A RESOLUTION TO AWARD THE DUCK CREEK STABILIZATION
CONTRACT TO THE LOWEST RESPONSIBLE BIDDER
WHEREAS, the City of Riverdale, Iowa ("Riverdale"), held a public hearing on May 4,
2010, on the proposed plans, specifications, form of contract, and estimated cost for the
Duck Creek Stabilization Project (the "Project"); and
WHEREAS, the Project is a public improvement, subject to the Iowa Construction
Bidding Procedures Act, Iowa Code Chapter 26 (the "Act"); and
WHEREAS, Riverdale has advertised for, opened, and considered sealed bids for the
Project as required by the Act; and
WHEREAS, the firm of Miller Trucking and Excavating timely submitted a bid for the
Project of $53,015.00, making the Firm the lowest responsive, responsible bidder.
NOW, THEREFORE, BE IT RESOLVED, by the Riverdale City Council that Riverdale
awards the Project contract to Miller Trucking & Excavating; and
RESOLVED FURTHER, that the Riverdale City Clerk shall retain the bid security
furnished by Miller Trucking & Excavating until the approved contract form has been
executed, a bond has been filed by Berkely Regional Insurance Company guaranteeing
the performance of the contract, and the contract and bond have been approved by the
City Council; and
RESOLVED FURTHER, that the Riverdale City Clerk shall return the bid security
submitted by the unsuccessful bidders within thirty days.
PASSED, APPROVED AND ADOPTED THIS 18 day of May, 2010.
