Minutes of the meeting of the Town Commission of the Toren of Gulf Stream,
Florida, held on Dec. 10, 1955.
Mayor Lindsay gave the oath of office to Mr. henry V. Pope.

The minutes of the Town Commission meeting held on November 12,1955 were
read and upon motion were unanimously adopted and approved.
Acting Torn Clerk, J. R. Fountain, reported bank balances as of Nov.30,
1955, as follows:
General Account $22,016.99
Water 7,043.87
Depreciation " 2,486.55
Payments from the general account for the month of November were on checks
numbered 2072 to 2102 inclusive. Payment from the water account was on check
number 48. There were no payments from the depreciation account.
All of the above payments were unanimously approved.
Mayor Lindsay stated the need for the Town to have a sufficiently large
dump truck for the removal of unsightly trash. The Mayor explained the growing
complaints in regard to the delays in picking up the trash.
The Mayor finally summed up the discussion in regard to the hauling of trash
by recommending and making the motion that after careful study of costs have been
made and if, in the judgment of the Mayor and Town Clerk the Town's best interest
will be served by the purchase of a new 8'x12' metal platform 2 ton dump truck with
twin four inch (4 ") hoist, and provided that the Town gets the full allowance of
$750.00 on the 1947 Chevrolet dump truck, which is too small, with the further
stipulation that the Town gets a further discount from list price, that the purchase
of the truck be made without delaying until the next Commissioners meeting. After
being seconded the motion as made was approved unanimously.
After a discussion of the advisability of the Town increasing the charge
per load for the removing of trash, Commissioner Pope requested J. R. Fountain to
prepare a cost analysis sheet showing the probable cost to the Tcwn for the removal
of trash to the City dump. Commissioner Pope recommended that J. R. Fountain
investigate the possibility of the Town dumping trash beyond the boundaries of
the North Polo Field. Mayor Lindsay appointed Commissioner Pope to assist the
Town Clerk, J. R. Fountain, in endeavoring to secure a suitable site for dumping.
This Commissioner Pope agreed to do.
Mr. Lindsay stated that Mfr. C. Y. Byrd who has acted as Town Attorney for
f A many years had asked to be relieved of his duties with the Town as he is reducing
his professional activities. Mr. Byrd recommended Mir. Harry A. Johnston and Mr.

Henry F. Lilienthal of West Palm Beach as his successors and after interviewing
them, Mr. Lindsay and Mr. Roig had concurred in this recommendation and has reached
an agreement with them, subject to the approval of the Commission, as outlined
in their letter of December 6th, 1955, which was submitted to the meeting, with the
additional item of checking and reviewing the minutes of meetings of the Commission
(inadvertently omitted from the letter) included in the retainer. Mr. Lindsay
explained that under the arrangement made, the services of both Mr. Johnston and
M. Lilienthal would be available. He also pointed out that, as stated in the
letter of December 6th, the arrangement was for no fixed period but was at the
"pleasure" of the Town.
On motion duly adopted, it was:
RESOLVED FURTHER, that Mr. Harry A. Johnston and Mr.
Henry F.Lilienthal of West Palm Beach, Florida, be
retained as Town Attorneys and that the arrangement
made with them by Mr. Lindsay and Mr. Roig, as stated
in their letter of Dec. 6, 1955, copy hereto attached
corrected as above set forth, be and the same is
approved.
The Town Clerk requested authorization to investigate the reports regarding
stagnant water in the drainage ditch to the East and South of Polo Field #2. The
Mayor suggested that J. R. Fountain contact Mr. Ramsey and proceed to take care of
the situation, using his own discretion.
7. R. Fountain called the Commissioners' attention to the fact that the
Town's resolutions regarding the signing of Town checks are not satisfactory with
the First National Bank. The Mayor requested that J. R. Fountain consult with the
Town Attorney and have ready for the next meeting satisfactory resolution.
There being no further business the Commissioners adjourned.

Dear Sirs:
Referring to yours of the 6th inst., we beg to
advise that at a meeting of the Town Commission of the Town of
Gulf Stream, held Decemier 10th, your retainer as Town Attor-
neys was ap *.roved as outlined in your letter with the additional
item (inadvertently omitted from your letter) of checking
and reviewing minutes of meetings of the Town Commission in-
cluded in the items covered by your retainer.
We understand that this slight correction has been
confirmed by telephone conversation between Ir. Jchnston and
Nr. Roig.
The form of the Commission's approval is as set
forth in the minutes of the meeting of December 10th, which we
believe you will find in order.
the next meeting of the Commission will be on Gaturday
January 14th, 1956 at 10:00 o'clock A. M., when we hope to have
a full attendance in order that I•Ir. Johnson and i:r. Lilienthal
may attend and meet the Commissioners. He hope this date will be
satisfactory to you.
