BOARD OF HEALTH MEETING
WEDNESDAY SEPTEMBER 19 , 2018 AT 700OPM
TOWN HALL, ROOM B
Board members present: Carmen Scherzo, DVM, Chairman; Annette Graczewski , MT (ASCP); Joe Ford and Nancy Leach,
PharmD
Board members absent: Penny Holeman, MPH , MA, MS
Others present: Nancy Ellis Ice, CHO, RS, MPH , Health Director and Tammi Mason, Senior Department Assistant
1 . Chairman 's announcements
The VNA in conjunction with the BOH will hold a Blood Pressure, Glucose and Cholesterol screening on September 25,
2018 from 10AW12PM at the Brewster Ladies Library. Residents can call 508 - 957 -7423 for information .
Last week the first Asian tiger mosquito was collected at a Harwich marina . These are very aggressive mosquitos and are
daytime biters and are associated with the Zika virus .
September 17th -21St is septic awareness week. Residents can go to www. eDa . ciov/seDtic/seDticsystemoutreachtoolkti for
information . There is a lot of septic information on the website.
A Design Charrette was held yesterday. Mrs . Ice has sent loads of information on the proposed Pond Nutrient Regulation ,
Dr. Scherzo encouraged new members to review previous Board of Health meetings regarding this proposed regulation .
2 . Discuss the revised Tobacco Regulations (which include flavored tobacco)
Bob Colette, Cape Cod Regional Tobacco Control Program and DJ Wilson , Massachusetts Municipal Association were
present.
Mr. Colette spoke about Cumberland Farms suing the Town of Yarmouth about the list that the inspectors use when doing
an inspection .
The Judge was mostly in favor of the BOH decision in regards to the list.
No decision was made yet.
Dr. Scherzo asked about the FDA banning flavored products within 60 days . Mr. Wilson stated he was not sure about
banning completely, but if the companies don 't produce proof that they are not selling to minors, they may do something .
Mrs . Graczewski asked if there were any other towns that did their own inspections . Mr. Colette stated that they do all
inspections except for the town of Dennis, which does not participate in the program . Bourne does their own as well as
the CCRTCP .

Dr. Scherzo stated that Ms . Holeman really wanted to be here for this discussion but could not make it to the meeting . He
is in favor of changes but thinks we should wait until the court decision and the FDA information comes to light.
Motion : Continue until the next BOH meeting so that Ms . Holeman can be present.

3 . Discuss the addition of " public parks" in the Regulation Prohibiting in Smoking in Workplaces and Public
places
Mrs . Graczewsi asked how this came to the BOH . Mrs . Ice stated that it was an email to Mary Chaffee ,
The Board agreed to add : town owned Parks, playgrounds, non -school playing fields and walking trails to the regulation .
Changes will be made and sent to Town Counsel for review.
4. Approve and sign the revised SWWTF regulations
Motion : Approve the changes .
Motion : Annette Grazcewski Second : Joe Ford Vote: 4- 0-0 Action : Motion passed
5 . Discuss and review the proposed Marijuana Regulations
Mr. Ford asked if we still needed this regulation . Mrs . Grazewski is in favor of putting this on the back burner for awhile
as she doesn 't believe we need it at this time.
Dr. Leach stated that the Board has time . It could be years before they get up and running and things may change .
Dr. Scherzo handed out a statement he believed should go into the regulation . He went on to read something from the
M . G . L. about the authority of the Board of Health .
Dr. Leach stated that in her opinion, state and federal inspections as well as the number of inspectors tend to be sparse
and inspections are not very frequent. She does believe we need a regulation at some point so that we have some
control .
Dr. Scherzo wants Town Counsel to be able to review what he wrote. Mrs . Grazewski suggested he could ask this question
to Town Counsel instead of adding it to regulation and having them review the whole thing .
Motion : Seeing how there may be delays with shops opening and the Board of Health already has authority to do
inspections, table this indefinitely until a certain time is determined .

6. Discuss the revised Well Regulation
Mrs . Ice brought this back to the Board to look at removing the " abutter notification " notification from the Town's
regulation . Dr. Scherzo stated that he had looked through the State' s revised regulation and there were other changes
made that the Board may want to look at.

Motion : Bring this back to the October work meeting and invite Tom Desmond to the meeting .

7 . Discuss the Special Account Regulation
Mrs . Ice told the Board that this regulation was last reviewed in 1991 . She suggested just keeping it as it is .
Motion : Note that we reviewed the regulation and no changes were made .
Motion : Annette Graczewski Second : Nancy Leach Vote: 4- 0 - 0 Action : Motion passed
8. Discuss the Financial Hardship Regulation
Mrs . Ice told the Board that this regulation was last reviewed in 1993 . She suggested just keeping it as it is .
Dr, Scherzo stated that since it was last done in 1993, the number index has changed and other information in the
regulation should be updated .
Motion : Add the updated number index

Motion : Continue this discussion until the correct references can be determined

9 . Discuss the Planning Board application for 9 Sara Ann Lane
Noted . No comments
10 . Topics the Chairman did not anticipate
Mrs . Ice asked about the next meeting on October 3 �d . The Board agreed to hold one meeting on October 17th
November meeting will be on the 7th and December meeting will be on the 5th
Informational items were noted .
