CITY COUNCIL
MINUTES
OCTOBER 21, 1986
INITIATION:
1. CALL TO ORDER:
Mayor Atkins called the regular meeting of the City
Council to order at 7:30 p.m. on Tuesday, October 21,
1986.
2. The invocation was given by Pastor Judy Bever of the
Temple City Christian Church,,9723 Garibaldi Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor
Atkins.

Councilman Gillanders moved to excuse Councilman Dennis
with cause, seconded by Councilman Swain and unanimously
carried.
PRESENTATIONS:
1. Southern California Edison Co. presented to the City
Council a framed resolution expressing appreciation
of the City's support.
2. Mayor Atkins proclaimed the month of October Soropti-
mist International Month in recognition of the anni-
versary of the founding of this organization and in
appreciation for the club's many contributions to the
community.
3. Mayor Atkins proclaimed the month of November Veter-
ans' Unity Month and presented the proclamation to
Sam Candela of the State Department of Employment.
5. CONSENT CALENDAR:
Mayor Atkins advised that a request had been received by
the City staff to remove item D. (1) from the Consent
Calendar.
Councilman Swain requested that a correction be made in
the Minutes to reflect Councilman Swain's absence and
Mayor Atkins' presence.
On motion by Councilman Gillanders, seconded by Council-
man Froehle, the remaining items on the Consent Calendar
were unanimously approved as recommended with Councilman
Swain abstaining on item A.

B. RECOMMENDATION FROM TRAFFIC COMMISSION MEETING OF
OCTOBER 1, 1986 - HOLIDAY PARKING ENFORCEMENT - PUBLIC
PARKING LOTS, CENTRAL BUSINESS DISTRICT
Council concurred with the Commission's recommenda-
tion to approve the request for parking enforcement
by the Sheriff's Department five days a week, four
hours per day, Monday through Friday, December 8 to
24 in the business district.
C. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION
MEETING OF OCTOBER 15, 1986 - REQUEST FOR RESERVED
USE OF TENNIS COURTS BY TEMPLE CITY HIGH SCHOOL
City Council approved the request from Temple City
High School for use of the seven tennis courts at
Live Oak Park to conduct the Rio Hondo League Girls
and Boys Tennis Prelims and Finals as detailed in the
staff memo dated October 16, 1986.
D. RECOMMENDATIONS FROM PLANNING COMMISSION MEETING OF
OCTOBER 14, 1986
(2) PROPERTY NUISANCE - 4912 EL MONTE AVENUE;

As no appeal was received, Council adopted
Resolution No. 86 -2671, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF TEMPLE CITY DECLARING
CERTAIN PREMISES TO BE A PUBLIC NUISANCE AND
ORDERING ABATEMENT THEREOF.
(3) PLANNING COMMISSION ACTION
Council received and filed memo from the Plan-
ning Commission outlining action taken at the
Commission's meeting of October 14, 1986.
E. MAINTENANCE SERVICE AGREEMENT - COMPUCORP SYSTEM
Council authorized payment to Advanced Inter Systems
in the amount of $5,590.20 for the period ending
June 30, 1987 for a maintenance service agreement on
computer equipment.
F. RESOLUTION NO. 86 -2668: UPDATE OF EMERGENCY SERVICES
SIGNATURES
City Council adopted Resolution No. 86 -2668, A RESO-
LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
DESIGNATING AUTHORIZED REPRESENTATIVES TO SIGN APPLI-
CATIONS AND DOCUMENTS FOR FEDERAL FUNDING UNDER THE
CIVIL DEFENSE ACT OF 1950.
G. RESOLUTION NO. 86 -2670: EMPLOYMENT OF PERSONNEL
Council adopted Resolution No. 86 -2670 appointing
budgeted personnel.
H. RESOLUTION NO. 86 -2669: WARRANTS AND DEMANDS
Council adopted Resolution No. 86 -2669 authorizing
payment of bills.
D. (1) CLARIFICATION OF AMBIGUITY TO ALLOW GYMNASIUMS
AND HEALTH CLUBS IN THE C -2 ZONE WITH CONDI-
TIONAL USE PERMIT

City Manager Koski stated that he had been
advised that the applicant for a gymnasium
business in the C -2 zone had requested that this
item be removed from the Consent Calendar for
further discussion as the applicant felt that
the requirement of a CUP was a burden for him.

City Attorney Martin stated that this was not a
public hearing this evening, but rather an
interpretation of the Code. Since gymnasiums
are not listed in the Zoning Code, Council has
been requested by the Planning Commission to
approve of the clarification as to what
classification of business a gymnasium falls
under.
Daniel Cortez, 11914 Liscomb Street, El Monte
91732, advised that he is one of the applicants
for the subject business occupancy. It was the
opinion of Mr. Cortez that his proposed business
was closer to a reducing salon than to the
classification given by the Planning Commission.
He stated that individuals who frequent a gym do
not usually "hang around ", but rather come, work
out and leave immediately. Mr. Cortez did not
want to invest in the renovation of the building
without a firm commitment of an approval from
the City.
Councilman Froehle explained to Mr. Cortez the
importance of the CUP process and the precedent
the Council would be setting in categorizing his
type of business.
Councilman Gillanders moved to affirm the Plan-
ning Commission's clarification of ambiguity to
allow a gymnasium and /or health club in the C -2
zone with a Conditional Use Permit; and request
that the Commission initiate an amendment to the
Temple City Zoning Code, seconded by Councilman
Froehle and unanimously carried.
City Attorney Martin introduced for first read-
ing by title only Ordinance No. 86 -596, AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY AMENDING SECTIONS 9380(a) AND 9202
OF THE TEMPLE CITY ZONING CODE ALLOWING GYMNASI-
UMS AND HEALTH CLUBS AS A PERMITTED USE IN THE
C -2 ZONE WITH A CONDITIONAL USE PERMIT.
Councilman Froehle moved to waive further read-
ing, seconded by Councilman Swain and unani-
mously carried.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: ORDINANCE NO. 86 -595 EXTENDING
SECTIONS 3 AND 4 OF ORDINANCE NO. 86 -592 AS IT RE-
LATES TO SECTION 9455 OF THE TEMPLE CITY ZONING CODE
(PURSUANT TO GOVERNMENT CODE SECTION 65858) PERTAIN-
ING TO BUSINESS REGULATIONS AND ADULT BUSINESSES
City Manager Koski provided background information
stating that on September 16 City Council adopted
Urgency Ordinance No. 86 -592 amending and /or adding
sections of the Municipal and Zoning Codes relating
to business regulations and adult businesses. On
September 30, 1986 the Planning Commission recom-
mended the extension of Sections III and IV of the
Ordinance amending Section 9455 of the Zoning Code.
The amendments to Section 9455 revises the definition
of adult business to provide that it would include
any business which is at any time or times conducted
substantially or more than de minimus for the patron-
age of adults. It also expands adult businesses to
include any business dispensing "sexually oriented"
or "viewing for pay" as a predominant, principal or
substantial, significant or even occasional part of
the business.

Mayor Atkins declared the public hearing open and
invited those wishing to speak in favor or against
the Ordinance to come forward.
As no one wished to address the City Council, Coun-
cilman Swain moved to close the public hearing,
seconded by Councilman Gillanders and unanimously
carried.
Councilman Gillanders moved to approve the Negative
Declaration of Environmental Impact, seconded by
Councilman Froehle and unanimously carried.
Councilman Froehle moved to waive further reading and
adopt Ordinance No. 86 -595, AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF TEMPLE CITY EXTENDING SECTIONS
3 AND 4 OF URGENCY ORDINANCE NO. 86 -592 AMENDING
SECTION 9455 OF THE TEMPLE CITY ZONING CODE RELATING
TO BUSINESS REGULATIONS AND ADULT BUSINESS, seconded
by Councilman Swain and unanimously carried.
7. NEW BUSINESS:
A. L.A. COUNTY SOLID WASTE MANAGEMENT PLAN - VOLUME II,
HAZARDOUS WASTE ELEMENT
City Manager Koski referred Council to the staff memo
dated September 18, 1986, which summarized the
County's Waste Management Plan.
Councilman Gillanders moved to approve the prelimi-
nary draft of the L.A. County Solid Waste Management
Plan - Volume II as presented; and requested the
matter be turned over to the Planning Commission for
study and possible incorporation into the City's
General Plan, seconded by Councilman Swain and unani-
mously carried.

9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
None wished to address Council.
RECESS TO CRA:
At this time Council recessed to meet as the Temple City
Community Redevelopment Agency; approved the Minutes of
their regular meeting of October 7, 1986; approved the
restriping of the CRA parking lots; and adopted Resolu-
tion No. CRA 284: Warrants and Demands in the amount of
$156,475.76.
10. ACTION ON REQUEST BY CRA:
None
11. MATTERS FROM CITY OFFICIALS:
A. DIAL -A -RIDE CHRISTMAS PROMOTION
Councilman Gillanders recommended that the City
assist the seniors and handicapped during the holiday
season by waiving the $.50 fare normally charged.
This promotion would encourage ridership and also be
a financial assist to present riders.
Councilman Gillanders moved to waive the Dial -a -Ride
fare during the month of December, seconded by Coun-
cilman Swain and unanimously carried.

B. Councilman Froehle recognized Planning Director Shaw
for his service to the City, and offered his good
wishes for success in the City of Redlands.
12. ADJOURNMENT:
On motion by Councilman Swain, seconded by Councilman
Froehle, the meeting of the City Council adjourned at
8:20 p.m. The next regular meeting of the City Council
will be held on Tuesday, November 4, 1986.
