A CHARTER ORDINANCE EXEMPTING THE CITY OF BEL AIRE,
KANSAS FROM THE PROVISIONS OF K.S.A. 1982, 12-4112, 12-
4305, 12-4410 and 12-4411 AND AMmDMENl'S THERETO, AND
PROVIDING FOR THE MANNER BY WHICH SUBSTITUTE AND
ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO
THE CODE OF PROCEDURE FOR THE MUNICIPAL COURT MAY BE
MADE.
BE IT 0RDAlNID BY 'mE GOVERNIRi OO)Y OF THE CITY OF BEL AIRE, KANSAS:
Section 1. The City of Bel Aire, Kansas, a City of the Third Class,
by the power vested in it by Article 12, Section 5 of the Constitution of
the State of Kansas hereby elects to exempt itself from and makes
inappliacable to it the provisions of K.S.A. 1982, 12-4112, 12-4305, 12-
4410 and 12-4411 and provide the manner by which substitute and additional
provisions may be made. Such referenced provisions are either enactments
or a part thereof which are applicable to this City, but are not applicable
uniformly to all Cities.
Section 2. The Governing Body of the City of Bel Aire, Kansas may by
regular Ordinance provide and establish substitute and additional
provisions on the same subject matter as embodied in K.S.A. 1982, 12-4112,
12-4305, 12-4410 and 12-4411 and amendments thereto, which statutes relate
to the Code of Procedure for the Municipal Court.
Section 3. This Charter Ordinance shall be published once each week
for two consecutive weeks in the official City Newspaper.
Section 4. This is a Charter Ordinance that will take effect sixty-
one (61) days after final publication unless a sufficient petition for
referendum is filed and referendum held on the Ordinance as provided in
Article 12, Section 5, Subdivision (c) (3) of the Constitution of the State
of Kansas, in which case the Ordinance shall become effective if approved
by a majority of the electors voting thereon.
ADOPTED AND APPROVED by the Governing Body of the City of Bel Aire,
