Councilmember F ish called the City Council Regular Meeting to orde r at 7 :3 1 p .m. in the Council Chambers located at 59 3 8 Kauffman Ave nue , Temple City. 2. ROLL CALL PRESENT: Counc ilmember -Chavez , Fish , Yu ABSENT : Councilmember-Man , Sternquist ALSO PRESENT: City Manager Cook , City Attorney Vail , City Clerk Kuo Councilmember Chavez made a motion to excuse Mayor ProTem Man and Mayor Sternquist for cause . Seconded by Councilmember Yu . 3. INVOCATION Pastor Darrel Kelty, Community of Ch rist, provided the invocation . 4. PLEDGE OF ALLEGIANCE Girl Scout Troop 5141 led the pledge of a ll egiance . 5. CEREMONIAL MATTERS -PRESENTATIONS A. PET OF THE MONTH Doreen Hudson , San Gabriel Valley Humane Society Board Pres ident, introduced the featured pet of the month "Duplaix". Those interested in adopting Duplai x can call the San Gabriel Valley Humane Society at (626) 286-1159. B . 2017 BOOKMARK CONTEST WINNERS AND HONORABLE MENTIONS City Council presented certificate s of recognition to the bookmark contest honorees and winners. CONSIDERATION TO RELAX THE ENFORCEMENT OF OVERNIGHT PARKING RESTRICTIONS DURING THE HOLIDAY SEASON City Council is requested to re la x the enforcement of overn igh t parking restriction from 12 :00 m idnight on Sunday, December 17 , 2017 to 11 :59 p.m . on Monday, January 8 , 2018 . Action : Approved relaxing of overnight parking restriction enforcement from 12:00 midnight on Sunday , December 17 , 2017 to 11 :59 p .m. on Monday, January 8 , 2018 . F. SECOND AMENDMENT TO CITY MANAGER EMPLOYMENT AGREEMENT Approval of the Second Amendment to City Manage r's Employment Agreement will grant the City Manager a 2% cost of living adjustment. Act ion : Approved the Second Amendment to the City Manager's Employment Agreement. G . ADOPTION OF RESOLUTION NO . 17-5294 APPROVING PAYMENT OF BILLS FOR FISCAL YEAR 20 17-1 8 The City Council is requested to adopt Resolution No . 17-5294 authorizing the payment of bills . Action : Adopted Resolution No . 17-5294. 8. PUBLIC HEARING A. CONTINUED HEARING ON APPLICATION FOR FORTUNE TELLER PERMIT SUBMITTED BY C&C CRYSTAL ADVISORS The C ity Council opened the public hearing on October 17 , 2017 , to consider a request for a fortun e teller permit. At the applicant's re quest, the City Council continued the hearing to November 7 , 2017 . City Manager Cook gave a brief overview of the public hearing. City Attorney Vail advised Council on the proceedings for the public hearing City Council Minutes November 7 , 2017 Page 4 of 8 and to consider only the issues presented. Community Development Director Forbes gave a brief summary of the staff report . Councilmember Fish opened public hearing. Ms. Appleton, representative for C & C Crystal Advisors , made comments and answered City Council's questions (i.e., who Chloe is , operating the business without a business license , "psychic" versus entertainment, etc.). Miller Yonko, father of the applicant, made comments regarding his son 's application for a fortune telling permit. Patricia Delgado , member of the public , made comments regard i ng her experience with Chloe in August. Peter Choi , Temple City Chambers President/CEO , spoke in favor of staff's recommendation . Ms . Appleton, representative for C & C Crystal Advisors, answered Counci l's questions . Hearing no further request to speak , Councilmember Fish closed public hearing . Councilmembers made comments regarding the testimonies received . Councilmember Yu made a motion to deny C & C Crystal Advisor's application for a fortune teller permit. Seconded by Councilmember Chavez and carried by the following votes : AYES : NOES : ABSTAIN : ABSENT: Councilmember-Chavez, Fish , Yu Councilmember-None Councilmember-None Councilmember-Man , Sternquist B. FIRST READING AND INTRODUCTION OF ORDINANCE NO . 17-1027 AMENDING TITLE 3 , CHAPTER 4 , ARTICLE D OF THE TEMPLE CITY MUNICIPAL CODE RELATIVE TO TREE PRESERVATION AND PROTECTION The proposed ordinance amendment will clarify sections of the Temple City Municipal Code in regards to t ree removal appeals and bring the code into compliance with recent City Council policies regarding public and private trees and sidewalks . City Council Minutes November 7 , 2017 Page 5 of 8 Parks and Recreation Director Burroughs gave a brief summary of the staff report . City Council asked questions regarding the proposed ordinance amendment. Councilmember Fish opened public hearing. Hearing no request to speak , Councilmember Fish closed public hearing . City Council commented further regarding the proposed ordinance amendment. Councilmembers Chavez and Fish spoke in favor of the amendment as recommended by the Parks and Recreation Commission and included in the proposed ordinance . Councilmember Yu spoke in favor of Sections 3-4D-1 0, PERMITS; and 3-4D-11, APPEALS, be adopted per staff's original recommendation to the Parks and Recreation Commission restricting appeals to individual who live or own property within 1,000 from the subject tree . Councilmember Chavez introduce Ordinance No. 17-1027 for first reading by title only , amending Sections 3-4D-7, 3-4D-10:D , and 3-4D-11 of the Temple City Municipal Code ; waived further reading of Ordinance No. 17-1 027 ; and scheduled the second reading of Ordinance No . 17-1027 for November 21 , 2017 . Seconded by Councilmember Fish and carried by the following votes : AYES : NOES : ABSTAIN : ABSENT: Councilmember-Chavez , Fish Councilmember-Yu Councilmember-None Councilmember-Man , Sternquist City Attorney Vail advised the City Council that adoption of the ordinance on November 21, 2017 would require three affirmative votes . 9. DIRECTION REGARDING DEPLOYMENT OF AUTOMATED LICENSE PLATE RECOGNITION (ALPR) CAMERA SYSTEM AND PARTICIPATION IN THE RING REBATE PROGRAM In continuing the City 's effort to reduce crime , City Council is requested to consider implementation of ALPR camera systems and Ring rebate program . Public Safety Supervisor Ariizumi gave a brief summary of the staff report . I City Council made comments and asked questions regarding the proposed ALPR camera system and Ring Rebate Program . Councilmember Fish opened public comment. City Council Minutes November 7 , 2017 Page 6 of 8 Jerry Jambazian, Temple City business owner, asked questions regard i ng the ALPR camera system and Ring Rebate Program . Hearing no further request to speak , Councilmember Fish closed public comment. Councilmember Chavez made a motion to approve the deployment of Automated License Plate Recognition (ALPR) camera systems and participation in the Ring Rebate Program ; approve a budget amendment in the amount of $4 ,650 for the ALPR camera systems ; and approve a budget amendment i n the amount of $20 ,000 and authorize the City Manager to pursue a partnership agreement with Ring .
