You may consider this letter as authorization and permission to extend this permit until December 31, 1990. The easement rules for submerged lands and formerly submerged lands should be adopted by that time. A permanent easement will then be issued to replace this permit. The easements have also been reviewed by Public Works Director Larry Chalfant. I would ask that the following language be Inserted in both - easement agreements: The Grantor does hereby covenant with theGrantee that it is lawfully seized and possessed of the above mentioned and described tract of land, and it has a good and lawful right to convey said easements, and that it will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever. Given that addition, it is my opinion that the prepared easements would be acceptable. Please keep me advised of your actions with regard to these easements. Dear Mr. Schmidt: Enclosed is the executed subject easement authorizing an underwater sewerline in the bed of the North Fork of the Payette River and Payette Lake. This document is now ready to be recorded in the office of the Valley County Clerk -Recorder. This amended easement replaced State ,of Idaho Easement No. 5129 which was issued on August 25, 1983 and State of Idaho Temporary Permit No. 1948 which was issued on May 28, 1987.
