SUBJECT: HEARING ON APPLICATION FOR FORTUNE TELLER PERMIT
SUBMITTED BY C&C CRYSTAL ADVISORS
RECOMMENDATION:
The City Council is requested to hold a public hearing regarding the attached
application for a fortune teller permit, to take public testimony on the item , and after
having received all relevant evidence to deny the application for the reasons set forth in
full below.
BACKGROUND:
1. On July 6 , 2017 , C&C Crystal Advisors (the "Applicant") submitted a bus iness
license application to the City, noting that "fortune tell i ng -sales of crystals and
mise cards -notes -books" were the intended business activities (Attachment
"A "). Temple City Municipal Code (TCMC) Sections 4-8-10 et seq. require a fortune
teller permit for such a business , subject to approval by the City Council.
2 . In early August 2017 , staff received a complaint from a member of the public that
the business was operating without a license. The complainant prov ided a p icture
of a flyer in the window at the proposed business location advertising "Psychic
Readings by Chloe " with some details about services provided, and a phone
number to call to set up an appointment. The complainant also made staff aware
of an online review and online advertising for a psychic named "Chloe Kaslo "
performing services at the proposed lo cation and with the same phone number as
displayed on the sign at the location (Attachment "B").
3 . On August 16 , 2017 , City staff inspected the proposed business location and found
evidence that the busi ness was operating without a business license . The City
inspector was greeted by Christian Yanko and a woman identify ing herself as
"Chloe Castillo " who gave her age as 22 years old . Staff issued a verbal warning to
City Council

the Appl icant that the bus iness could not operate until the fortune teller permit and
business license were approved.
4. On August 16, 2017 , staff requested that the applicant provide the names of all
people who would be employed by the business . The Applicant initially indicated
that Chloe Castillo would be an employee of the business , but is currently a minor
and would not be doing any psychic readings until she is 18 years old ; she would
be selling crystals and doing other administrative work. City staff informed the
Appl icant that Chloe Castillo would need to apply for a work permit since she is a
m i nor and would need to undergo a Live Scan fingerprint process as an emp loyee
of the business . The Applicant replied that Chloe would not be part of the business
if her involvement would be an "issue." Correspondence between City staff and the
Appl icant regarding th is matter is attached as Attachment "C".
5. On September 6 , 2017 , the City rece ived a formal Community Preservation
complaint stating that a reading was done on August 31 , 2017 , and a "cleanse for
a curse " was performed . The complaining party believed the work was fraudulent ,
that the person performing the services was named "Chloe " and appeared to be i n
her 20s , and that the business would not refund money for the work . This is a
business license violation as the Applicant was operating without a business
license .
6 . On September 6 , 2017 , staff vis ited the business location in response to the
complaint. Staff observed a sign on the door saying "I'm 2 minutes away" with a
phone number, implying that the fortune teller was nearby and could arrive at the
location to provide fortune telling services within two minutes . The phone number
on the sign was the same number as in the on l ine ads provided by the complainant
in early August. Staff observed other evidence that the business was operating ,
w ith tarot cards and a crystal ball prominently displayed in the entry area and a
"Psychic" sign in the window (Attachment "0 "). Staff posted a Code Compliance
Notice on the door of the business for a code violation for operating a business
w ithout a license . This was the first of two potent ial non-monetary enforcement
actions against the business before the City could begin monetary sanctions under
the TCMC .
7 . On September 15 , 2017 , staff again visited the location and found evidence that
the business was operating , again including a door sign saying "I'm 2 minutes
away ."
8 . On September 25 , 2017 , staff received another complaint that "Chloe Kaslo " was
doing business at the location and was alternate ly advertising her name as "Chloe "
and as "Heather" (Attachment "B").
9 . On September 27 , 2017 , staff met with the Applicant , the Applicant's agent , and
the Applicant 's family member at their reques t. The Applicant's agent expressed
thei r concerns that the business license had not yet been approved . Staff
explained that City Counci l approval of a fortune teller permit is requ ired before any

fortune teller business may operate. Staff shared that the business appears to be
in violation of the TCMC due to numerous complaints regarding business activity
without a license and site visits from Community Preservation staff wh ich found
that the business appeared to be operating without a license . The Applicant
provided information to refute the complaints and staff observations ; however, the
information was not sufficient for staff to change the recommendation in this report.
10 . On October 5 , 2017 , as staff was preparing this report , staff observed an online
business listing on Yelp for "Psychic" at the proposed business location
(Attachment "E"). In addition to being listed at the same location , the business
listing has the same phone number from the sign on the door and online
advertisements . Business owner "Chloe K ." states in the listing that she has been a
psychic for "over one decade" since she was "11 years old ." The information in the
business listing indicates that Chloe does the readings and that she is at least 21
years old. Further, the business listing states that all readings are 50 percent off in
September, indicating that the business has continued to operate without a license ,
despite being issued a Code Compliance Notice on September 6.
11. On October 5, 2017 , the Applicant submitted a letter to the City Council providing
information about the proposed business (Attachment "F").
ANALYSIS:
TCMC Section 4-8-10-6 requires that the City Council make four findings before
approving a request for a fortune teller permit. The findings are as follows:
1. All the information contained in the application and supporting data is true;
2 . The applicant has not, within the previous six (6) months , been convicted of any
violation of this section or any law relating to fraud or moral turpitude ;
3 . The applicant appeared in person at the hearing ; and
4 . The applicant agrees to abide by and comply with all conditions of the permit and
this section .
Based on the information prov ided above , City staff recommends that findings 1, 2 , and ,
potentially 4 cannot be made for the reasons set forth fully below:
With respect to finding number 1, the conflicting information found by City staff when
researching the application (i.e ., the Applicant 's own advertising , verbal statements
given to the City , and the supporting information) leads to a conclusion that finding 1
cannot be made . It is believed that the information contained in the application and
supporting data is not true . Specifically:
• The application states that Christian Yonko will be providing all fortune telling
serv ices , but online and flyer advertising states that a "Chloe " will be providing
such services . In addition , the two complaints rece ived by the City about the

business both state that a "Chloe " provided the serv ices being comp lained of;
and
• Supporting information for the application indicates that Ch loe Cast i llo is a minor
who may assist with front desk/sales portions of the business or may not be
involved at all. Contrary to this is the presence of a Chloe Castillo at the
business location who gave her age to a City inspector as 22 years old and the
online Yelp business listing which indicates that her age is at least 21 years old .
The conflict among the Applicant's own advertising , verbal statements given to the C ity ,
and the application and supporting information leads to a conclusion that find ing 1
cannot be made . The third -party complaints provide additiona l reason to reach this
conclusion . It can be reasonably concluded from all of the facts in the record that Ch loe
will be performing fortune telling services and that it is the des ire of the App licant that
Chloe not undergo a background check .
In light of the foregoing , and of all of the record , City staff be lieves that finding 1 cannot
be made and is recommending denial for this reason .
With respect to finding number 2 , TCMC Section 4-8-10-4 requires that any person who
engages in fortune telling in the City have a background check performed . The Sheriff's
Department performed a Live Scan fingerprint and background investigat ion on
Christian Yonke , the stated owner of the business , as the only person named to be
performing fortune telling services . Based on the background i nvestigation , t he Sheriffs
Department concluded that it had no basis to protest approval of the appl ication .
However, given the confl icts among information found in the application , its supporting
documentation , the Applicant's own advertisi ng , and the th i rd-party reports , City staff
has concern that the Applicant appears to not want Chloe (whether he r last name is
Castillo or Kaslo ) to undergo the Live Scan fingerprint process or any other background
check . In light of this , City staff believes that finding 2 cannot be made and is
recommending denial for this reason.
With respect to finding number 4 , City staff notes that the Applicant has been
conducting business without a permit, has provided inconsistent information in the
application process , and appears to have been untruthful in that process . While the
Applicant may voice an agreement to comply with the conditions put on a pe rmit, his
own actions have shown that compliance is questionable at best. In light of th is , C ity
staff believes that finding 4 cannot be made and is recommending denial for th is reason .
The City is cognizant that fortune-telling businesses are specially regulated in Cal if ornia
for a number of reasons . First , fortune-telling businesses have a high potentia l for fraud
and so local jurisdictions wish to investigate thei r operators bef ore allowing them to
open up for business in the jurisdiction . Second , and somewhat contrary to the first ,
fortune telling raises First Amendment aspects of freedom of speech and freedom of
religion , so it is important to treat these businesses and pract it ioners carefully .

In this case , the Applicant has been inconsistent in the presentation of Chloe and her
involvement in the business . The Applicant has also been carrying on bus iness without
a fortune teller permit or business license . And the Applicant continues to make
contradictory statements in documents submitted to the City, such that it is not possible
for City staff to confidently conclude that the business is one that will be free of
fraudulent activity and thereby properly subject to First Amendment protections.
In light of this , City staff is recommending denial of the permit application .
This matter is subject to a public hearing but, under TCMC Section 4-8-10-5 , that
hearing has special notice provisions . City staff has provided the requisite notice for the
hearing .

Regulation of fortune tell ing business relates to the City Strateg ic Goal of Publ ic Health
and Safety.
FISCAL IMPACT:
This decision has no impact on the Fiscal Year 2017-18 City Budget.

PART V-Hlah·PIIed Combustible Storage:
In Chapter 23 of the County of Los Angeles Fire Code, high-piled combustible storage is defined as: Storage of
combustible materials [product and/or packaging] in closely packed piles (floor storage) or combustible materials on
pallets, in racks, or on shelves where the top of storage is great er than 12 feet i n height. High-piled combustible storage
also includes certain high hazard commodities, such as rubber tires , 'Group A ' plastics, flammable liquids, idle pallets , and
similar commodities, where the top of the storage is greater than six feet in height.
It is very important to contact a fire inspector prior to consideration of storing high-pil ed combustible storage. Many of the
permit requ irements must be bu ilt into your building . If your building is not approved for high-piled combustible storage, it
may be cost prohibitive. For example, if you have a pipe schedule sprinkler system no high-piled storage is permitted until
the system is calculated. A fire inspector can assist you with fire department requirements.

Commercial Kitchen Hood System -One Class K fire extinguisher shall be placed within 30 feet of all grease
cooking operations in a commercial kitchen . Protect ion of a multiple deep fat fryer appliance install ation shall be
as per Fire Code 904 .11 .5.2. Mount in an accessible and conspicuous location. Care shall be used to insure that
the K Class ext ingu isher and not the other type of extinguishers will be used in the event of a grease fire involving
cooking equ ipm ent. Multi-pu rpose fire extinguishers may comprom ise the effectiveness in wet chemical ki tc hen
hood ext inguishing systems.
Hazards involving the ignition of Class D combustible metals such as magnesium, t ita nium , zirconium , sod ium,
lithium , and potass ium shall be protected as per NFPA 10 standard for areas where combustible metal powders,
flakes, shavings , chips , or similarly s ized products are generated. Travel d istance to a fire extinguisher/fire
extinguishing agent shall not exceed 75 feet from any point from the hazard involved . Mount in an accessible and
conspicuous loc ation.

I have never h ad to jump tlu·u so many h urdles in any of the business I have ever assisted with, this seems to be
a bit excessive. We started this process and paid all the city fees on July 6, 20 17, had the Livescan results and
and here we are paying another months rent and w e still can no t open and it mid September now. ·
I had to even track the Livescan results myself due to the fact we were told the hold up was just the Department
of Justice, I called the DOJ myself and I was told on August 22 the res ults had already been received by the
requesting party.
Chloe is not an employee. She is Christian fiancee.
She will not be receiving a paycheck. H er only p urpose in the business i s to assist her husband to be.
If necessary we would like to have a one on one meeting with your supervisor to get this application
completed.

I wish to operate a Crystal Advisor and Personal Enlightenment Cent er at ~~U~ .E. Las
Tunas Ave. I have gone thru, and cleared a Department of Justice background check, have
had the County Fire Department sign the required docwnentation a s required b y the city
license department. I have obtained full liability insurance thru a local State Farm
Insurance office, acquired a state sales tax account, and in addition, I have at my own
personal expense, repainted the front of the building I am renting as to better blend with
.the surrounding, businesses.
In our m any m eetings with city staff we were not told I would n eed to have a City
Council m eeting to appro ve m y application, until I requested a meeting with staff
supervisor to see what the hold up was to our having a City Inspec tor come out to the
location to clear my unit in order to issue m y license so I could open for business. I had
started this process back in May, paid all my fees on July 6 of $1038.50, and I still had not
heard from an Inspector.
I was informe d it would be a good ide a to put toge ther a little information about the
business and any impact I may have on the community surrounding my office and if any
environmental impact I might have o n the community.
TI1ere will b e no environmental impact; I will have no hazardous items in my facility . I
have ample parking in the rear of m y location, as well as street parking i n front of the
building. As far as parking m y hours will b e a bit ~erent then m y neighbors the r eby
causing no parking problems. I do not expect any more then 3 to 5 clients in my facility at
a time.
My hours of operation will be Monday thru Thursday 12:00-7:00pm and Fridays and
Saturdays 2:00-lO:OOpm I will offer private r eadings as well as Bridal Shower, Engagement
Party, Birthday Parties, and Gals and Guys night out fun readings. All of my services are
for entertainment only.
My fees are simple they are from $15.00 to $50 .00 and parties will be based on how many
guest wish to have a reading. I o_ffer all types of readings and offer all types of crystals.
And did I mention the reading r oom and m e ditation center will be free for public use.
I believe that the area I .am in is zoned for Entertainment that is why I chose the location I
see all that this beautiful city is building and I want to b e part of this fast flourishing city.
