Depending on the number of items on the Agenda and the number of speakers, the Chair may, at his/her discretion, reduce the time of each speaker to two (2) continuous minutes. Also, the Committee may terminate public comments if such comments become repetitious. In addition, the maximum time for public comment for any individual item or topic is thirty (30) minutes. APPROVE MEMORANDUM OF UNDERSTANDING FOR COOPERATIVE PLANNING AND DEVELOPMENT OF THE SANTA ANA RIVER TRAIL PROJECT BETWEEN THE COMMISSION AND THE RIVERSIDE COUNTY REGIONAL PARK AND OPEN-SPACE DISTRICT Pagel Overview This item is for the Committee to: 1) Approve Memorandum of Understanding (MOU) No. 15-67-059-00 with the Riverside County Regional Park and Open-Space District (District) for project management services to complete the design phase and manage the construction phase of the Santa Ana River Trail Project (Project). The MOU will reimburse the Commission's cost to perform project management services for managing the completion of design, construction management, and construction contracts for the Project; 2) Authorize the Chair or Executive Director, pursuant to legal counsel review, to execute the agreement on behalf of the Commission; 3) Authorize the Executive Director, pursuant to legal counsel review, to execute agreements with the District to reflect non-funding changes related to the Project on behalf of the Commission; 4) Approve an increase of $250,000 in FY 2014/15 budgeted revenues and expenditures for project management services related to the Project; and 5) Forward to the Commission for final action. 8. OPERATION OF THE FREEWAY SERVICE PATROL PROGRAM IN RIVERSIDE COUNTY Page 13 Overview This item is for the Committee to: 1) Approve Agreement No. 15-45-027-00 with the California Department of Transportation (Caltrans) for the operation of the Riverside County Freeway Service Patrol (FSP) program in the amount of $1,635,846 in state funding for FY 2014/15; and 2) Forward to the Commission for final action. Formerly known as the Compass Blueprint Awards, last year the name was changed to the SCAG Sustainabil it y awards to better reflect the goals and benefits of the Regional Transportation Plan/Sustainable Communitie s Strategy [RTP/SCS]. SCAG remains committed to acknowledging and honoring the great planning and development work occurring throughout the region . Th ese outstanding planning projects were a major emphasis in the 2012 -2035 RTP /SCS and will be emphasized in the upcoming 2016 RTP /SCS. SCAG is accepting nominations for projects that coordinate land use and transportation actions to improve the mobility, livability, prosperity, and sustainability of our region. More information about th e types of projects that SCAG is looking for can be found below. The SCAG Sustainability Awards Program is ope n to all parties, including local governments, non-profits, developers, and others. Partnerships are welcome; pu b lic agencies , in combination with other public or private organizations or individuals may jointly submit an entry. Eligible submittals include plans , projects, and progra m s completed or adopted after January 1, 2012 and prior to March 1, 2015 . Award winners may have the opportunity t o present projects at the 2015 Annual Regional Conferen ce & General Assembly. The deadline for nomination submittals is Tuesday, March 3, 2015 at 5:00 P.M. EVALUATION CRITERIA There are three categories to the Awards Program: Integrated Planning , Green Region Initiative, and Active Transportation, which also make up the three branche s of SCAG's Sustainability Program . SCAG is requesting applicants choose a category to submit their nominatio n under. Submissions will be evaluated and selected bas ed on standards relevant to each category as well as the ir AB ILIT Y overall strength in implementing the goals and benefits of t he 2012-2035 RTP/SCS. The specific criteria for each cat egory are outlined below: AW ARD CATEGORIES AND CRITERIA In tegrated Planning • Integrates land use and transportation planning . • Promotes infill, Transit Oriented Development, and other forms of sustainable development. • Promotes a sustainable land use mix, including new housing. • Locates new housing near ex isting jobs and /or new jobs near existing housing . Green Region Initiative •Addresses climate change through GHG emission reduction of adaptation planning. • Preserves rural, agricultural , recreational, and environmentally sensitive areas . • Promotes energy and/or water efficiency and savings. • Ensures environmental justice regardless of race, ethnicity, or income class. • Promotes overall sustainability on various resource issues . Ac t ive Transportation • Promotes active [bicycle and pedestrian) transportation planning . • Promotes physical activity, safety, education, and outreach . • Promotes linkages within existing active transportation and transit networks. • Promotes shift from cars to active transportation . 2014 EXCEL LENCE IN ACTIVE TRANSPORTATION AWARD City of Santa Monica I Bike Santa Monica/Santa Monica Bik e Action Plan Bike Santa Monica is a comprehensive effort of the City of Santa Monica to encourage more bicycling in th e City by every possible means. The Santa Monica Bike Action Plan includes programs-education, outreach, rides. classes. events, partnership, contests; facilities- bike lanes, trails, neighbo rh ood greenways, key connections. bike boxes, signal detection. "sharrows;" and su pporting faci li ties-Santa Monica Bike Center, Santa Monica Bike Campus, bike racks, bike rooms. and bike valet. By in cluding opt io ns that cre ate m ore compact neigh borh oods a nd plac i ng eve ryd ay destinations closer t o hom es and closer to one another, t he 2012-2 035 RT P/SCS strateg ies can reduce the cost of development for ta x payers and reduce the everyday costs of housing and tran s portation . 3 . Benefits to Public He a lth & the Environment Publ ic hea lth a nd e nviro nmenta l p rotec ti on have long bee n li nked t o th e way o ur region is p la nn ed and the way pu b lic services are de li ve red . Many st rategies in the 2012- 2035 RTP /SCS will provide wid espread benefits for pub lic hea lth and enviro nmen t a l protect ion . Better place m aking wi ll a ll ow peop le to wa l k a nd bicyc le m ore reg u lar ly in their daily lives , and promotes the development of u r ban parks, thus providing more opportunities for rec reation and exe rc ise . Reducing the footprint of new development protects farmland that provides food for the region , ma intai ns w ildlife habitat, decreases air pollution , and improves opportunities fo r green stormwater solutions th at w il l improve water q ua lity. 4. Greater Responsiveness to Demographics & Changing Hou si n g Market The demographic profile of the reg ion is chang ing and the market for h ousi ng is c hanging with it. The number of parents whose ch ildren ha v e grown and left home is significantly increasing , an d m any are loo king for smaller housing and a more man age able , walkable lifestyle. In addition , re si dents will be lo oking for a "value lifestyle" in which both ho u sin g and t ra nsportati on costs are minimized even as they mainta in a high -quality of life . Strategies focu sed on high -qual ity places, compact infi ll develop m ent, a nd more ho us ing an d tran sportation choices provide a response to t hese newly emerging market forces . 5. Improved Access & Mobility Southern California congestio n is ever present and additional road construction cannot solve all of the reg ion 's mobil ity c ha ll enges. Th e tra nspo rtation strategies contain ed within th e 2012-2035 RTP/SCS w ill fo c us on "the most bang for the buck" solutions by improving c ri t ica l road co n nections i n th e reg io n a n d increasi ng pu blic transit capacity. Application Procedure 1. Review the Eligibility and Evaluation Process and Criteria . 2 . Select a category that best fits the submitted proj ect. 3. There are four parts to the Sustainability Awards application : a. Submittal Form : PDF copies of the form are available online at www.sustain .scag .ca.gov. b. Evaluation Criteria Response: Responses sho u ld be 2,000 words or less. Keep in mind that th e application will be reviewed by a panel of judges, and judges will favor entries that are persua sive and concise . PDF copies of the form can be completed electronically ; you must have Ad o be Acrobat 9 Standard to save changes to the f o rm . c . Images: Include up to ten graphics to represe nt and demonstrate the quality of the project, program, or action . Images should be subm itted in PowerPoint, as well as one of the follow in g formats : TIFF, JPG , or PDF. Photographs that showcase the community surroundings and community i nvolvement are encouraged . d. Letters of Support: Applicants are encouraged to include letters of support from organizations an d individuals involved in the project indicating why the project is worthy of an award. 4. Eligibility The program is open to all projects, programs, and actions t ake n within the SCAG region . Nominations are welcome f ro m cities, counties and sub reg ions, in combination with i nd iv idual developers, consultants, builders, and others who strive to implement the goals and benefits of the 2012-2035 RTP/SCS . Eligible submittals must have been completed or ad o pted after January 1, 2012, and prior to April 1, 2015 . Sub mittals must clearly describe and demonstrate how the proj ect, program, or action addresses the goals and benefits of t he 2012-2035 RTP/SCS and other evaluation criteria. El ig i ble submittals should also demonstrate significant con t ributions to the community and excellence in planning a nd design . C. Evaluatio n Process and Criteria Proj ects will be evaluated by a review panel consisting of experts in the fields of planning and development. In an in itial review, each entry will be scored based on the goals an d benefits of the 2012-2035 RTP/SCS. Projects that sco re a minimum point total will qual ify for a second review co n sistin g of a group evaluation by the full panel of judges, w ho will ultimately determine the winning entries for each category. D. Awards Wi nners will be recognized at SCAG's annual Regional Co u ncil & General Assembly in Palm Desert on May 7 and 8. BACKGROUND INFORMATION: The District is expanding trails across Riverside County to promote healthy lifestyles and provide alternative forms of active transportation and commuting. The Santa Ana River Trail is a major component of this effort, ultimately providing 100 miles of free and easily accessible hiking, riding, and biking opportunities. The trail is being built in segments in a joint effort with a number of public and private agencies including the counties of Orange and San Bernardino and 16 cities in the watershed. On August 20, 2008, the District entered into a MOU for cooperative planning and development of the Santa Ana River Trail with the cities of Norco and Corona. Since then, the parties to the MOU have been able to facilitate the design, environmental compliances, and construction Agenda Item 7 1 documentation for large portions of the Project. In an effort to accelerate the construction and development of the Project, the District believes that on the ground implementation will be well served by an agency with greater staff resources and a higher level of expertise in dealing with many of the permitting and approving agencies during the construction process and desires to enter into a MOU with the Commission to manage the completion of this work. The District will remain as the lead agency for environmental (National Environmental Policy Act and California Environmental Quality Act) compliance, and the Commission will be the responsible agency for project approval, final design, and construction phases. This means that the Commission would procure and enter into contracts with a construction management firm and a construction contractor and administer construction of the Project. DISCUSSION: The District believes the Project will be well served by having the Commission manage the completion of preliminary design and construction. The District is bringing the MOU to the County Board of Supervisors meeting for consideration of approval on March 10, 2015. The District has an agreement with the California State Coastal Conservancy to provide funds for trail planning, design, and construction through Proposition 84. These funds are the primary source of funding for the Project and for this agreement. Once the MOU is executed, the District will provide a $250,000 advance deposit to the Commission to cover project management costs and progress payments to Project contractors. This deposit should provide sufficient funding for FY 2014/15 expenditures; however, staff recommends approval of a budget amendment to increase FY 2014/15 revenues and expenditures each in the amount of $250,000. Staff is working with District staff to develop estimated expenditures and related reimbursements for subsequent fiscal years. Staff reviewed the MOU and recommends the Committee approve this request and forward it to the Commission for final action. Termination. Either party may terminate its participation in this MOU by providing thirty (30) days prior written notice to the other Party. The MOU may be terminated if the governing bodies of both Parties agree to do so in writing. In that event, the MOU will be terminated thirty (30) days following the written notice of termination. In the event of MOU termination, or the receipt of a written notice by RCTC to terminate its participation in this MOU, the District will assume all responsibilities vested in RCTC. RCTC will promptly assign its interest in all contracts related to the completion of the Trail project to the District, which will assume all of RCTC's obligations thereunder. RCTC shall not incur any additional costs after such time a notice of termination has j;},~~n sent by the District. RCTC shall not incur any additional costs after such time a notice of termination has been sent by the District. XVIII. Funding. Notwithstanding anything to the contrary, in the event the District experiences 6 8 Agreement No. 15-67-059-00 reductions in Proposition 84 or Development Impact Fee funding in relation to the Trail project, the District's allocation to RCTC for this Trail project shall decrease in proportion to the decrease the District receives in such funding. If such a decrease is issued, the Parties will be required to reevaluate the Trail project and recommend a scope reduction to accommodate the funding available, provided that the District shall be obligated to reimburse RCTC for all costs incurred pursuant to the terms of this MOU prior to notification by the District of any reductions in funding. XIX. No Maintenance Obligations. Nothing in this MOU shall make RCTC responsible for any future maintenance of the Trail in Riverside County, if and when constructed. Any such maintenance obligations shall remain with the District. BACKGROUND INFORMATION: In 1986, the Commission established itself as the Riverside County Service Authority for Freeway Emergencies (RC SAFE) after the enactment of SB 1199 in 1985. The purpose of the formation of SAFEs in California was to provide call box services and, with excess funds, provide additional motorist aid services. Funding for RC SAFE is derived from a one dollar per vehicle registration fee on vehicles registered in Riverside County. Initially, these funds were used only for the call box program. As additional motorist aid services were developed, SAFE funds were also used to provide FSP and the Inland Empire 511 traveler information services as part of a comprehensive motorist aid system in Riverside County. In 1990, Proposition C was passed to fund transportation improvements and to help reduce traffic congestion in California. From this, the FSP program was created by Caltrans, which developed the corresponding Local Funding Allocation Plan to distribute funds to participating jurisdictions through a formula based on population, urban freeway lane miles, and levels of congestion. The Commission, acting in its capacity as the RC SAFE, is the principal agency in Riverside County, in partnership with Caltrans and the California Highway Patrol, managing the FSP program. The purpose of the FSP program is to provide a continuously roving tow services patrol along designated freeway segments (referred to as beats) to relieve freeway congestion and facilitate the rapid removal of disabled vehicles and those involved in minor accidents on local freeways. Currently, the Commission contracts with four tow truck operators to provide service on a total of nine beats Monday through Friday during the peak commute hours, Agenda Item 8 13 I 5:30 a.m. to 8:30 a.m. and 2:30 p.m. (12:30 p.m. on Fridays) to 6:30 p.m. In FY 2013/14, FSP performed over 44,000 assists. DISCUSSION: In October 2014, the Commission received the attached funding agreement from Caltrans for FY 2014/15. Caltrans funding agreements are reimbursement-based and allow for the carryover of contract balances not expended in the agreement's stated fiscal year. This allows the Commission to fully expend allocated amounts and also helps to accommodate the timing of the Caltrans allocation release, which is typically later during the fiscal year for which it is intended. C) Any Fund expenditures for costs for which ADMINISTERING AGENCY has received payment or credit that are determined by subsequent audit to be unallowable under 2 CFR, Part 225, 48 CFR, Chapter 1, Part 31 or 49 CFR, Part 18, are subject to repayment by ADMINISTERING AGENCY to STATE. Should ADMINISTERING AGENCY fail to reimburse Fund moneys due STATE within 30 days of demand, or within such other period as may be agreed in writing between the Parties hereto, STATE is authorized to intercept and withhold future payments due ADMINISTERING AGENCY from STATE or any third-party source, including, but n6t limited to, the State Treasurer, the State Controller, and the California Transportation Commission. 10. THIRD PARTY CONTRACTING A) ADMINISTERING AGENCY shall not award a construction contract over $10,000 or other contracts over $25,000 [excluding professional service contracts of the type which are required to be procured in accordance with Government Code Sections 4525 (d), (e), and {f)] on the basis of a noncompetitive negotiation for work to be performed using Funds without the prior written approval of STATE. B) Any subcontract or agreement entered into by ADMINISTERING AGENCY as a result of disbursing Funds received pursuant to this Agreement shall contain all of the fiscal provisions {Section II, Paragraphs 9, 11, 12, & 13) of this Agreement; and shall mandate that travel and per diem reimbursements and third-party contract reimbursements to subcontractors will be allowable as project costs only after those costs are incurred and paid for by the subcontractors. C) In addition to the above, the preaward requirements of third party contractor/consultants with ADMINISTERING AGENCY should be consistent with Local Program Procedures as published by STATE. 11. ACCOUNTING SYSTEM ADMINISTERING AGENCY, its contractors and subcontractors shall establish and maintain an accounting system and records that properly accumulate and segregate Fund expenditures by line item for the PROJECT. The accounting system of ADMINISTERING AGENCY, its contractors, and all subcontractors shall conform to Generally Accepted Accounting Principles (GMP), enable the determination of incurred costs at interim points of completion, and provide support for reimbursement payment vouchers or invoices. RIGHT TO AUDIT For the purpose of determining compliance with this Agreement and other matters connected with the performance of ADMINISTERING AGENCY's contracts with third parties, ADMINISTERING AGENCY, ADMINISTERING AGENCY's contractors, and subcontractors, and STATE shall each maintain and make available for inspection all books, documents, papers, accounting records, and other evidence pertaining to the performance of such contracts, including, but not limited to, the costs of administering those various contracts. All of the above referenced parties shall make such materials available at their respective offices at all reasonable times for three years from the date of final payment of Funds to ADMINISTERING AGENCY. STATE, the California State Auditor, or any duly authorized representative of STATE or the United States Department of Transportation shall each have access to any books, records, and documents that are pertinent for audits, examinations, excerpts, and transactions, and ADMINISTERING AGENCY shall furnish copies thereof if requested. 13. TRAVEL AND SUBSISTENCE Payments to ADMINISTERING AGENCY for travel and subsistence expenses of ADMINISTERING AGENCY forces and its subcontractors claimed for reimbursement or applied as local match credit shall not exceed rates authorized to be paid exempt non-represented State employees under current State Department of Personnel Administration (DPA) rules. If the rates invoiced are in excess of those authorized DPA rates, then ADMINISTERING AGENCY is responsible for the cost difference and any overpayments shall be reimbursed to ST ATE on demand. 14. SINGLE AUDIT ADMINISTERING AGENCY agrees to include all state (Funds) and federal funded projects Jn the schedule of projects to be examined in ADMINISTERING AGENCY's annual audit and in the schedule of projects to be examined under its single audit prepared in accordance with Office of Management and Budget Circular A-133. SECTION Ill IT IS MUTUALLY AGREED: 1. All obligations of STATE under the terms of this Agreement are subject to the appropriation of resources by the Legislature and the encumbrance of funds under this Agreement. Funding and reimbursement is available only upon the passage of the State Budget Act containing these STATE funds. The starting date of eligible reimbursable activities shall be JULY 1, 2014. 2. All obligations of ADMINISTERING AGENCY under the terms of this Agreement are subject to authorization and allocation of resources by ADMINISTERING AGENCY. Page 5 of 7 Non-Fed FSP 21 3. ADMINISTERING AGENCY and STATE shall jointly define the initial FSP program as well as the appropriate level of FSP funding recommendations and scope of service and equipment required to provide and manage the FSP program. No changes shall be made in these unless mutually agreed to in writing by the parties to this Agreement. 4. Nothing in the provisions of this Agreement is intended to create duties or obligations to or rights in third parties not parties to this Agreement or affect the legal liability of either party to this Agreement by imposing any standard of care with respect to the maintenance of State highways different from the standard of care imposed by law. 5. Neither STATE nor any officer or employee thereof is responsible for any injury, damage or liability occurring or arising by reason of anything done or omitted to be done by ADMINISTERING AGENCY under or in connection with any work, authority, or jurisdiction delegated to ADMINISTERING AGENCY under this Agreement. It is understood and agreed that, pursuant to Government Code Section 895.4, ADMINISTERING AGENCY shall fully defend, indemnify, and save harmless the State of California, its officers, and employees from all claims, suits, or actions of every name, kind, and description brought for or on account of injury {as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by ADMINISTERING AGENCY under or in connection with any work, authority, or jurisdiction delegated to ADMINISTERING AGENCY under this Agreement. 6. Neither ADMINISTERING AGENCY nor any officer or employee thereof is responsible for any injury, damage, or liability occurring or arising by reason of anything done or omitted to be done by STATE under or in connection with any work, authority, or jurisdiction delegated to STATE under this Agreement. It is understood and agreed that, pursuant to Government Code Section 895.4, STATE shall fully defend, indemnify, and save harmless ADMINISTERING AGENCY, its officers, and employees from all claims, suits, or actions of every name, kind, and description brought for or on account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by STATE under or in connection with any work, authority or jurisdiction delegated to STATE under this Agreement. 7. ADMINISTERING AGENCY will maintain an inventory of all non-expendable PROJECT equipment, defined as having a useful life of at least two years and an acquisition cost of $500 or more, paid for with PROJECT funds. ADMINISTERING AGENCY shall define in PROJECT contract who shall take ownership of all equipment at the conclusion of the Project. 8. ADMINISTERING AGENCY and its sub-contractors will comply with all applicable Federal and State Jaws and regulations, including but not limited to, 2 CFR, Part 225, Cost Principles for State and Local Governments, and 49 CFR, Part 18, Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments. 9. In the event that ADMINISTERING AGENCY fails to operate the PROJECT commenced and reimbursed under this Agreement in accordance with the terms of this Agreement or fails to comply with applicable Federal and State laws and regulations, STA TE reserves the right to terminate funding for PROJECT, or portions thereof, upon written notice to ADMINISTERING AGENCY. However, the non-expendable equipment and liability clauses shall remain in effect until terminated or modified in writing by mutual agreement.
