HomeMy Public PortalAboutCharter Ord 09 Exempting Qualifications of Appointed Officers (Published in the ~ LI~, !J~ on the ~ day of tL~ ,1998 and on the J1id, day of ' a~ .1998.) / THE CITY OF BEL AIRE, KANSAS CHARTER ORDINANCE NO.9 A CHARTER ORDINANCE EXEMPTING THE CITY OF BEL AIRE, KANSAS FROM CERTAIN TERMS AND PROVISIONS OF K.S.A. 14-205, AND PROVIDING SUBSTITUTE PROVISIONS RELATING TO THE QUALIFICATIONS OF APPOINTED OFFICERS OF THE CITY. WHEREAS, the City of Bel Aire, Kansas has been designated as a city of the second class; and WHEREAS, the City of Bel Aire, Kansas deems it advisable to exempt itself from the provisions of K.S.A. 14-205 requiring certain appointed officers to be qualified electors of the City of Bel Aire, Kansas; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. Exemption The City of Bel Aire, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to make inapplicable to it and exempts itself from the provision of K.S.A. 14-205 requiring certain appointed officers to be qualified electors of the City of Bel Aire, Kansas. In exempting itself, the City of Bel Aire, Kansas finds that such provision is applicable to cities of the second class, but not uniformly applicable to all cities. Therefore, the City of Bel Aire, Kansas hereby adopts substitute and additional provisions on the same subject as hereinafter provided. Section 2. Appointive Officer Qualifications The City of Bel Aire, Kansas may appoint nonresidents of the City of Bel Aire, Kansas as appointed officers of the city pursuant to the provisions contained in K.S.A. 14-201 and K.S.A. 14-205. However, all other provisions contained in K.S.A. 14-201 and K.S.A. 14-205 concerning appointed officers which are not otherwise modified shall remain in effect. Section 3. Effective Date This Charter Ordinance shall be published once each week for two consecutive weeks in the official city newspaper and shall take effect 61 days after final publication unless a sufficient petition for a referendum is filed, requiring a referendum to be held on this Charter Ordinance as provided in Article 12, Section 5 Subsection (c) (3) of the Constitution of the State of Kansas. If a sufficient petition for a referendum is filed, this Charter Ordinance shall become effective upon approval by a majority of electors voting thereon.
