HomeMy Public PortalAbout10A Unattended Collection Box PresentationUnattended Collection Boxes, Reverse Vending Machines, Collection Facilities, and Other Recycling Facilities Ordinance 17-1026PL 17-915Citywide City Council Meeting November 21, 2017 Background Relating to Unattended Collection Boxes 2 Community Preservation Issues with UCBs Placed in the public right of way Placed on private property without permission Placed in landscape planters Private property owners do not maintain or manage the box Boxes are not emptied often enough Items overflow onto the ground around the UCB Vandalism People scavenge through uncollected materials UCB Regulations 3 Permit: Operator must obtain a permit from the CD Director Application must include: Property owner and operator acknowledgement of regulations Maintenance plan Permit expires annually Permit cannot be approved if there are public nuisances onsite UCB Regulations 4 •Buffers from residences & other UCBs •Site must be occupied •Cannot be In the public right of way Within 5 feet of the right of way In landscaping Five feet from a property line •Cannot block walkways, driveways, fire lanes, etc. UCB Regulations •One UCB is permitted per parcel •Physical Attributes Made of durable waterproof and rustproof material Be locked No more than 7’ x 6’ x 6’ •Sign must include box & operator information 5 Recycling and Donation Facilities Reverse Vending Machines Collection Facilities Permit Process: Zoning Clearance Permit Process: Conditional Use Permit Distance from Residences: 50 feet Distance from Residences: Same Distance from Right of Way: --Prohibited within 20 feet of the public right of way, within 5 feet of a property line, or in landscaping Distance from Right of Way: --Prohibited within 45 feet from any public right of way; --Must be screened from view of the Right of Way with landscaping 6 Recycling and Donation Facilities Reverse Vending Machines Collection Facilities No blocking parking, driveways, walkways, or the like No blocking parking, driveways, walkways, or the like Dimensions: No more than 50 square feet and 8 feet high Dimensions: No larger than 500 square feet Hours of Operation: Within the operating hours of the main use Hours of Operation: Attended facilities within 100 feet of a residence may only operate between 9:00 a.m. and 7:00 p.m. 7 Recycling and Donation Facilities •Material recycling plants •Prohibited in all commercial and residential zones. •CUP required in manufacturing zones •Performance standards, operations, maintenance, etc. handled through the CUP process 8 Planning Commission Review On October 10, 2017 the Planning Commission recommended approval of the Ordinance 17 -1026 without any changes. 9 Recommendation 10 1.Introduce for first reading by title only and waive further reading of Ordinance No. 17 -1026 (Attachment “A”), amending Titles 4 and 9 of the Temple City Municipal Code (TCMC) to adopt regulations for unattended collection boxes (UCBs) and other recycling and collection facilities; 2.Waive further reading of Ordinance No. 17 -1026; 3.Schedule the second reading of Ordinance No. 17 -1026 for December 5, 2016; and 4.Adopt Resolution No. 17 -5295 (Attachment “B”) amending the Master Fee and Fine Schedule for Fiscal Year (FY) 2017 - 2018, to establish a new fee for UCB permits.
