WEDNESDAY AUGUST 15, 2018 AT 7 :OOPM TOWN HALL, ROOM B Board members present : Carmen Scherzo, DVM, Chairman; Annette Graczewski, MT (ASCP), Vice Chairman; Joe Ford ; Penny Hausser Holeman, MPH , MA, MS and Nancy Leach, PharmD Others present: Nancy Ellis Ice, CHO, RS, MPH, Health Director; Tammi Mason, Senior Department Assistant and Mary Chaffee, Select Board Liason 1 . Chairman 's announcements Dr. Scherzo welcomed Nancy Leach, the newly appointed member until May 2019 , The Coastal Committee is sponsoring a community discussion on preserving public access to public beaches and landings on August 1616, 2018 from & 8PM at the Cape Cod Museum of Natural History. The Planning Board will hold a public listening session on the new Proposed Assessory Dwelling Units bylaw on August 22, 2018 at 6: 30PM at the Town Hall , The VNA in conjunction with the BOH will hold a child & adolescent immunization and lead screening clinic at their South Dennis office on August 20, 2018 from 9AM — 11 : 30AM . Call 50811, 9571,, 7423 for an appointment, The VNA in conjunction with the BOH will hold a Blood Pressure, Glucose and Cholesterol screening at the Brewster Ladies Library on August 28, 2018 from 1OAm - 12PM . Natures Alternative Inc . is holding their required Community reach meeting tonight. It will be an adult use recreational establishment August is national immunization month . The Center for Disease Control and Prevention will hold a different theme each week. 2 . Dan A. Speakman — Title 5 variance request for 80 Joe Long Road David Mason presented this to the Board . This is an existing 4 bedroom dwelling . They are proposing a replacement of a failed leach pit. The maximum cover will be 12' . A variance to allow the proposed SAS to be more than 3 feet below grade is being requested . A vent is going to be installed . Mrs . Ice stated that this system has already been installed . The need for a variance was discovered at time of inspection . The components are H2O . Mr. Ford asked what the groundwater elevation was . Mr. Mason stated that no water was encountered . Mrs . Graczewski asked if the vent was over the d - box. Mr. Mason stated that the vent was added off of the d - box at the time of installation . WWW.BREWSTER-MA . Motion : Annette Graczewski Second : Joe Ford Vote: 5 -0- 0 Action : Motion approved 3 . J . M . O' Reilly & Associates — Local and Title 5 variance request for 876 Satucket Road John O' Reilly presented this to the Board . The property is on lower mill pond and is 2 .7 acres . It is a large single family home in the west corner and there is a 1 bedroom home on the other side . The proposed SAS system is 120' from the pond . The proposed SAS reserve area will be 122' from the pond . Groundwater is flowing away from the pond in a NNW direction . There is no expansion of flow. Mrs . Graczewski asked if Mr. O ' Reilly gr the cost for moving it to the NNW corner of the property. Mr. O' Reilly stated that it would be around $ 3500 and would cause a large disturbance to the site . There is a well that services both structures and there is a well on the neighbor' s property. Mrs . Graczewski asked where the neighbor' s septic system was . Mr. O' Reilly stated that is was due east of the property. Motion : Finding there is no change in the flow, the groundwater is flowing away from the pond and in consideration of the location of the wells, approve the 178 and 180' variance requests . Motion : Joe Ford Second : Annette Graczewski Vote: 5 - 0 -0 Action : Motion carried 4. J . M . O ' Reilly & Associates — Local and Title 5 variance requests for 30 Tanglewood Road John O ' Reilly presented this to the Board . The home is being sold . The SAS is 278' from the pond and the reserve area is 276' from the pond . The septic tank is 6 . 3 feet down in the ground . The system is under driveway. It will be vented and components will be H2O . Mr. O' Reilly stated that this is the only location that makes sense for the system . Dr. Scherzo asked if the system could be put in the reserve area instead Mr. O' Reilly stated that it could be flip flopped, but it would still need variances . Dr. Scherzo asked if title 5 allowed the tank to go below 6 feet. Mr. O' Reilly believes that DEP allows it under local jurisdiction . JO -will make sure the tank will be put in under the local jurisdiction guidelines . Motion : Finding that there is no other feasible place on the lot to put the system, there is 31 feet to groundwater and the system will be vented and have H2O components, approve the variance requests of 22 ' for the proposed SAS and 24' for the proposed reserve area . This motion is pending the submission of revised plans swapping the system into the reserve area . Bennett Environmental — 298 Robbins Hill Road — request for an extension to variances (existing) David Bennett and Attorney Ben Zehnder presented this to board . These variances previously granted on July 16, 2016 and August 2, 2017 . The work was not started and they are now asking for another 1 year extension . The project has finally started . The reason for the extension request is because the system has to be complete in the year time frame and the septic is going to be the last thing done . The system is going to be an Advantex system . Mrs . Graczewski asked if the technology that is going to be used is still the best after 3 years . Mr. Bennett stated that it was . The floor plan has not changed . Dr. Scherzo stated that he did drive by the site and would be ok with giving an extension this time . Motion : Grant a 1 year extension until August 13 , 2019 . Motion : Joe Ford Second : Annette Graczewski Vote: 5 -0 - 0 Action : Motion carried 6 . Discuss the Septic System Betterment regulation Dr. Scherzo stated that Mrs . Ice had checked with the Town to see if there was money still out there and there is . Mrs . Ice spoke with Mark Forrest., Interim Town Administrator and he thought we should keep it on the books just in case there is a need . The Board had previously voted to rescind this regulation . Motion : Reverse the prior decision to rescind the regulation Motion : Annette Graczewski Second : Joe Ford Vote: 5 - 0 - 0 Action : Motion carried 7 . Review the changes to the Inspection/Maintenance Program regulation There were some additional changes made by the Board . Motion : Make the corrections and have a public hearing . Review the changes to the Substandard Septic System upgrade regulation There were some additional change made by the Board . Discuss restricting flavored tobacco in Brewster Bob Colette and DJ Wilson were present. The State law changing the entire state to 21 (to purchase tobacco) goes into effect at the end of this year. The age will go up progressively. Dr. Scherzo spoke about the fines . Change from 24 months to 36 months . Brewster' s fines are ok as is otherwise. Mr. Ford spoke about his experience with this issue . Does agree with this restriction . Ms . Holeman asked about the definition of "flavored " tobacco . There was discussion on the types of flavors and the list that the state has of all the different flavored tobacco ingredients . Mr. Colette stated that they will be doing an educational phase on this . 10 . Review changes to the Wastewater Treatment Facilities regulation There were a few minor additional changes . Motion : Make the changes and have a public hearing . Motion : Joe Ford Second : Annette Graczewski Vote: 5 - O- O Action : Motion carried 11 . Review " Host Community Agreements" Mrs . Ice told the new member that Dr. Mary Chaffee was involved with drafting these agreements . Mrs . Graczewski stated that she was bothered by the fact that Mrs. Ice was not included in those meetings, and by the fact that the Health Department was left out of the inspection part of the agreement. Dr. Chaffee stated that she felt comfortable relaying any information within the conversation because she had just been on the board . She did advocate that the language was included . Language is broad enough that the Health Department could do inspections . Dr. Scherzo spoke about community host public meetings and other issues he had with the agreements . Dr. Chaffee stated that she is confident that these agreements meet what is needed for this town . 12 . Topics the Chair did not anticipate None Informational items were noted .
