Anderson AdditionMember Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2008-64 RESOLUTION GRANTING EXTENSION OF TIME TO FILE FINAL PLAT FOR WALTER G ANDERSON ADDITION AMENDING RESOLUTION 2008-36 WHEREAS, RGA Properties, LLC, d/b/a Walter G. Anderson, Inc. (the "Applicant') received approval of a preliminary and final plat to combine parcels, located at 4535 Willow Drive (the "Subject Property") which is legally described on Exhibit - A attached hereto; and WHEREAS, under the terms of said resolution, approval was valid for a period of sixty days from June 3, 2008, and WHEREAS, the Applicant received a 30-day extension up to September 18, 2008, in order to meet the terms and conditions of approval, as approved under Resolution No. 2008-56, adopted by the City Council on August 19, 2008; and WHEREAS, the Applicant has requested an additional 30-day extension in order to meet the same terms and conditions of approval,. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, as follows: 1. The final plat must be filed with the County Recorder by October 20, 2008 or the final plat shall be considered void, unless a written request for time extension is submitted by the Applicant and approved prior to the deadline by the City Council. 2. Except as explicitly stated above, all terms and conditions of Resolution 2008-36 are hereby reaffirmed. Dated: September 16, 2008 T.M. CrosQy, ., Mayor ATTEST: Chad M. Adams, City Administrator -Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Smith Resolution No. 2008-64 September 16, 2008 and upon vote being taken thereon, the following voted in favor thereof: Johnson, Smith, Cavanaugh, Weir, Crosby and the following voted against same: None Whereupon said resolution was declared duly passed and adopted. Resolution No. 2008-64 2 September 16, 2008 EXHIBIT — A Parcel 1 The West 631 feet of the East 664 feet of that part of the West '/z of the Northeast '/4 of Section 4, Township 118 North, Range 23 West of the 5th Principal Meridian, which lies South of the North 1343 feet of the West '/z of the Northeast V4 and lies northerly of State Highway No. 55. Together with that portion of Willow Drive vacated in Resolution No. 03-20 filed as Document No. 8413169 accruing thereto by reason of said vacation, Hennepin County, Minnnesota. Parcel 2 That part of the West 'h of the Northeast 1/4 of Section 4, Township 118 North, Range 23 West of the 5th Principal Meridian, which lies South of the North 1343 feet of said West 1/2 of the Northeast ''/4, Northerly of State highway No. 55, and West of the East 664 feet of said West l of the Northeast 'A, Hennepin County, Minnesota.
