HomeMy Public PortalAbout09.5) General Plan - Attachment A - CC Resolution 17-5298RESOLUTION NO. 17-5298 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT (STATE CLEARINGHOUSE NO. 2016091047) FOR THE MID- CENTURY GENERAL PLAN UPDATE AND CROSSROADS SPECIFIC PLAN, AND ADOPTING CEQA FINDINGS, A MITIGATION MONITORING AND REPORTING PROGRAM, AND A STATEMENT OF OVERRIDING CONSIDERATIONS WHEREAS, the City Council of the City of Temple City ("City Council") proposes to adopt the Mid-Century General Plan Update (“General Plan”) and the Crossroads Specific Plan (“Specific Plan”); and WHEREAS, the City of Temple City is the lead agency for the General Plan and Specific Plan pursuant to the California Environmental Quality Act ("CEQA," Cal. Pub. Res. Code §21000 et seq.) and the State CEQA Guidelines (the "Guidelines," 14 Cal. Code Regs. §15000 et seq.); and WHEREAS, pursuant to Guidelines Section 15063, the City conducted an Initial Study for the General Plan Update and determined that an Environmental Impact Report ("EIR") should be prepared; and WHEREAS, the City issued a Notice of Preparation ("NOP") of an EIR on September 16, 2016 (see Appendix A of the Draft EIR), and provided the NOP and the Initial Study to the Office of Planning and Research ("OPR"), as well as to responsible, trustee, and other interested agencies and persons in accordance with Guidelines Section 15082(a); and posted in the Los Angeles County Clerk's o ffice; and WHEREAS, pursuant to Guidelines Sections 15063 and 15082, the City solicited input on the contents and scope of the EIR for a 30-day period, from September 19, 2016 to October 18, 2016; and WHEREAS, an EIR scoping meeting was held on September 29, 2016, at 7:30 p.m. in the City’s Council Chambers; and WHEREAS, comments received on the NOP during the public review period are contained in Appendix B of the Draft EIR; and WHEREAS, pursuant to Public Resources Code Section 21092 and Guidelines Sections 15087 and 15085, the City provided a Notice of Completion and Availability ("NOA") of the Draft EIR (State Clearinghouse No. 2013091009) on June 19, 2017; and Resolution No. 17-5298 PL 17-865 Page 2 of 4 WHEREAS, copies of the Draft EIR were placed at the City's Community Development Department counter at 9701 Las Tunas Drive at the County of Los Angeles Temple City Library and on the City's website; and WHEREAS, the Draft EIR was circulated, together with technical appendices, for a 45-day public comment period, from June 20, 2017 through August 3, 2017, and received comments from the public and other agencies during and after the comment period; and WHEREAS, during the comment period, the City held two community meetings (June 26, 2017 and July 8, 2017) and the Planning Commission hosted a community forum on July 25, 2017 to receive comments on the Draft General Plan, Specific Plan and EIR; and WHEREAS, during the public comment period the City received written and oral comments on the Draft EIR, and consulted with all responsible and truste e agencies and other regulatory agencies pursuant to Guidelines Section 15086; and WHEREAS, pursuant to Guidelines Section 15088 the City prepared written responses to all written comments received on the Draft EIR and revised the Draft EIR, as appropriate, in response to those comments; and WHEREAS, on November 2, 2017, the Final Environmental Impact Report (the "Final EIR") including responses to comments, mitigation monitoring and reporting program (“MMRP”), errata, and corrections was posted and made available on the City's website and these responses were also distributed in accordance with Public Resources Code Section 21092.5 and Guidelines Section 15088; and WHEREAS, on November 14, 2017, the Planning Commission held a duly noticed public hearing on the General Plan, Specific Plan and the Final EIR at which the Planning Commission recommended to the City Council adoption of the General Plan and Specific Plan (subject to the recommended changes found in Attachments H, I, M, and N, of the City Council staff report dated December 5, 2017) and certification of the Final EIR; and WHEREAS, consistent with Guidelines Section 15132, the Final EIR is comprised of the Draft EIR, along with the comments and responses to comments on the Draft EIR, revisions to the Draft EIR, the technical appendices, and the MMRP; and WHEREAS, the City Council held a duly noticed public hearing on the General Plan, Specific Plan and the Final EIR on December 5, 2017; and WHEREAS, after reviewing the responses to comments, the revisions to the Draft EIR, and other information added to the Final EIR, the City Council has concluded that these responses, revisions, and additional information merely clarify and amplify the analysis presented in the EIR, and do not constitute significant new information requiring recirculation of the Draft EIR under Guidelines Section 15088.5; and Resolution No. 17-5298 PL 17-865 Page 3 of 4 WHEREAS, the City Council finds that, as required by CEQA, the Final EIR describes all feasible mitigation measures which could minimize the General Plan’s and Specific Plan’s significant impacts; and WHEREAS, the City Council finds that there are significant environmental impacts arising from the General Plan and Specific Plan that remain even after mitigation, but there are overriding considerations that outweigh those impacts; and WHEREAS, prior to any discretionary approvals associated with the General Plan and Specific Plan, the City Council must certify the Final EIR pursuant to Guidelines Section 15090, make CEQA findings pursuant to Guidelines Section 15091, adopt a MMRP consistent with Guidelines Section 15097, and adopt a Statement of Overriding Considerations ("SOC") consistent with Guidelines Section 15093; and WHEREAS, a MMRP has been prepared by the City and is included as an Attachment D to the City Council Staff Report dated December 5, 2017; and WHEREAS, CEQA Findings of Fact and a SOC have been prepared by the City and are included as Attachment E to the City Council Staff Report dated December 5, 2017; and WHEREAS, the documents, staff reports, technical studies, appendices, plans, and other materials that constitute the record of proceedings on which this resolution is based are on file and available for public examination during normal business hours in the City Clerk’s Office, who serves as the custodian of these records. THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESOLVES: SECTION 1. The above recitals are true and correct and are incorporated herein by reference as if set forth in full. SECTION 2. The City Council has reviewed and considered the Planning Commission's recommendations associated with the General Plan, Specific Plan and the Final EIR. SECTION 3. The City Council has reviewed and considered all oral and written testimony received. SECTION 4. The City Council certifies that: (1) The Final EIR has been completed in compliance with CEQA, Resolution No. 17-5298 PL 17-865 Page 4 of 4 (2) The Final EIR was presented to the City Council and that the City Council has reviewed and considered the information contained in the Final ElR prior to approving the General Plan and Specific Plan, and (3) The Final EIR reflects the City's independent judgment and analysis. SECTION 5. The City Council adopts the CEQA findings and Statement of Overriding Considerations contained in Attachments E of the City Council staff report dated December 5, 2017. SECTION 6. The City Council adopts the MMRP contained in Attachment D of the City Council staff report dated December 5, 2017 . SECTION 7. The Secretary shall certify to the adoption of this Resolution.
