Mayor Sternquist called the City Council Regular Meeting to order at 7:32 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember— Chavez, Yu, Man, Sternquist ABSENT: Councilmember — Fish ALSO PRESENT: City Manager Cook, City Attorney Vail, City Clerk Kuo Councilmember Yu made a motion to excuse Councilmember Fish for cause. Seconded by Councilmember Chavez. 3. INVOCATION Pastor Jim Walden, First Baptist Church, provided the invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop 161 led the Pledge of Allegiance. 5. CEREMONIAL MATTERS — PRESENTATIONS A. UPDATE FROM THE YOUTH COMMITTEE Youth Committee members reported on their upcoming events and Council Mentorship activities. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Lucy Liou, Neighborhood Watch Area Leader, reminded everyone to be safe during the holidays. Steve Stafford, Temple City resident, commented about debris clean up after a vehicle accident and homeless in the City. City Council Minutes November 21, 2017 Page 2 of 8 7. APPROVAL OF MINUTES The City Council is requested to review and approve: 1. Minutes of the Special City Council Meeting of November 7, 2017; 2. Minutes of the Regular City Council Meeting of November 7, 2017; and 3. Minutes of the Special City Council Meeting of November 14, 2017. Action: Approved. B. PLANNING COMMISSION ACTIONS The City Council is requested to receive and file Actions of the Regular Planning Commission Meeting of October 24, 2017. Ips Received and filed. C. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS The City Council is requested to receive and file Actions of the Regular Transportation and Public Safety Commission Meeting of November 8, 2017. Action: Received and filed. D. BRIDGE PREVENTIVE MAINTENANCE PROGRAM COOPERATIVE AGREEMENT WITH THE COUNTY OF LOS ANGELES The City Council is requested to approve the proposed Bridge Preventive Maintenance Cooperative Agreement with the County of Los Angles as this would allow the eligible bridges in Temple City to be repaired using federal Highway Bridge Program funding. Action: 1. Approved the Bridge Preventive Maintenance Program Cooperative Agreement with the County of Los Angeles; City Council Minutes November 21, 2017 Page 3 of 8 2. Authorized the City Manager to execute the agreement; 3. Approved a budget amendment for Fiscal Year (FY) 2017-18 to allocate $35,000 from Measure M fund balance; and 4. Approved a budget amendment to add Bridge Preventive Maintenance Program as a new Capital Improvement Project (CIP) in the FY 2017-18 City Budget (Street Construction/Maintenance Account No. 60-980-75-4810, CIP No. P18-07) with an allocation of $35,000 in Measure M funds. E. FISCAL YEAR (FY) 2017-18 CITY BUDGET — FIRST QUARTER BUDGET AMENDMENTS City Council is requested to approve various budgeted appropriations for the FY 2017-18 City Budget to ensure actual spending levels are within budgeted appropriations during the current fiscal year. Action: Authorized staff to revise various budgeted appropriations for the FY 2017-18 City Budget. F. FIRST QUARTER FINANCIAL STATUS REPORT The City Council is requested to receive and file the First Quarter (i.e., July - September 2017) Financial Status Report. Action: Received and filed. G. VISA CARD REPORT The City Council is requested to receive and file the Petty Cash Report. Action: Received and filed. H. ADOPTION OF RESOLUTION NO. 17-5296 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 2017-18 The City Council is requested to adopt Resolution No. 17-5296 authorizing the payment of bills. Action: Adopted Resolution No. 17-5296. 8. PUBLIC HEARING A. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 17-1026 AMENDING TITLE 4 AND 9 OF THE TEMPLE CITY MUNICIPAL CODE TO ADOPT REGULATIONS ON UNATTENDED COLLECTION BOXES AND OTHER COLLECTION AND RECYCLING FACILITIES AND ADOPTION OF City Council Minutes November 21, 2017 Page 4 of 8 RESOLUTION 17-5295 TO ADOPT A RELATED PERMIT FEE Unattended collection boxes (UCB) are used by a variety of for-profit and non- profit organizations to collect previously used items for recycling reuse, or resale. The boxes are often placed on properties without the owner's permission and often lead to property maintenance issues and act as an attractive nuisance. City Manager Cook gave a brief overview regarding the unattended collection boxes in the City. Planning Manager Reimers gave a summary of the staff report. City Council asked questions regarding the proposed ordinance for the UCB. Mayor Sternquist opened public hearing. Steve Stafford and Lucy Liou, Temple City residents, spoke in support of staff's recommendation. Hearing no request to speak, Mayor Sternquist closed public hearing. Councilmember Chavez made a motion to introduce for first reading by title only and waive further reading of Ordinance No. 17-1026, amending Title 4 and 9 of the Temple City Municipal Code to adopt regulations for unattended collection boxes and other recycling and collection facilities; waive further reading of Ordinance No. 17-1026; schedule the second reading of Ordinance No. 17-1026 for December 5, 2017; and adopt Resolution No. 17-5295 amending the Master Fee and Fine Schedule for Fiscal Year 2017-18, to establish a new fee for UCB permits. Seconded by Councilmember Yu and carried by the following votes: AYES: Councilmember—Chavez, Yu, Man, Sternquist NOES: Councilmember — None ABSTAIN: Councilmember — None ABSENT: Councilmember — Fish 9. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 17-1027 AMENDING TITLE 3, CHAPTER 4, ARTICLE D OF THE TEMPLE CITY MUNICIPAL CODE RELATIVE TO TREE PRESERVATION AND PROTECTION The City Council is requested to adopt the proposed ordinance which will clarify specific sections of the Temple City Municipal Code (TCMC) in regards to tree removal appeals and bring the TCMC into compliance with recent City Council policies regarding public and private trees and sidewalks. City Council Minutes November 21, 2017 Page 5 of 8 City Attorney Vail reported that staff is requesting City Council's consideration to table the adoption of this ordinance to allow staff time to incorporate additional changes. Councilmember Yu made a motion to table the adoption of Ordinance No. 17- 1027 amending sections 3-4D-7, 3 -4D -10:D, and 3-4D-11 of the Temple City Municipal Code relative to tree preservation and protection. Seconded by Mayor Pro Tem Man and carried by the following votes: AYES: Councilmember— Chavez, Yu, Man, Sternquist NOES: Councilmember— None ABSTAIN: Councilmember — None ABSENT: Councilmember — Fish B. LOS ANGELES COMMUNITY CHOICE ENERGY PROGRAM UPDATE This report provides an update on the status of the Los Angeles Community Choice Energy (LACCE) program and addresses questions raised by the City Council at the meeting of September 17, 2017. City Manager Cook gave an overview regarding the LACCE. City Council asked questions regarding the LACCE program. Community Development Director Forbes answered City Council questions and provided additional information. City Council discussed and made comments regarding membership with the LACCE. Mayor Sternquist opened public comment. Steve Stafford, Temple City resident, made comments regarding energy options. Jim Clift, Temple City resident, expressed concerns regarding the cost that will trickle down to the consumers as the energy companies update and maintain their facilities and infrastructure. Hearing no request to speak, Mayor Sternquist closed public hearing. City Council directed staff to reach out to the Los Angeles County and LACCE for additional information on the energy option and prepare a draft ordinance for City Council's consideration at the first meeting in December. 10. UPDATE FROM CITY MANAGER Shared upcoming City events and reported out on the progress of the curb address painting project and Temple City Pavement Project. Preventative maintenance will begin on Rosemead Boulevard in the spring. 13. UPDATE FROM CITY ATTORNEY Apprised City Council that there are law firms that are submitting petitions to cities regarding the regulation of recreational marijuana. Councilmember Chavez left the meeting at 8:52 p.m. and returned at 8:53 p.m. 14. COUNCIL REPORTS REGARDING AD HOC OR STANDING COMMITTEE MEETINGS A. The Committee received an update regarding the Pavement Management Report, Bridge Preventative Maintenance Program, and the Street Light LED Conversion Program. MAYOR STERNQUIST Complimented staff on the successful Veteran's Day Celebration and reported on the donation amount collected to date for the art component of the Library Renovation Project. She also announced that the City will be selling bricks to help raise funds toward the art component for the Library as well. C. MAYOR PRO TEM MAN Complimented staff on the successful Veteran's Day Celebration. D. COUNCILMEMBER CHAVEZ Complimented staff on the successful Veteran's Day Celebration. He also shared with Council the activities at the California Joint Power Insurance Authority. E. COUNCILMEMBER FISH —Absent 16. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Lucy Liou, Neighborhood Watch Area Leader, spoke regarding recreational marijuana. Jerry Jambazian, Temple City business owner, shared that Senator Ed Chau donated 40 turkeys to the Kiwanis Club for needy Temple City residents.
