RESOLUTION NO. PC81 -1
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF BEAUMONT, CALIFORNIA
GRANTING CONDITIONAL USE PERMIT
WHEREAS, the Planning Commission of the City of Beaumont did by
consider a Bell, d /b /aC Beaumont a e
Swap Meet, toA operate lan swap umeet dfacilfity;
and
WHEREAS, the Planning Commission did give notice of the
Public Hearing as required by law (see attached Exhibit "A "); and
WHEREAS, the Planning Commission did hold said Public Hearin
and consider said Conditional Use Permit Application on February 13
1981 and February 26, 1981;
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
does hereby approve the request for a Conditional Use Permit by
Gladys Bell, subject to the following conditions:
1. Upon the effective date of this permit, all prior permit
and conditions shall be declared null and void; and no vested
rights shall be expressed or implied concerning the use authorized
by said permit.
2. Approval of the swap meet operations shall be developed
strictly in accordance with the approved site plan. Any deviation
from this adopted plan shall be cause for future revocation of this)
permit.
3. No more than one hundred fifty (150) vendors may operate
at any one time, as per the site plan.
4. Improved off- street public parking shall be provided for
a minimum of three hundred twenty -seven (327) vehicles, as per site
plan.
5. The required parking spaces are to be made available to
the general public at no cost.
6. The applicant will gravel completely the driveways
(firelanes) as per site plan.
7. The parking stalls shall be delineated with lime. The
restri_ping will be carried out as required.
8. A sign(s) provided and displayed by the owner will be
placed at the northwest corner of the leased property directing
parking south of Xenia and to the rear of the swap meet.
9. No sexual devices, narcotic paraphernalia (i.e., roach
clips) or any other such items that will offend the general decency
of the public, shall be exhibited or displayed whereby any juvenile
on the premises, with or without parental control, may be sold,
rented, displayed or given said item at this location. Further,
that no alcoholic beverage be consumed on the premises by any
person, patron, or vendor whether such alcoholic beverage is in
the possession of a minor or adult.
10. The electrical boxes installed on the base of the light
standards are to remain disconnected due to their poor condition,
or brought up to current code.

1 11. Electrical drop cords are not to run across driveways
and paved areas.
2 12. The vegetable stands and office will be brought up to
3 electrical code standards, under the building code, as needed for
normal operation. A Certificate of Compliance will be sent to the
4 City by the applicant within thirty (30) days from the effective
date of this permit.
5 13. The three east /west lanes A, B, and C shall have signs
6 plainly posted with the words "Keep Lanes Clear ".
7 14. At least two (2) ABC type extinquishers will be mounted
on the existing main building known as the office. To be used
8 during all hours of operation when the swap meet business is being
conducted.
9 15. The businesses at the swap meet shall not create a hazar
10 to life such as the preparation and /or the selling of petroleum
base products as would be found with the existence of gasoline,
11 alcohol, thinners, etc. The selling of such items will not be
allowed.
12 16, Applicant shall not allow businesses requiring open flam�,
13 such as muffler welding on vehicles, etc., which create an
unnecessary fire hazard through performance of this service.
14 17. Within thirty (30) days of the effective date of this
15 permit, all selling spaces shall be re- numbered and existing
numbers removed. Applicant shall furnish a current master list and
16 map of spaces, and the numbering system, to the City Building
art -
Department, Police Department, Fire Department and Planning Dep
17 ment.
18 18. All future construction shall secure a valid building
permit from the Building Department.
19 19, Fire lanes, as specified by Exhibit "B" are to be
20 painted with a white background with red letters identifying them
as fire lanes.

20, No encroachment, blocking or other interference with �
22 official fire lanes shall be allowed.
,Z3 21. Adequate security shall be provided at the expense of th4
applicant during all hours the facility is open to the public. Thi
24 determination shall be made by the Police Department and the appli-
cant.
25 22. No vendor parking shall be allowed on Spaces 1 through
26 17, see Exhibit "B ".
23. Business licenses for each vendor, if required by the
27
City, shall be prominently displayed during all business hours.
28 24. Applicant shall comply with Federal and State guidelines
29 on handicapped restroom facilities.
25. Applicant shall move the temporary restrooms, located
30 currently behind the vegetable stand, an adequate distance so as
31 not to be in violation of health standards.
26_ Applicant must a) adequately stripe, b) channelize, or
32 c) remove light pole at the northeast corner of site.
27. Applicant shall provide an appropriate sign with the
words "No Left Turn ", and place it at the northeast driveway. This

;ign shall face south.
28. Overnight storage of saleable merchandise will not be
allowed unless the applicant constructs a six foot chain link fence
ts required by the Planning Commission. Enclosure for overnight
Storage shall be limited to Spaces 85 through 93 only, see Exhibit
'B ". Also refer to Section 203.1, subsections 8, 13, 14b-
29. No overnight parking shall be permitted by vendors. (No
overnight parking by owners is implied).
30. Applicant shall provide adequate handicapped parking as
per site plan.
31. Applicant shall comply with Article 402.11, or obtain a
trash haulers permit as required by the City of Beaumont.
32. Proposed snack area shall operatein accordance with the
health and safety codes of this County, and shall have the proper
permits in and posted during normal business hours.
33. This permit shall allow the swap meet to operate weekly
as per application.
34. In the event applicant, or its successor in interest,
shall violate any of these conditions and be informed in writing at
its place of business, 1501 East Sixth Street, Beaumont, CA., 922223
or at residence address, 266 North Fourteenth Street, Banning,
92220, by the city to correct the same it shall do so within thirty
(30) days. In the event it shall not do so, this Conditional Use
Permit shall be revoked and any continued use by app
successors, shall be in violation of applicable laws and ordinances
of the City of Beaumont.
35. Applicant has sixty (60) days to comply with the above
conditions except for conditions which specify a thirty (30) day
compliance date.
36. The Conditional Use Permit shall be subject to an annual
review.
I HEREBY CERTIFY the foregoing Resolution was duly adopted
by the Planning Commission of the City of Beaumont, County of
Riverside, State of California, at a Special. Meeting of said
Planning Commission held on the 24th day of March, 1981, by the
following vote:
AYES: Commissioners Livingston, Barker, Medina,-Remy,
Seaburg and Chairperson Thompson,
NOES: None.
