Bathroom AdditionMember Cavanaugh introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2008-74 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT, TO THREE RIVERS PARK DISTRICT FOR A 560 SQUARE FOOT BATHROOM ADDITION AT THE NO.2 BATHROOM AT BAKER PARK CAMPGROUND LOCATED AT 2309 COUNTY ROAD 19 WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Three Rivers Park District (the "Applicant") successor in interest to Suburban Hennepin Regional Park District located at 2309 County Road 19 in Hennepin County, Minnesota (the "Property"), legally described in Exhibit A, attached hereto; and WHEREAS, the Applicant has requested approval from the City to construct a 560 square foot addition for the No. 2 bathroom facility at the Baker Park Campground; located at the Property, and WHEREAS, the City's zoning ordinance requires a conditional use permit amendment under such circumstances; and WHEREAS, the Planning Commission recommended approval of an amended conditional use permit on October 14, 2008 terms and conditions; and WHEREAS, the City Council reviewed the application for conformance with city ordinances on October 21, 2008, considered the recommendations of the Planning Commission and heard comments from the applicant and other interested parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that it should and hereby does approve the request by Three Rivers Park District for an amended conditional use permit of the Property, subject to the following terms and conditions: 1) The Applicant shall provide adequate accessibility requirements, completed foundation/construction plans, and receive approval from the Minnesota Department of Health prior to the issuance of a building permit. 2) The storm water pond project shall be installed by June 2009, subject to engineering review and approval. 3) Existing Baker Park Campground structures may be expanded by up to 5% of their existing footprint size, as of November 5, 2008, without approval of a CUP Amendment. Resolution 2008-74 November 5, 2008 4) The Applicant shall work with city staff in reducing or eliminating any stormwater runoff into the ground drain located near the outdoor water fountain/jug-filler area. 5) The Applicant shall pay to the City a fee in the amount sufficient to pay for all costs associated with the review of the application to amend the Conditional Use Permit.
