RESOLUTION NO. PC81 -2
1 A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF BEAUMONT, CALIFORNIA
2 GRANTING CONDITIONAL USE PERMIT
3 WHEREAS, the Planning Commission of the City of Beaumont did
consider a verified application for a Conditional Use Permit for
4 Raymond and Patsy Shaw; and
5 WHEREAS, the Planning Commission did give public notice, see
attached Exhibit "A "; and

WHEREAS, the Planning Commission did hold a Public Hearing
7 on February 13, 1981 and February 26, 1981, in the Beaumont City
Council Chambers;

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
9 hereby approves the request for a Conditional Use Permit by Raymond
and Patsy Shaw, subject to the following conditions:

1. Upon effective date of this permit all prior permits and
11 conditions shall be declared null and void and no vested rights
shall be expressed or implied concerning the use authorized by
12 said permit.
13 2. Approval of the operation shall be developed strictly in
accordance with the approvedsite plan, with the exception that the
14 parking spaces shown on the site plan be changed from 900 parking
to 600 parking, see Exhibit "B ". Any deviation from this plan
15 shall be cause for future revocation of this permit.
16 3. No more than thirty -nine (39) vendors may operate at any
one time, as per site plan.
17 4. Improved off- street parking shall be provided for a mini
18 mum of ninety -nine (99) vehicles, as per site plan.
19 5. The required parking spaces are to be made available to
the general public at no cost.

6. The applicant will gravel completely the firelanes as pe
21 site plan.

22 7. The vendor and parking stalls shall be delineated with
lime. The restriping will be carried out as required.

S. Applicant shall furnish a current master list and map of
24 booths, and a numbering system, to the Police Department, Fire
Department, Planning Department and City Manager.
25 9. No overnight parking of vehicles or campers shall be
26 allowed.
27 10. No overnight storage of merchandise shall be allowed,
unless in compliance with Article 203.1, subsections 8, 13, 14b,
28 "Screening ".
29 11. Applicant shall provide proper signs indicating the ratel
of speed in driveways.

12. Applicant shall provide a sign indicating a "Right Turn
31 Only ". The sign shall be placed at the north end of the driveway
near the Longhorn Tavern as the traffic egresses to 6th Street.
32 13. Applicant will supply to the Planning Commission, for it
file, copies of acceptance letters from owners of the land on each
side of the proposed swap meet regarding encroachment.
1 14. Applicant must provide three (3) approved handicapped
parking spaces.
2 15. Applicant shall provide adequate trash facilities for the
3 swap meet. 55 gallon barrels placed in strategic areas to accommo-
date vendors and patrons.
4 16. The proposed snack bar shall operate in accordance with
5 the health and safety codes of this County, and shall have the
proper permits in order and posted during business hours.
6 17. The public restroom facilities shall be designed in such
7 a manner as to accept the handicapped. The restrooms shall be
maintained in an acceptable manner.

18. Business licenses or vendor permits for each vendor, if
9 required by the City, shall be prominently displayed during all
business hours.
10 19. The driveway from the rolled curb on 6th Street south to
11 the actual swap meet site shall be graded and surfaced in accord -
e h the standards prescribed by the City Council. (Article
20. No parking shall be allowed adjacent to the Longhorn
13 Tavern on the west side. However, four parking spaces shall be
allowed on the west side of the proposed driveway to the swap meet
14 Further, four parking spaces, clearly defined, shall be allowed
directly behind the Longhorn Tavern.
15 21. Landscaping shall conform to Article 804.10, and the
16 provisions for irrigation and maintenance thereof.
17 22• All future construction shall secure a valid building
permit from the City Building Department.
18 23. Floodlights, for security, must comply with Article 804.:
19 24. The City shall have right of entry for inspection.
20 25. Applicant shall maintain two (2) five (5) pound ABC type
21 fire extinguishers on premises at all times.
22 26. No sexual devices, narcotic paraphernalia (i.e., roach
clips) or any other such item that will offend the general
23 decency of the public be exhibited or displayed whereby any
juvenile on the premises, with or without parental control, may be
24 sold, rented, displayed or given said item at this location.
Further, that no alcoholic beverage be consumed on premises
25 (swap meet or parking area) by any person, patron, or vendor
whether such alchol.ic beverage is in the possession of a minor or
26 adult.
27 27. The applicant shall comply with the Uniform Building
Code and Electrical codes concerning this swap meet.
28 28. In the event applicant or its successor in interest shal
29 violate any of these conditions, and be informed in writing, at

30 3. Partners address, if any,
31 by the City to correct same, it shall do so within thirty (30)
days. In the event it shall not do so, this Conditional Use Permi
32 shall be revoked and any continued use by applicant, or its
successors, shall be in violation of applicable laws and ordinance

of the City of Beaumont.
29. Applicant has sixty (60) days to comply with the above
conditions, except for conditions which specify a thirty (30) day
compliance date.
30. This Conditional Use Permit shall be subject to an
annual review.
I HEREBY CERTIFY the foregoing Resolution was duly adopted
by the Planning Commission of the City of Beaumont, County of
Riverside, State of California, at a Special Meeting of said
Planning Commission held on the 24th day of March, 1981, by the
following vote:
AYES: Commissioner Livingston, Barker, Medina, Remy, Seaburg,
Chairperson Thompson.
