MEETING MINUTES
Tuesday, September 11 , 2018 at 7 : 00 pm
Brewster Town Office Building
Chair Brian Harrison convened the Zoning Board of Appeals meeting at 7 : 00 pm in the Brewster Town Orfice Building
with members present : Arthur Stewart , Jeanne Kampas , William Hoag , John Nixon and Patricia � r .� u' lR f
Member missing : Bruce MacGregor
Also present : Susan McShane .
The Chair read the Recording or Taping Notification : "As required by the Open Meeting Law we are informing
you that the Town will be audio and video taping this public meeting . In addition , if anyone else intends to audio or
video tape this meeting he or she is required to inform the chair. "

18 = 12 Thomas L. Stripling, Trustee of the Lodge Nominee Trust of 2009 . ( Represented by Attorney Paul R.
Tardif), Lot 86 Flying Dragon Road, MAP 78 LOT 127, previously M 2 L 105 . In the RM zoning district . The applicant
seeks a Variance under MGL 40A 40 to establish buildability of the lot and other relief deemed necessary .
Chairman read a letter from Attorney Paul R . Tardif into the record . Attorney Tardif request a CONTINUANCE until
November 13, 2018 Zoning Board meeting .
MOTION by Arthur Stewart to CONTINUE 1842 (Stripling ) to November 13 , 1918 as requested . Second by
Patricia Eggers , VOTE : 6-0-0 .
18 = 13 Nicole and Jay Merriman , ( Represented by Frank Shirley Architects), 692 Tubman Road , MAP 65 LOT 50,
previously M 26 L 108, in the RM zoning district. The applicant seeks a Special Permit under MGL 40A- 6 and
Brewster Bylaw 179- 25 A (extension and alterations) to add to an existing historical structure within the front yard
setback.

Mr . Frank Shirley (Architect) represented the applicant.
Mr. and Mrs . Merriman were present .
Mr . Shirley gave an overview of this project;
• Home is now very close to the road
• The house actually predates the road
• The original front is now the back
• There have been previous additions
• This addition will improve the function of the home
• proposed addition is non-conforming approximately 7 feet from the road
• it does extend the non -conformity'
• addition cannot be turned due to wetlands behind
• Home was built in 1734/ one bathroom , no basement
Questions from the Board
• Where do you stand with Conservation ? Continued until October 2 , 2018
• ZBA could approve with Condition upon Conservation decision .
• Normally ZBA waits until finished with Conservation
• This property had Cons Com approval 9 years ago
• On the original building , what is the setback? Corner to the road
• You are increasing the non-conformity , can it move back? NO , wetland behind
• Septic approval ?
• New attached garage is completely conforming
• What is square footage of increase? 2 . 6 % increase
• Need new site plan with all dimension (contour lines)
• Engineer can create a zoning table on the site plan
• Has the Building Commissioner seen this plan ? YES
• Complicated site
• Historic approval was granted 8/ 10/ 18
