RESOLUTION NO. 2019-07-01
A RESOLUTION AUTHORIZING THE APPROVAL OF TWO ASSIGNMENT AND
MODIFICATION OF EASEMENT AGREEMENTS.
WHEREAS, Ron Anderson is the owner of certain real property located in the Town of Fraser,
described as Lot 3, Block 1, Byers Vista Subdivision; and
WHEREAS, Kathleen Marie Fisher is the owner of certain real property located in the Town of
Fraser, described as Lot 4, Block 1, Byers Vista Subdivision; and
WHEREAS, pursuant to previously recorded Easement Agreements, easements were granted
to the Grand County Library District on the above referenced properties for the installation and
operation of utilities; and
WHEREAS, the easements were described as being "exclusive" and now the parties desire to
modify the Easement Agreements to make the easements non-exclusive; and
WHEREAS, Town of Fraser owns certain utility facilities within the easement and desires to
have the Easement Agreements assigned to Fraser.
THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO THAT:
1. The Town Board of Fraser, Colorado hereby authorizes the execution of the two
attached Assignment and Modification of Easement Agreements.
READ, PASSED ON ROLL CALL VOTE, AND ADOPTED BY THE BOARD OF TRUSTEES
