 447 is available from the city administrator -clerk at Medina city hall during regular
business hours.

BE IT FURTHER RESOLVED by the city council of the city of Medina that the city
administrator -clerk keep a copy of the ordinance in his office at city hall for public inspection and
that he post a full copy of the ordinance in a public place within the city.
