CALL TO ORDER The meeting of the Riverside County Transportation Commission (RCTC) Technical Advisory Committee (TAC) was called to order at 10:03 a.m. at the Riverside County Transportation Commission, 4080 Lemon Street, Riverside, CA. 2. APPROVAL OF MINUTES Minutes approved as submitted. Greg Butler abstained from voting as he was not in attendance at the May 14, 2012 meeting. 4. PUBLIC COMMENTS There were no public comments. 5. IDLE EARMARKS Shirley Medina, RCTC, stated that in August the Federal Highway Administration (FHWA) announced that it was rescinding all unobligated earmarks through 2006 appropriations if not obligated by December 31, 2012. RCTC worked with the local agencies that were on the list and exchanged the federal earmark funds with federal Surface Transportation Program (STP) funds for which there is no spending timeframe. A list of projects in FHWA's rescission and each project's funding status was provided. 6. MAP-21 OVERVIEW Ms. Medina announced that MAP-21 will be effective October 1. Many programs were consolidated and some were eliminated. FHWA and FTA are currently developing new guidance for the fund programs. She further stated that there are off -system bridges that are now eligible for regional STP funds. The MAP-21 language sounds like bridges will now be competing with regional arterial projects. However, Caltrans will continue to administer the bridge program and continuing the current commitments for these bridges. It's just a matter of obligating using different color money. The distribution of STP to Caltrans and the regions is still being worked out. The commitment is to try to maintain the funding levels we've had over the past couple of years. Safe routes to school can be programmed with Highway Safety Improvement Program (HSIP) STP funds. There most likely will not be any changes there. The Transportation Alternatives Program (TAP) is a new program and is essentially a restructured Transportation Enhancements (TE) program. TE projects are part of the STIP and the effort is to maintain the current level without having to reprogram projects programmed in the current STIP. Some categories under the old TE program are no longer eligible. Funding levels are reduced somewhat for Congestion Mitigation and Air Quality (CMAQ) and staff is working with the state to see how the funds will be distributed because the state has its own formula for non -attainment areas. MAP-21, State Implementing Legislation - Caltrans indicated that we do not need legislation to move forward with the distribution of funds, and implementing MAP-21 on October 1st Technical Advisory Committee Meeting September 17, 2012 Page 3 Anne Mayer, RCTC, indicated that with only two years to distribute funds, there is not a lot RCTC can do to adjust funding splits or percentages because it will undo projects that are currently programmed, which will cause a problem. Brian Kelly, the new agency secretary to the secretary of transportation, indicated that he wants to stop legislating individual issues. He thinks there is real opportunity to discuss roles and responsibilities. There are some things that are better administered at the state level and others at the local level. RCTC and most of its counterpart agencies agreed to not push for legislation and instead over the next several months talk about each of the programs. 7. FTIP/RTP UPDATE Grace Alvarez, RCTC, reported that the 2011 FTIP cycle will end in mid -December 2012 when the new 2013 cycle is approved. The 2011 FTIP has had 32 amendments since its approval in mid - December 2010. RCTC has participated in 26 amendments totaling 511 project changes. A11 of the amendments submitted to SCAG have been approved with the exception of the formal amendment No. 30 that is currently going to the public review comment period and the recently submitted administrative modification No. 32, submitted to SCAG on September 11. Approval of amendment No. 30 and administrative modification No. 32 is anticipated for the beginning of October. There is one more opportunity to make project changes to the 2011 FTIP. Administrative modification No. 33 is due to SCAG on October 2. In anticipation of the 2013 FTIP approval in mid -December, SCAG has prepared the 2013 FTIP amendment schedule for the first six months of the 2013 FTIP cycle. The first formal amendment is due to SCAG on October 22. RCTC will 'review the project changes processed in the 2011 FTIP, subsequent to the final 2013 FTIP submittal to SCAG, for incorporation into the 2013 FTIP. The project changes will be processed through the first formal amendment and/or subsequent administrative modifications. Ms. Alvarez stated that she will coordinate the project reviews with the respective agencies. 8. FEDERAL FISCAL YEAR 2012/13 OBLIGATIONAL AUTHORITY PLAN Ms. Alvarez said that each year states are allocated federal Surface Transportation Program (STP) and Congestion Mitigation Air quality (CMAQ) funds that are sub -allocated to regions and/or counties based on the specific funding distributions for each funding source. Caltrans requires each region to prepare an obligation plan that identifies each project that is scheduled for obligation in the current fiscal year. The obligation plan is important to track the progress of the project obligations, as it will allow RCTC to develop contingency plans such as loans between regions or project substitutions based on the target amount of federal funds that need to be obligated during the fiscal year. Likewise, the plan allows Caltrans to monitor the rate of obligations and develop contingency plans for use of any funds that may not be obligated at a statewide level. The expectation is for each region to obligate 100% of its STP and CMAQ allocations or Obligation Authority (OA). Technical Advisory Committee Meeting September 17, 2012 Page 4 Regions have until April 1 of each year to obligate their annual OA target after which the OA becomes available for use by other regions within the state. If the state as a whole does not use all of the OA, then the unobligated balance will return to the FHWA for redistribution to other states that have obligated 100% of the OA. This is referred to as the August Redistribution. RCTC understands that some projects cannot obligate earlier than the schedule allows because of issues with the environmental approval and/or right of way certification requirements; however, staff encourages agencies to obligate as early as possible. This increases the likelihood that there will be OA available for the project in the current fiscal year and may even bring more OA for Riverside County agencies than originally anticipated. As we transition from the 2012 FFY to the 2013 FFY, RCTC has prepared the draft 2013 Obligation Plan for the STP and CMAQ based on the project milestones reports submitted to RCTC in July through fund track. The draft Obligation Plan also includes the STIP projects scheduled for obligation in FY 13. Ms. Alvarez urged the TAC to keep RCTC posted on any schedule changes so she can update the obligation plan accordingly. 9. PROP 1B SLPP FORMULA PROGRAMMING STATUS Shirley Medina reported that at the March and July 2012 meetings, the Commission approved programming Proposition 1B (Prop 1B) State -Local Partnership Program Formula funds. The program is strict in that it is for construction funds and the funds need to be allocated when requested. Projects that CVAG nominated are provided on the staff report. There are still other projects that need to be programmed. All agencies are urged to submit the allocation requests to Caltrans/CTC by February 2013 to prevent funds from lapsing. 10. LOCAL ASSISTANCE UPDATE Sean Yeung, Caltrans Local Assistance, said that each quarter a review of federal projects that are inactive is performed as well as a review of the six month and three month look ahead. Mr. Yeung recommended that the local agencies submit an invoice or a justification form by the established deadline; FHWA is more stringent on justification requests and basically approves only time extension associated with environmental approvals, right -or -way issues, and/or litigation. Mr. Yeung reminded the TAC about the upcoming South Tehachapi meeting taking place on September 25 in Caltrans District 11 in San Diego. Mr. Yeung reported staffing changes at Local Assistance District 8, announcing that he was appointed the acting Local Assistance Engineer and that John Pagano currently is the Acting Deputy District Director Planning. Ms. Medina pointed out that Savat Khamphou had previously indicated that the local agencies should send their submittals to him and he would disburse them to appropriate staff She requested an update of the assignments to the cities. Mr. Yeung indicated that he will update the assignments. Technical Advisory Committee Meeting September 17, 2012 Page 5 In the meantime, submittals should be sent to the same address attention their respective Local Assistance Engineer. For issues related to Local Assistance, agencies need to contact John Pagano instead of Savat or Bill Mosby and cc Sean Yeung. 11. SEPTEMBER COMMISSION MEETING HIGHLIGHTS Anne Mayer announced that several Measure A CIPs were approved. There was an update on state and federal legislation. RCTC did not propose a position on SB 878 that would have created the office of inspector general with the authority to monitor and investigate all state, local, and regional MPOs who receive transportation dollars, but several Commissioners opposed it. A letter of opposition was sent to the Governor stating that the creation of another state agency is unnecessary. The new SunLine/RTA joint bus service commuter link running from the Coachella Valley through the Banning Pass was highlighted. If the service is successful, instead of adding stops there would be an addition of new routes. A contract was awarded for I-15 Central, Scott Road to Nuevo Road, which is funded by CMIA and STIP money. Ms. Mayer also stated that Jeff Morales, CEO of the High Speed Rail Authority, will make a presentation to the RCTC Commissioners at its October 10 meeting. 12. OTHER BUSINESS Bruce Harry, City of Rancho Mirage, announced that his city recently completed a central mix rubberized emulsion aggregate slurry project and if any agency has interest in learning more about the project, contact him. Chris Sunde expressed the City of San Jacinto's appreciation for the funding provided for the Ramona Expressway Widening between Sanderson Avenue and Eagle Drive. Dave Barakian said the City of Palm Springs has filled the position of Assistant City Engineer/Assistant Director of Public Works, Marcus Fuller's former position, with Savat Khamphou. 13. AGENDA ITEM 6 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: December 10, 2012 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: Status of Projects Selected for State -Local Partnership Program STAFF RECOMMENDATION: Receive and File. BACKGROUND INFORMATION: Earlier this year, nine projects were selected by the Commission for Proposition 1 B State - Local Partnership Program (SLPP) Formula funding, three in Western Riverside County totaling $46.673 million, and six projects in the Coachella Valley totaling $12.258M. The SLPP projects were selected based on the Commission's priority projects and programs, and the California Transportation Commission's (CTC) allocation deadline of June 30, 2013. All projects must have approved CEQA documents (or NEPA if federal funds or approvals are required), design, and right-of-way certification in order to request SLPP funding by the CTC's June 11, 2013 meeting. Therefore, all funding allocation requests for SLPP funds must be submitted to Ca!trans by April 11, 2013 in order to secure the allocation vote at the June CTC meeting. The attached table represents each project's progress to date. There are three actions that need to occur: 1. Programming - 2. Future Consideration of Funds - 3. Allocation of Funds - All projects have been programmed. 3 projects have completed this action, 2 projects had CE's and this action was not applicable 1 project has been allocated. The city of Indio's Monroe project received its allocation at the October 2012 CTC meeting. Corona's Foothill Parkway project and Murrieta's 1-15 Los Alamos project are scheduled for an allocation at the January 2013 CTC meeting. In March 2013, the Commission's SR-91 CIP, Indian Wells' Hwy 111 improvements, and La Quinta's Hwy 111 and Washington intersection improvement are scheduled for allocations. In May 2013, the remaining three projects, city,of Palm Desert's I-10/Monterey Interchange, Indio's Varner Road, and County of Riverside's Fred Waring are scheduled for allocations. Project sponsors must notify Commission staff immediately if there are any problems that may result in delays and the inability to submit its allocation request by April 11, 2013. If the project sponsor cannot request the allocation by April, the SLPP funds will expire. Commission staff will monitor the progress of these projects over the next couple of months. Sufficient time will be needed to reprogram the funds to another project if any of the projects are deemed undeliverable by the deadline. AGENDA ITEM 7 RIVERSIDE COUNTY TRANSPORTATION COMMISSION DATE: December 10, 2012 TO: Technical Advisory Committee FROM: Shirley Medina, Programming and Planning Manager SUBJECT: City of Beaumont Surface Transportation Program (STP) Funds STAFF RECOMMENDATION: This item requests that the TAC reviews and approves the city of Beaumont's STPL reprogramming request from its Historic San Timoteo Canyon Bike and Pedestrian Facilities to its SR60/Potrero Blvd. Interchange, Phase I. BACKGROUND INFORMATION: The city of Beaumont has requested the reprogramming of $1,416,300 of STPL (formerly Transportation Enhancement funds) from its San Timoteo Canyon Bike and Pedestrian Facilities project to its SR60/Potrero Blvd. Interchange project, Phase I. The San Timoteo Canyon Bike and Pedestrian Facilities is a project that competed for the 2005 Transportation Enhancement Call for projects. Subsequently RCTC at its meeting of November 9, 2011 approved staff recommendation to convert STIP-TE funded projects to federal STP to streamline delivery of these projects. The project has stalled at the right-of-way process due to right-of-way negotiations with the Union Pacific Railroad (UPRR); it is anticipated that the right-of-way negations with UPRR will take approximately two years. Additionally, the project cost has increased due to unanticipated utility relocations and installation of drainage facilities that exceed the approved budget for the project. The SR60/Potrero Boulevard is a new planned Interchange that will be built in two phases. Phase I will construct the new Potrero six -lane overcrossing (3 lanes in each direction) with temporary connection to Western Knolls. Phase II will construct new IC on/off ramps, WB/EB exit and entry ramps (2 lanes) and WB/EB loop entry ramps (2 lanes), along with EB/WB auxiliary lanes at exit ramps, realigning Western Knolls Avenue and removing Western Knolls Avenue connection to SR60. The total project cost is estimated at $78.5 M. The project is in the final stage of engineering and right-of-way certification with Caltrans and the federal STPL funds can be obligated for the construction funding in FFY 2012/2013. Staff recommends approval of this request as the SR60/Potrero Blvd IC Phase I is consistent with the Pass Area Prioritization Plan. Additionally, funds can be obligated in the near term. The primary reasons for approving the proposed funding adjustment are: (1) the subject funding would best used to build the most important new interchange facility in the Pass Area; and, (2) the proposed Bike Lane Project has major right-of-way (ROW) issues and construction related constraints which threaten to further postpone its installation indefinably (originally slated for construction in 2007). A more detailed justification discussion follows: Ilivhest & Best Use of Funds: These funds need to be used where they will be most able to help alleviate current and future traffic congestion along the I-10 corridor as shown in the Riverside County Congestion Manage Plan (Exhibit 4-1A as LOS "D" at I-10/SR60 Merge) and has received a fourth place ranking on the County's 2012 Pass Area Transportation System Ranking Plan. Furthermore, the City of Beaumont and Riverside County TLMA have been jointly working on the SR79 Bypass Corridor which features the SR60/Potrero Interchange facility. The proposed Interchange Project is slated for construction in the FY2012-13 and is in its final stages of engineering with Caltrans and the STPL money will be obligated in short order to create jobs and help stimulate the local economy. Bike Lane Proiect Right -of -Way & Construction Cost Constraints: If these funds remain programmed on the Bike Lane .Project, it is anticipated to take another two years of negotiation with the UPRR officials to secure the required ROW for the Project. In addition, new drainage concerns and projected utility relocation costs are expected exceed budgeted STPL funding. Lastly, the Bike Lane Project (and its associated County roadway surface rehabilitation work slated for San Timoteo Canyon Road) is unranked by 2012 Pass Area Transportation System Ranking Plan. BACKGROUND INFORMATION: In the past, the Commission has programmed federal STP funds for rehabilitation projects. Given the economy, staff recognizes the challenges local agencies face in funding rehabilitation projects. Although the federal transportation bill, Moving Ahead with Progress in the 21 st Century (MAP-21), has been in effect since October 1, 2012, there are still many issues regarding distribution of the federal funds included in MAP-21. However, staff feels that there is enough certainty to develop programming guidance for rehabilitation projects so that these projects can begin initial phases. Staff will discuss the next cycle for STP rehabilitation projects at the December 10, TAC meeting including timeline, parameters, and funding targets. BACKGROUND INFORMATION: As presented to you at the September 17 meeting, RCTC needs to prepare a federal obligation plan to submit to Caltrans Local Assistance on a yearly basis. The attached 2012/2013 Obligation Plan includes Riverside County's Congestion Mitigation Air Quality (CMAQ) and Surface Transportation Program Local (STPL) funded projects. The obligation plan is based on the July 2012 project milestone reports submitted to RCTC through FundTrack. The obligation plan provides critical information to RCTC on the need to develop contingency plans, such as loans between regions or project substitution, based on the target amount of federal funds that needs to be obligated during the fiscal year. Likewise, the plan allows Caltrans to monitor the rate of obligations and develop contingency plans for use of any funds that may not be obligated at a statewide level. Regions have until April 1st, of each year to obligate their annual Obligation Authority (OA) target, after which the OA becomes available for use by other regions within the state. If the state as a whole does not use all of the OA, then the unobligated balance will return to the Federal Highway Administration (FHWA) for redistribution to other states that have obligated 100% of the OA. This is referred to as "August Redistribution." This opportunity allows states to obligate more federal funding than initially anticipated. California received approximately $200 M in FY 11/12 through the August redistribution. Agencies that submit their request for authorization by April 1st, have better chances of securing the necessary funding for their projects than agencies that submit their request for authorization after April 1st. Also, agencies that obligate their federal funding early help our region secure additional OA for Riverside County through the "August Redistribution." RCTC understands that some projects simply can not obligate earlier than the schedule allows due to environmental or right of way certification issues, however, RCTC staff encourages agencies to obligate as early as possible in the federal fiscal year. Therefore, RCTC requests your active participation in keeping the 2012/2013 Obligation Plan updated before and after submission to Ca!trans. We also encourage you to keep funding obligation on track.
