CITY OF MEDINA RESOLUTION NO. 2008-69 RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 451 BY TITLE AND SUMMARY WHEREAS, the city council of the city of Medina has adopted Ordinance No. 451 an ordinance amending Sections 825.07, 825.19, 826.98 and 828.09 regarding Definitions, Accessory Building Standards, Conditional Use Permit Standards and Performance Standards and Enforcement; and WHEREAS, Minnesota Statutes § 412.191, subdivision 4 allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinance is 7 pages in length; and WHEREAS, the city council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina that the city administrator -clerk shall cause the following summary of Ordinance No. 451 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The city council of the city of Medina has adopted Ordinance No. 451, an ordinance amending Sections 825.07, 825.19, 826.98 and 828.09 regarding Definitions, Accessory Building Standards, Conditional Use Permit Standards and Performance Standards and Enforcement. This ordinance amends the definitions section of Section 825 to create three new definitions, which are "Animal Units," "Hobby Farm" and "Grazable Acres." Changes were made to Section 825.19, the accessory building standards section, to reflect a height limitation of 30 feet for non-agricultural buildings and a height no greater than 35 feet for building projections and features. Allowances have been made in this ordinance for larger accessory buildings in relation to various sized lots. An allowance for an additional accessory building of less than 120 square feet has been made in this ordinance. Language was added to ensure that exterior materials for accessory buildings match or will be compatible with the principal buildings. An exemption for certain types of accessory structures was added. Changes were also made to Section 826.98, conditional use permit standards for agriculture preservation and residential districts by removing solar equipment; adding accessory building standards for residential properties greater than five acres in area; and standards for private windmills or wind energy conversion systems. Performance standards for solar equipment were made to Section 828.09. BE IT FURTHER RESOLVED by the city council of the city of Medina that the city administrator -clerk keep a copy of the ordinance in his office at city hall for public inspection and that he post a full copy of the ordinance in a public place within the city.
