HomeMy Public PortalAbout09.5) General Plan - Attachment F - CC Resolution 17-5299RESOLUTION NO. 17-5299 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA ADOPTING THE MID- CENTURY GENERAL PLAN UPDATE (A GENERAL PLAN AMENDMENT) (FILE PL 17-865) WHEREAS, the State of California Government Code Section 65300 requires the City to adopt and maintain a General Plan that contains certain elements and describes its long-term goals, and develop policies and programs to achieve those goals; and WHEREAS, the City has been operating under a General Plan adopted in 1987 consisting of General Plan text and maps; and WHEREAS, the City Council initiated a comprehensive update to the City’s General Plan to revise the plan to bring it into conformance with State law and to make all the elements internally consistent; and WHEREAS, the updated General Plan will supersede the 1987 General Plan text and maps; and WHEREAS, the City Council adopted the 2014-2021 Housing Element of the General Plan on January 7, 2014, which shall remain in full force and effect; and WHEREAS, the City Council created the General Plan Advisory Committee (GPAC) on May 6, 2014 and appointed its members on July 1, 2014 to oversee the preparation of the General Plan and Specific Plan and provide recommendations to the City Council; and WHEREAS, the City has sought to proactively engage the public in the update to the General Plan and the Specific Plan, including 10 community outreach workshops and meetings, 18 GPAC meetings, and conducting special meetings of the Planning Commission, and gave regular updates to the Planning Commission and City Council; and WHEREAS, the City as Lead Agency determined that the proposed General Plan was a “Project” under the California Environmental Quality Act (CEQA) and that preparation of an Environmental Impact Report (EIR) was warranted; and WHEREAS, the City issued a Notice of Preparation on September 16, 2016 and received comments from other agencies and members of the public; and Resolution No. 17-5299 PL 17-865 Page 2 of 4 WHEREAS, the City issued a Notice of Availability of a Draft EIR on June 19, 2017 with a public comment period of June 20, 2017 to August 3, 2017, and received comments from the public and other agencies during and after the comment period; and WHEREAS, during the Draft EIR comment period the City staff hosted two community meetings (June 26, 2017 and July 8, 2017) and the Planning Commission hosted a community forum on July 25, 2017 to receive comments on the Draft General Plan and EIR; and WHEREAS the City staff is recommending changes to the Draft General Plan because of the public input and comments that were received; and WHEREAS, the General Plan Advisory Committee and Planning Commission have reviewed the General Plan and recommended that the City Co uncil adopt the General Plan with some changes; and WHEREAS, the City Council has reviewed and considered information from a variety of sources, including, but not limited to, City staff, outside agencies, the Environmental Impact Report, and the report and recommendations of the GPAC, Planning Commission, and members of the public; and WHEREAS, public notice was provided as required by law and a City Council public hearing was held on December 5, 2017; and WHEREAS, the City Council has certified the Final EIR as being in compliance with CEQA as has adopted CEQA findings, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program pursuant to CEQA. THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESOLVES: SECTION 1. That after careful consideration of text, maps, facts, exhibits, testimony, staff reports, public comments, other evidence submitted in this matter, and the substantial evidence in the record, the City Council adopts the Mid-Century General Plan Update as reflected in Attachment G and as modified in Attachments H and I of the City Council staff report dated December 5, 2017. The City Clerk shall cause to be prepared a final General Plan document inclusive of all these approved revisions, which document shall be placed on file in the office of the City Clerk and is incorporated by reference. SECTION 2. The findings in support of the proposed General Plan and Specific Plan are as follows: 1. The proposed General Plan and Specific Plan contain a thorough and adequate treatment of land use, economic, environmental, and development issues within the realm of the planning period. The General Plan contains Land Use, Mobility, Economic Development, Community Services, Natural Resources, Resolution No. 17-5299 PL 17-865 Page 3 of 4 and Hazards Elements which together make up six of the required seven elements in State Law. The existing Housing Element, the remaining required element remains in full effect, having been adopted by the City Council in 2014. 2. The proposed General Plan is internally consistent. 3. The proposed General Plan would not be a detriment to the public interest, health, safety, convenience, and welfare of the city. 4. The proposed General Plan encourages appropriate land uses, preservation of neighborhood character and natural resources, infill of vacant and underutilized land area, new multi-family residential development, provision of urban services and utilities, pedestrian facilities and enhancement of the property tax base. 5. The proposed General Plan includes a wide variety of objectives, policies, and implementing programs designed to enhance the public h ealth, safety, and welfare, including the Safety Element which addresses soil limitations, flood hazard, potable water supplies, emergency preparedness, fire protection, and police protection. The Plan further protects the public health by and safety through reliance on mitigation measures and policies requiring the adoption of impact fees. 6. The proposed General Plan addresses the issue of climate change and contains numerous policies designed to reduce the impact of future development on climate change. 7. The proposed General Plan and Specific Plan have been prepared in accordance with the California Government Code, and the City has prepared a Final Environmental Impact Report in accordance with the provisions of the California Environmental Quality Act. SECTION 3. The Secretary shall certify to the adoption of this Resolution.
